Skvada, III Secretary On May 15, 2013, David Buetow from Charlotte -Mecklenburg Stormwater Services (CMSWS), conducted a site inspection of the Contech facility located at 4242 Raleigh St. in Charlotte, Mecklenburg County, North Carolina. The site drains to an upper tributary of Little Sugar Creek Creek, Class C waters located in the Catawba River Basin. The site visit and file review revealed that the subject facility is covered by NPDES General Stormwater Permit— NCG03000. This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section H. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop and implement site -specific comprehensive Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge. Copies of the general permits and accompanying documents can be accessed from the following webpage: http://portal.nedenr.org/webfwq/ws/su/npdessw#General_Permits_NPDES. Permit text, technical bulletins, discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES General Stormwater Permit] can be found on this website. The following items are a subset of permit requirements and are listed to assist you and help bring your attention to certain permitting issues, process and condition requirements of your. permit. Please see the above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day. • Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit • All persons desiring to have facilities covered by a General Permit must register with the Division of Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees. • This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any discharge of stormwater associated with the industrial activity, process wastewater, and/or mine dewatering. • Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked. • Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable. non-stormwater discharge or is covered by another permit, authorization, or approval. • There are currently 19 active general permits. Copies of the analytical monitoring results shall also be maintained on site. The Permittee shall retain records of all monitoring information, including all calibration and maintenance records and all original strip -chart recordings for continuous monitoring instrumentation, and copies of all reports required by this general permit for a period of at least 5 years from the date of the sample measurement, report, or application. o Expiration — The permittee is not authorized to discharge after the expiration date of the general permit. In order to receive automatic authorization to discharge beyond the expiration date, the permittee shall submit forms and fees as are required by the agency authorized to issue permits no later than 180-days prior to the expiration date. Any permittee that has not requested renewal at least 180 days prior to expiration, or any permittee that does not have a permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subject to enforcement. Failure to renew your permit is a violation. o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not transferable to any person expect after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the Certificate of Coverage to change the name and incorporate such other requirements as may be necessary under the Clean Water Act. The Permit is NOT transferable. o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the Division in writing in the event the permitted facility is sold or closed. The Division of Water Quality views changes of name or ownership as a modification that requires the Director's approval and reissuance of the permit. Name and ownership changes require you to complete a Name/Ownership Change Form from the Division and mail it back to the Division of Water Quality along with all appropriate information. o Proper Operation and Maintenance is a requirement of the permit. Compliance History: The facility was inspected on May 7, 2008, by Charlotte -Mecklenburg Storm Water Services (CMSWS). The Division of Water Quality issued a Notice of Violation as a result of the inspection. The facility was compliant during the follow-up inspection on August 6, 2008. This permit expires on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for continued coverage under the reissued permit. In order to assure your continued coverage under the general permit, you must apply to the Division of Water Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued coverage under the general permit. Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $10,000 per day. Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial facilities in any of the 11 categories of "storm water discharges associated with industrial activity," (except construction activities). The Charlotte Plant manufactures corrugated metal pipe and fittings and distributes other highway construction products. Corrugated metal pipe is made from coils of galvanized steel, aluminized steel, polymeric coated steel, and aluminum. Fittings, bands, culvert end sections, and other products related to corrugated pipe are also manufactured and/or stored on site. Other products not manufactured at this location but stored on site are geotextiles, geogrids, and plastic pipe and fittings. The facility is located on approximately 6.5 acres consisting of two manufacturing buildings and an office building. The facility is comprised of approximately 99% impervious area that includes concrete and gravel. This facility does not conduct vehicle washing on site nor does it conduct its own vehicle maintenance. An outside company is contracted to come to the facility to conduct any required maintenance on the facility's small equipment. All used oil and filters are taken off site. Compliance History: Ms. Erin Hall of Charlotte -Mecklenburg Storm Water Services CMSWS inspected the facility on May 7, 2008). The Division of Water Quality issued a Notice of Deficiency on June 20, 2008. Industrial Operations/City of Charlotte Stormwater Ordinance Review: Arching Machine - The initial inspection found that accumulated rainwater within the engine's secondary containment was at full capacity and it was recommended that the accumulated rainwater be pumped out and properly disposed. The follow-up inspection on August 6, 2008, found that accumulated rainwater had been pumped out and properly disposed. Reroll Machine — The initial inspection found that accumulated rainwater within the sump area beneath the machine is pumped out and filtered via a 5-filter system setup that includes filters ranging from 5 — 15 microns and discharged to the ground. It was recommended the facility cover the reroll machine area to avoid pumping and discharging accumulated rainwater from the sump. The follow-up inspection conducted on August 6, 2008 revealed that the reroll machine is now being covered with a tarp to prevent rainwater accumulation. The tarp appeared to be in good condition. Outdoor Paint Area — The initial inspection found that pipe painting was conducted intermittently on the concrete pad adjacent to the reroll machine, which resulted in a significant amount of excess dried paint in this area. In addition, two possible stormwater catch basins for Outfall 001 were observed within in the area that were not indicated on the facility's SPPP site map. It was recommended that the permittee cease its current painting process and either conduct painting inside away from stormwater exposure, cover the outside painting area, or place a tarp down to catch excess paint and avoid stormwater contamination. The tarp would need to be taken inside when not in use and disposed of properly when replaced. The follow-up inspection conducted on August 6, 2008, revealed that the permittee is no longer painting within the outside paint area. This facility does not conduct vehicle washing on site nor does it conduct its own vehicle maintenance. An outside company is contracted to come to the facility to conduct any required maintenance on the facility's small equipment. All used oil and filters are taken off site. Compliance History: The permitteelfacility does not have any prior compliance issues with either the NC Division of Water Quality or Charlotte -Mecklenburg Storm Water Services, Industrial Operations/City of Charlotte,Stormwater Ordinance Review; Aboveground Storage Tank (AST) — One 9,000-gallon diesel fuel AST is located to the southeast of the property next to the fence. It is located in a covered area and has secondary containment. It is not double -walled. The secondary containment is not equipped with a valve. If a spill occurs, then FCC Environmental would respond and dispose of the spilled material. The AST is locked when not in use. A spill kit is located in the immediate area. Open -top Dumpsters — Two open -top metal dumpsters were located to the southeast and northeast of the property. Both dumpsters contain scrap metal and are picked up from an outside company on an as needed basis. The dumpsters are covered with tarps when not in use and they appeared to be in good condition. Hopper — A small hopper was observed to the north of the property. It contained small pieces of scrap metal. Per facility personnel, the hopper is taken inside the fabricating building at the end of the day. Scrap material is picked up by an outside company on an as needed basis. Fabricating Building — The Fabricating Building is located to the southeast of the property. No floor drains are inside the building. No significant amounts of chemicals are stored in this area. Outdoor Storage Area — Approximately five 55-gallon drums are stored on pallets on a concrete pad. They are located in a covered area adjacent to the Fabricating Building. Drums contain metal parts that are used for construction jobs off site. No chemicals are stored in this area. Final products are stored outside throughout the facility grounds. Arching Machine — This machine arches pipe into pipe -arch shapes. A sump area is located beneath the machine. No drains or valves are connected to the sump area, The engine of the machine has a small secondary containment. Accumulated rainwater from this containment area as well as the sump area is pumped out and disposed of by FCC Environmental. It was observed at the time of inspection that accumulated rainwater within the engine's secondary containment was at full capacity. The permittee should have accumulated rainwater pumped out and properly dispose of it. Main Building — The Main Building is located to the south of the property. A spill kit and supplies were observed at the entrance of the building. Floor drains inside the building are not connected to any type of sewer system. They currently act as a sump area if a spill would occur. Some drains have been filled in. Per facility personnel, future plans are to fill in and cap off all floor drains. A parts washer is located inside the Main Building. US Filter is responsible for manifesting wastewater. Material Storage — Chemicals are stored inside the Main Building. A 250-gallon hydraulic AST, a 250-gallon new motor oil AST, a 200-gallon waste oil AST, and approximately three 55-gallon drums of mineral spirits are stored within a concrete secondary containment structure. This structure does not have a valve. If a spill occurs, then FCC Environmental would respond and dispose of the spilled material. Two 25=gallon and two 55-gallon drums of mineral spirits and lubricant products are stored in this area on portable spill containers. In another area within the Main Building, approximately five 5-gallon buckets of oil were stored on a portable spill container, Reroll Machine — This machine recorrugates the ends of the pipe to allow the connection of the pipe with bands. It is located outside on a concrete pad adjacent to the Main Building. A sump area is located beneath the machine. No drains or valves are connected to the sump area. Per facility personnel, accumulated rainwater is pumped out and filtered via a 5-filter system setup that includes filters ranging from 5 — 15 microns. Filtered rainwater is then discharged to the ground. It is recommended the facility cover the Reroll machine area to avoid pumping and discharging accumulated rainwater from the sump. Outdoor Paint Area — An outside area on the concrete pad adjacent to the Reroll machine is used by facility personnel to paint the ends of pipes using a galvanized paint. Paint is applied using a sprayer and is conducted approximately every other month. Approximately five gallons of paint is used over a week when painting occurs. A significant amount of excess dried paint was observed in this area. Two possible stormwater catch basins were observed within this area. These were not indicated on the facility's site map. It did appear that they may tie into stormwater piping that would discharge from Outfall 001. The permittee should cease its painting process in the way it is currently being conducted. Recommendations include painting inside away from stormwater exposure, covering the outside area, or putting a tarp down to catch excess paint. The tarp would need to be taken inside when not in use and disposed of properly when replaced. Yard Saw — The yard saw is located to the south of the property next to the fence. A moderate amount of water was observed on the ground around the machine_ Per facility personnel, the machine is water cooled thus the reason for the excess water within this area. The water is potable water. A significant amount of oil -dry was observed on the concrete area around the machine. Response — We use FCC Environmental to properly dispose and manifest this water when required. Issue — Reroll Machine — Avoid pumping and filtering rainwater by covering the reroll pit. Response — We are covering the pit at night and on weekends to minimize the accumulation of rainwater. Issue - Outdoor Paint Area — The paint area is exposed to storm water runoff and the catch basins were not indicated on the facility site map. Response — Tarps are now placed in the paint area when active and are stored inside when not in use. They will be properly disposed when replaced.
