During the inspection, observations were made of the overall site conditions at your facility and in doing so a pipe was discovered discharging a liquid substance into a road culvert under Enterprise Avenue. At the time of inspection, the origin of this pipe and the liquid substance were unknown, however in your response it states that this pipe comes from a floor drain in the air compressor unit as identified on April 6, 2009. The purpose of this letter is to inform you that direct discharges of air compressor condensate requires coverage under the NCG500000 general wastewater permit as administered by the NPDES Permits Unit with the Division of Water Quality. Enclosed is a Notice of Intent (NOI) application for coverage under the NCG500000 general permit. If you wish to continue with the discharge of air compressor condensate from your facility, you must complete and submit the NOI to the NPDES Permits Unit within 30 calendar days from receipt of this letter. Failure to submit this form within the allotted time frame may result in the issuance of a Notice of Violation, which is subject to the assessment of a civil penalty of up to $25,000 per day, per violation. Nn NA NF Page: 3 Permit: NCG030307 Owner - Facility: United Tool & Stamping Co of NC Inc Inspection Date: 03/20/2009 Inspection Type: Compliance Evaluation Reason for Visit: Routine Inspection Summary: Inspection conducted to ensure compliance with the conditions of the NCG030000 general stormwater permit. Met with Mr. Ervin Ellis, Maintenance Manager, who provided facility's Stormwater Pollution Prevention Plan (SPPP) for review. The SPPP contained all permit -required components with the exception of a general location (USGS) map to show surrounding features and topography. Mr. Ellis explained that he tried to get such a map, but had been unsuccessful. A topo map will be provided by the regional office to accompany the inspection report and it should be incorporated into the SPPP for review during future compliance inspections. The permit requires that the. SPPP be reviewed and updated as necessary on an annual basis. The facility's SPPP was not dated, but according to Mr. Ellis, he developed the SPPP approximatley two years ago. Mr. Ellis was advised to date the SPPP and include documentation of an annual review and any changes made to facility personnel, operational changes, storage practices, etc. There were no records at the time of inspection for Qualitative Monitoring and only one record of an Analytical Monitoring event that was conducted just prior to the inspection. Facility has maintained permit coverage since 1997, however there were no records of previous sampling events. Facility has one outfall, which consists of two storm drains along the southeast area of the facility that collect and carry stormwater flow off the property via a pipe that exits into the right-of-way of the adjacent railroad. Since the end of the pipe is not on facility property and the last drain prior to discharge is located in an elevated area with vegetation that receives minimal flow, sampling was conducted at the first drain, which is located within the facility's loading dock and dumpster area. Filter fabric has been placed in this drain to serve as a BMP to capture solids and other debris. While observing the site, a pipe was seen coming out of the ground near the employee parking area and discharging a steady trickle of liquid into the culvert ditch that runs under Enterprise Avenue. Personnel were not aware of its origin andthis should be evaluated as it appeared to be coming from the direction of the facility's air compressor unit. The more significant changes in the General Permit since your last Certificate of Coverage include the following: Part I Section A — A new notation that the No Exposure Exclusion from permitting option may be available to the permittee. • Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL, may not be eligible for renewed coverage under the General Permit. • Part II Section B Table 1 — An increased sampling frequency from once per year to twice per year. • Part II Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of the option to avoid sampling based on cutoff concentrations. • Part 11 Section B — New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. • Part If Section B — A new provision that four exceedences of any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control measures. NCG030307 STORMWATER DISCHARGES NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the Federal Water Pollution Control Act, as amended, United Tool & Stamping Co., Inc. is hereby authorized to discharge stormwater from a facility located at United Tool & Stamping Co., Inc. 2817 Enterprise Street Fayetteville Cumberland County to receiving waters designated as Blounts Creek in the Cape Fear River Basin in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III and IV of General Permit No. NCG030000 as attached. This Certificate of Coverage shall become effective June 17, 1994. This Certificate of Coverage shall remain in effect for the duration of the General Permit. Signed this day June 17, 1994.
