The proposed work is for the replacement of two existing bridges on Forest Highway 58 (State Route 1756), over Sols Creek and Charley Creek. The Sols Creek and Charley Creek bridges are located approximately 2.4 and 5.6 kilometers (1.5 and 3.5 mi.), respectively, east of the Forest Highway 58/ Route 281 intersection. This project has been designated Project NC PFH 58-1(1). The proposed bridge at Sols Creek will span the stream and all construction will be outside "Waters of the U.S." We understand that no Section 404 permit will be required for this replacement. The proposed bridge at Charley Creek will also span the stream and all construction for the permanent replacement bridge will be outside "Waters of the U.S." A requirement to maintain access across Charley Creek during construction has resulted in the need to install a temporary culvert immediately upstream of the existing bridge. The enclosed Section 404 Joint Form application is hereby submitted for the temporary culvert stream crossing at Charley Creek. The proposed temporary culvert crossing will be in use for approximately 1 year. Existing bridges and the temporary culvert will be removed when construction is complete and the area stabilized with vegetation. The North Carolina State Historic Preservation Officer, the U.S. Fish and Wildlife Service, and the North Carolina Wildlife Resources Commission (NCWRC) were contacted for comments. Copies of correspondence from these agencies are enclosed. All eight conditions outlined in the NCWRC's memorandum of April 30, 1996, will be incorporated into the design plans. The NCWRC's memorandum also indicated that the environmental action (NEPA) include consideration of the installation and removal of the proposed temporary detour road and culverts across Charley Creek during construction. The bridge replacements are required due to structural and alignment deficiencies in the existing bridges and approach roads. The project is scheduled for advertisement in early 1997. In accordance with FHWA pro d),dfes, a determination has been made that the environmental action associated it these proposed Forest Highway 58 improvements will be a Categorical Exclu ' n (CE). The CE includes an assessment of the effects of all aspects of this project, i udi . he temporary detour road and culverts at Charley Creek. The FHWA advertised in five different local newspapers for written public comments and made project information available to the public in Sylva and Highlands, North Carolina, during March and April 1996. No negative comments regarding the proposed project were received. One copy of the application package has been sent to Mr. David Yow, NCWRC; Mr. David Brook, Deputy State Historic Preservation Officer; and seven copies to Mr. John Dorney, North Carolina Department of Environment, Health, and Natural Resources. Federal Highway Administration 21400 Ridgetop Circle Sterling, Virginia 20166-1655 Dear Mr. Klinedinst: Subject: Proposed replacement of bridge number 225 over Sols Creek and bridge number 76 over Charley Creek on Forest Highway 58 in the Nantahala National Forest, Jackson County, North Carolina The U.S. Fish and Wildlife Service (Service) received notice of the subject project on March 28, 1996. Tile following comments are provided in accordance with the provisions of Section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). According to the information provided, this project will involve replacing the existing bridges over Sols Creek and Charley Creek on Forest Highway 58 in the Highlands Ranger District of the Nantahala National Forest. The proposed new bridges will be concrete deck structures approximately 26 feet long and 25 feet wide. Replacement structures will completely span the stream channels and will not involve work in the streams. No jurisdictional wetlands will be impacted during construction activities. The existing bridges and the corresponding support structures will be removed after completion of the replacement bridges. The purpose of the project is to replace structurally deficient bridges that do not conform with state road and bridge standards. The Service has reviewed its records and concurs with your determination that the project will not affect federally listed or proposed endangered or threatened species. In view of this, we believe the requirements of Section 7(c) of the Act are fulfilled. However, obligations under Section 7 of the Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or a critical habitat is determined that may be affected by the identified action. The Service would appreciate receiving a copy of the biological evaluation prepared by the U.S. Forest Service for this project. This memorandum responds to a request from the project sponsors for our concerns regarding impacts on fish and wildlife resources resulting from the subject project. The N. C. Wildlife Resources Commission (NCWRC) has reviewed the proposed project, and our comments are provided in accordance with provisions of the National Environmental Policy Act (42 U.S.C. 4332(2)(c)) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The proposed work involves replacement of two obsolete bridges with spanning structures at existing location. We prefer this alternative to other construction alternatives, and we do not object to the proposed project alternative. However, we have received supplementary information from the project sponsors that the Charley Creek bridge will require a temporary crossing of the stream to allow school bus travel during construction. Because this modification will require fill in trout waters and represents a considerable change in short-term project impacts, we ask that the project sponsors prepare an addendum to the Categorical Exclusion to incorporate the temporary stream crossing into the project description. Because the project will involve placement of fill in waters of the U. S., and because trout waters are involved, the NCWRC will review the Nationwide 404 permit for the Charley Creek crossing. We ask that the project sponsors attach a copy of the Categorical Exclusion document. with the addendum describing fill activities in trout waters, to the 404 application for this project, and that copies of application materials be provided to the NCWRC for review at the time of permitting. We anticipate that the following 404 pen-nit conditions will be recommended: 96-0618 Memo Page 2 April 30, 1996 l . All work involving clearing, grading, or filling of waters associated with installation or removal of the temporary crossing of Charley Creek must occur between April 15 and October 15 to avoid impacts on downstream trout populations. If bridge construction cannot be completed within this window, the temporary crossing should be left in place until the following April. All disturbed soils must be stabilized by October 15 and remain in a stable condition until April 15. 2. No excavation of the stream channel or banks of Charley Creek occur during installation of the temporary crossing. Fill materials should include only washed angular stone, with finer stone fill contained by filter cloth. Clay or soil fill should not be used in the stream crossing or on approach grades within 25 feet of the stream. Culvert pipes should not be embedded in the stream bottom, and existing stream bottom materials should be left in place. 3. Existing shrub vegetation in the area of the temporary crossing should not be grubbed. Root stock should be left in place to stabilize soils and allow regrowth following construction. 4. During removal of the temporary crossing, mechanized excavation of fill materials should avoid disturbance of the underlying stream bottom and stream banks. This may require hand removal of a portion of the angular stone fill. 5. All disturbed soils must be re-seeded and/or stabilized with mulch immediately following construction on each site of disturbance. 6. Stringent erosion control measures must be implemented and maintained throughout construction. 7. Shrub vegetation on the banks of Charley Creek must be restored following removal of the temporary crossing. 8. No direct contact between freshly poured concrete and stream waters should occur during construction. The contractors should be specifically instructed not to allow cleanout of concrete trucks into surface waters. This memorandum responds to a request from the project sponsors for our concerns regarding impacts on fish and wildlife resources resulting from the subject project. The N. C. Wildlife Resources Commission (NCWRC) has reviewed the proposed project, and our comments are provided in accordance with provisions of the National Environmental Policy Act (42 U.S.C. 4332(2)(c)) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The proposed work involves replacement of two obsolete bridges with spanning structures at existing location. We prefer this alternative to other construction alternatives, and we do not object to the proposed project alternative. However, we have received supplementary information from the project sponsors that the Charley Creek bridge will require a temporary crossing of the stream to allow school bus travel during construction. Because this modification will require fill in trout waters and represents a considerable change in short-term project impacts, we ask that the project sponsors prepare an addendum to the Categorical Exclusion to incorporate the temporary stream crossing into the project description. Because the project will involve placement of fill in waters of the U. S., and because trout waters are involved, the NCWRC will review the Nationwide 404 permit for the Charley Creek crossing. We ask that the project sponsors attach a copy of the Categorical Exclusion document, with the addendum describing fill activities in trout waters, to the 404 application for this project, and that copies of application materials be provided to the NCWRC for review at the time of permitting. We anticipate that the following 404 permit conditions will be recommended: 96-0618 Memo Page 2 April 30, 1996 1. All work involving clearing, grading, or filling of waters associated with installation or removal of the temporary crossing of Charley Creek must occur between April 15 and October 15 to avoid impacts on downstream trout populations. If bridge construction cannot be completed within this window, the temporary crossing should be left in place until the following April. All disturbed soils must be stabilized by October 15 and remain in a stable condition until April 15. 2. No excavation of the stream channel or banks of Charley Creek occur during installation of the temporary crossing. Fill materials should include only washed angular stone, with finer stone fill contained by filter cloth. Clay or soil fill should not be used in the stream crossing or on approach grades within 25 feet of the stream. Culvert pipes should not be embedded in the stream bottom, and existing stream bottom materials should be left in place. 3. Existing shrub vegetation in the area of the temporary crossing should not be grubbed. Root stock should be left in place to stabilize soils and allow regrowth following construction. 4. During removal of the temporary crossing, mechanized excavation of (ill materials should avoid disturbance of the underlying stream bottom and stream banks. This may require hand removal of a portion of the angular stone fill. 5. All disturbed soils must be re-seeded and/or stabilized with mulch immediately following construction on each site of disturbance. 6. Stringent erosion control measures must be implemented and maintained throughout construction. 7. Shrub vegetation on the banks of Charley Creek must be restored following removal of the temporary crossing. 8. No direct contact between freshly poured concrete and stream waters should occur during construction. The contractors should be specifically instructed not to allow cleanout of concrete trucks into surface waters.
