manufacture use the definition as found in 40 CFR 469.12; for electronic crystal manufacture use the definition as found in 40 CFR 469.22; and for cathode ray
tube manufacture use the definition found in 40 CFR 469.31).

Facilities that incorporate a solvent management plan into the Stormwater Pollution Prevention Plan may so certify, and the requirement for TTO monitoring
may be waived. The solvent management plan shall include a list of the total toxic organic compounds used and the other elements listed in the General
Permit. For those facilities electing to employ the TrO monitoring waiver, the discharger shall sign the following certification statement:
"Based upon my inquiry of the person or persons directly responsible for managing compliance with the permit monitoring requirement for total toxic organics
(TTO), I certify that to the best of my knowledge and belief, no dumping of concentrated toxic organics into the stormwater or areas which are exposed to rainfall or
stormwater runoff has occurred since filing the last discharge monitoring report. I further certify that this facility is implementing the all the provisions of the
solvent management plan included in the Stormwater Pollution Prevention Plan."

On January 27, 2017, the Washington Regional Office of the Division of Energy, Mineral, and Land
Resources received a copy of your CAMA application for a renovation project located at the Pelican
Marina near Elizabeth City, NC. The proposal included piers, platforms, a boat ramp, a floating fuel
dock & bulkhead work. Staff review of the plans and specifications has determined that the project,
as proposed, consists of activities that will not pose surface water quality threats from stormwater
runoff since no new impervious area is proposed.
The Director has determined that projects that are reviewed and approved by the Division as not
posing water quality threats from stormwater runoff should not be subject to the stormwater
management permitting requirements of 15A NCAC 2H.1000. For this reason, we are informing
you by way of this letter that your project will not require a State Stormwater management permit
at this time.
The stormwater rules require the Division to permit the common plan of development, therefore,
any future development on the property, regardless of whether a SEC plan or CAMA Major permit is
also required, will require a Stormwater Management Permit application and permit issuance from
the Division of Energy, Mineral, and Land Resources prior to any construction. Any construction on
the subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC
2H.1000 and may result in appropriate enforcement actions by this Office.
In a related matter and byway of this letter, we are informing you that Marinas are classified as an
industrial activity that must control stormwater discharges. The State of North Carolina has issued
a General Stormwater Permit that addresses the concerns and impacts associated with stormwater
discharges from marina facilities. For clarification, this is a separate and different type of
stormwater permit from the State Coastal Stormwater Program. The Notice of Intent for coverage
under stormwater permit NCG190000 and the permit requirements can be found on our
Department web page at NCDEQ - NPDES Industrial Stormwater. The Technical Bullentin for NC
General Stormwater Permit NCG190000 is enclosed for your reference.

On January 27, 2017, the Washington Regional Office of the Division of Energy, Mineral, and Land
Resources received a copy of your CAMA application for a renovation project located at the Pelican
Marina near Elizabeth City, NC. The proposal included piers, platforms, a boat ramp, a floating fuel
dock & bulkhead work Staff review of the plans and specifications has determined that the project,
as proposed, consists of activities that will not pose surface water quality threats from stormwater
runoff since no new impervious area is proposed.
The Director has determined that projects that are reviewed and approved by the Division as not
posing water quality threats from stormwater runoff should not be subject to the stormwater
management permitting requirements of 15A NCAC 2H.1000. For this reason, we are informing
you by way of this letter that your project will not require a State Stormwater management permit
at this time.
The stormwater rules require the Division to permit the common plan of development, therefore,
any future development on the property, regardless of whether a SEC plan or CAMA Major permit is
also required, will require a Stormwater Management Permit application and permit issuance from
the Division of Energy, Mineral, and Land Resources prior to any construction. Any construction on
the subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC
2H.1000 and may result in appropriate enforcement actions by this Office.
In a related matter and by way of this letter, we are informing you that Marinas are classified as an
industrial activity that must control stormwater discharges. The State of North Carolina has issued
a General Stormwater Permit that addresses the concerns and impacts associated with stormwater
discharges from marina facilities. For clarification, this is a separate and different type of
stormwater permit from the State Coastal Stormwater Program. The Notice of Intent for coverage
under stormwater permit NCG190000 and the permit requirements can be found on our
Department web page at NCDEQ - NPDES industrial Stormwater. The Technical Bullentin for NC
General Stormwater Permit NCG190000 is enclosed for your reference.

Total Toxic Organics sampling is applicable only for those facilities which perform metal finishing operations, manufacture semiconductors, manufacture electronic crystals, or
manufacture cathode ray tubes. For purposes of this permit the definition of Total Toxic Organics is that definition contained in the EPA E111uent Guidelines for the facility subject
to the requirement to sample (for metal finishing use the definition as found in 40 CFR 433.11; for semiconductor manufacture use the definition as found in 40 CFR 469.12, for
electronic crystal manufacture use the definition as found in 40 CFR 469.22; and for cathode ray tube manufacture use the definition found in 40 CFR 469,31).
Facilities that incorporate a solvent management plan into the Stormwater Pollution Prevention Plan may so certify, and the requirement for TTO monitoring may be waived. The
solvent management plan shall include a list of the total toxic organic compounds used and the other elements listed in the General Permit. For those facilities electing to employ
the TTO monitoring waiver, the discharger shall sign the following certification statement:
"Based upon my inquiry of the person or persons directly responsible for managing compliance with the permit monitoring requirement for total toxic organics (TTO),
certify that to the best of my knowledge and belief, no dumping of concentrated toxic organics into the stormwater or areas which are exposed to rainfall or storntwater
runoff has occurred since tiling the last discharge monitoring report. 1 further certify that this facility is implementing; the all the provisions of the solvent management
plan included in the Stormwaler Pollution Prevention Plan."
