Enclosed is a copy of the Compliance Evaluation Inspection Report for the stormwater
inspection conducted at the subject facility on October 26, 2011 by Mr. Wes Bell of this Office.
Please inform the personnel involved with the implementation of the Stormwater Permit by
forwarding a copy of the enclosed report.
This report is being issued as a Notice of Violation (NOV) due to the permittee's failures
to develop and implement a Stormwater Pollution Prevention Plan, violations of the subject
Stormwater Permit and North Carolina General Statute (G.S.) 143-215.1, as detailed in the
Stormwater Pollution Prevention Plan, Qualitative Monitoring, Analytical Monitoring, and
Permit/Outfalls Sections of the attached report. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000.00) per violation, per day, may be assessed
against any person who violates or fails to act in accordance with the terms, conditions, or
requirements of any permit issued pursuant to G.S. 143-215.1.
It is requested that a written response be submitted to this Office by December 2 2011,
addressing the above -noted violations in the attached report. In responding to the violations,
please address your comments to the attention of Mrs. Marcia Allocco.

Comment: The stormwater permit requires analytical monitoring (pH, TSS, lead, oil &
grease, total toxic organics -if applicable). No analytical monitoring had been performed.
Please be advised that the pH analyses must be collected and analyzed within
15-minutes. If the pH analyses are performed on -site then the facility staff must ensure
that the analytical method conforms to Standard Methods for the Examination of
Wastewater, 18th-20th Editions. All supporting documentation should also be
maintained on -site that includes: instrument calibrations, date of analyses,
collection/analysis times, sampling location, lab analyst, analytical results, etc.

Comment: The subject permit was reissued on November 1, 2007 (also effective date)
with an expiration date of October 31, 2012. The inspection verified that the facility has
two stormwater outfalls. No discharges were observed.
The site grounds were well maintained. Bundles of wire were being stored on a
concrete pad that directed the stormwater runoff (via sheet flow) into a vegetated field.
Two dumpsters (only one covered) were observed in the back parking lot. The
uncovered dumpster contained pallets (no staining observed). The facility staff should
provide cover for this dumpster and the metal scrap container adjacent to the building
prior to rainfall events. DWQ/MRO staff discussed with the on -site personnel additional
practices to reduce/prevent exposures and options regarding the facility's permitted
status.

Your facility is currently covered for stormwater discharge under General Permit NCG030000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I 1 categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed

rescission process has been completed.
