permit by the Division of Water Quality. According to the Tier Two requirements, we are
required to submit a monthly monitoring report for outfalls not meeting our permit
benchmarks. If no discharge occurs during the sampling period, then we are required to submit
a monthly monitoring report indicating "No Flow".
This letter is to inform you that J. C. Steele & Sons, Inc. was unable to capture stormwater
samples per our permit requirements for the period December 1, 2014 to December 31, 2014.
This letter is for our Shop's Permit No. NCG030255. A monthly rain log is kept which
documents the rain events and the reasons for not being able to do sampling. Please see the
"rain log" for the time period mentioned above.
In closing, J. C. Steele & Sons, Inc. respectfully submits this letter informing your group of our

Exclusion from NPDES Storm -water Permitting. Based on your submittal and signed
certification of no exposure at the above referenced facility, and the inspection dated May 13,
2015, the Division is granting your conditional exclusion from permitting as provided for under
40 CFR 122.26(g), which is incorporated by reference in North Carolina regulations.
Please note that by our acceptance of your no -exposure certification, you are
obligated to maintain no -exposure conditions at your facility. If conditions change such
that your facility can no longer qualify for a No -Exposure exclusion, you are obligated to
immediately obtain NPDES permit coverage for your stormwater discharge. Otherwise,
the discharge becomes subject to enforcement as an unpermitted discharge.
You must self re -certify your No -Exposure status annually using the included form
or obtain NPDES permit coverage for any stonmwater discharges from your facility. The

We are in receipt of your December 16, 2014 letter documenting best management
practices implemented at the Statesville facility and requesting relief from monthly monitoring.
Based on the information provided and. a site inspection conducted September 19, 2014 the
facility is in compliance with the tiered response actions and other conditions of the
NCG030000 General Permit. Therefore, the Division is granting regulatory relief from the Tier
responses. Upon receipt of this letter, the subject facility may resume the permit specified
semi-annual analytical monitoring for the remainder of the current permit term which expires
on October 31, 2017. This decision applies only to the copper and zinc benchmarks. A
benchmark exceedance of any other parameter listed in your permit will trigger the tiered
response actions as described in the general permit.
You must notify this office, in writing, within five business days if you become aware
of any significant source of copper or zinc at your facility that has the potential to be
exposed to stormwater. The relief granted in this letter is contingent upon the current
industrial practices at J.C. Steele & Sons. If industrial practices change and copper or zinc
does become a significant stormwater exposure risk or significant zinc or copper values
have been recorded during regular sampling events, then this office reserves the right to
withdraw this decision and reinstate the permit specified tiered response or other actions
that may be warranted by the new set of circumstances.

The Mooresville Regional Office staff have reviewed your request dated April 25, 2012 for a
determination that stormwater discharge outfall (SDO) 1 and 3 be granted representative outfall
status for stormwater outfalls 2 and 3a. Based on the information and maps provided and site
visit performed by Ms. Donna Hood of this Office on 01/09/2013, we are approving this
request. In accordance with 40 CFR §122.21(g)(7), you are authorized to sample outfall number
1 as a representative outfall for outfall 2 and sample outfall 3, representative of outfall 3a. This
approval is effective with the next sampling event. We also want to remind you that the permit
still requires Qualitative Monitoring be performed at all SDOs regardless of representative
status.
Please remember that any actions you initiate in response to benchmark exceedences as directed
in the tiered response provisions of your permit must address all drainage areas represented by
SDOs 1 and 3, where appropriate.

J.C. Steele submitted for Representative Outfall Status (ROS) on April 25, 2012. The facility
requested ROS for Outfalls 3a and 2, to be represented by Outfall 3 and Outfall 1, respectively. A site review confirmed
the requested ROS outfalls are representative of the stormwater discharge associated with outfalls 3a and 2. Additionally,
there are serious safety concerns with Outfall 2, as it discharges to an active railroad spur line. For the safety of
employees, qualitative observation at this outfall should not be taken from the railroad tracks but observed from the
concrete lot, behind the fence. The ROS request is approved as requested.

Please find enclosed the Stormwater Discharge Outfall Monitoring Report for permit
number NCGO30255 for the J. C. Steele & Sons, Inc., facility in Statesville. Previous testing for
outfails #1 and #3 resulted in Tier Two monthly sampling. The results from this stormwater
event will again put outfall #3 above the benchmark for copper and per the November results,
zinc is also above the benchmark thus triggering Tier Three actions. The November results also
put copper at the Tier Three level for the first time at outfall #1.
As stated in our last letter dated August 25, 2014; J. C. Steele & Sons, Inc. operates
metal finishing processes at our location. The facility instituted Tier One and Tier Two actions
as a result of previous benchmark exceedances. J. C. Steele & Sons, Inc. has implemented the
following best management practices in an effort to reduce the metals discharged to the
stormwater.
• Implemented a stronger good housekeeping program including more frequent
sweeping.
• Changed several of our dust collector stacks from horizontal to vertical discharge and
extended the height of the stacks.
• Replaced broken asphalt and concrete so these areas can be better swept.
• Had consultants on site to review and comment on our stormwater issues.
• Cleaned around storm drains and installed filter barrier material in some areas.
Installed curbs around stormwater drains to help settle the solids.

• Curbing was installed at outfall #5 to redirect the water flow to a pit filled with rip -rap in
an effort to slow down the water flow and help settle solids before reaching the outfall.
This has resulted in No -Flows for each rain event.
• After speaking with Mr. Michael Parker (NCDENR) the flow at outfall #4 was redirected
to outfall #6. This was accomplished by installing a trench to redirect the water flow
through a ditch filled with rip -rap material and then through a grassy area before
reaching outfall #G.
• Before reaching Tier Three status a roof was installed over a dumpster and wash area.
Also a trench was installed to redirect water flow to a ditch filled with rip -rap material in
an effort to slow down water flow and help settle solids. The costs just for these two
installations were over $42,000.
• So far J. C. Steele has spent an additional $57,000 on the other improvements listed
above.
• J. C. Steele has also collected rain samples from the machine shop roof in May 2014.
These samples were collected in the outfall #3 area before the water hit the ground.
The copper level was 0.026 and the zinc level was 0.41 both of which exceed the
benchmarks set forth in our permit.
After sending you notification back in August of this year, James Moore and Samar Bou-
Ghazale came by to see our site. During their visit Mr. Bou-Ghazale suggested we add mulch to
a holding pit at outfall #1 to try and capture the copper and zinc in our stormwater. This
project has been completed per his request. Mr. Moore suggested we move a hopper
containing metal chips/shavings from our machine shop operation to a covered area and to
contain the leaks coming from the hopper. This project too has been completed.
Our permit requires notification to the Raleigh Office in writing when Ter Three status is
reached. -This notification was forward to the Raleigh Office along with a statement telling of
, riot ication. You will find a summaryof the lab analysis for outfall #1 and outfall #3 for the
1;rn h of November. Having put in place all the best management practices shown above; J. C.
Steele would like to again request a reduction in monitoring requirements.

Thanks, we have already started with the work to reroute the drain from the roof. I have checked with the dumpster
vendor about covers and non -leaking dumpsters but they have neither. I have been looking at ways to deal with the
dumpster but will need to check with the Shop Manager next week when he returns from vacation. I also have a vendor
coming by on Wednesday to look at the pit (shavings) at outfall 1, so the plan is in motion.

Please find enclosed the Stormwater Discharge Outfall Monitoring Report for permit
numbers NCGO30255 and NCS000018 for the J. C. Steele & Sons, Inc., facility in Statesville.
Previous testing for outfalls #3, #5 and #6 resulted in Tier Two monthly sampling which is the
reason for this report. The results from this stormwater event will put outfall #3 above the
benchmark for copper thus triggering Tier Three actions.
J. C. Steele & Sons, Inc. operates metal finishing processes at our location. The facility
instituted Tier One and Tier Two actions as a result of previous benchmark exceedances.
J. C. Steele & Sons, Inc. has implemented the following best management practices in an effort
to reduce the metals discharged to the stormwater.
• Implemented a stronger good housekeeping program including more frequent
sweeping.
• Changed several of our dust collector stacks from horizontal to vertical discharge and
extended the height of the stacks.
• Replaced broken asphalt and concrete so these areas can be better swept.
• Had consultants on site to review and comment on our stormwater issues.
• Cleaned around storm drains and installed filter barrier material in some areas.
• Installed curbs around stormwater drains to help settle the solids.
• Curbing was installed at outfall #5 to redirect the water flow to a pit filled with rip -rap in
an effort to slow down the water flow and help settle solids before reaching the outfall.
This has resulted in No -Flows for each rain event.

• After speaking with Mr. Michael Parker (NCDENR) the flow at outfall #4 was redirected
to outfall #6. This was accomplished by installing a trench to redirect the water flow
through a ditch filled with rip -rap material and then through a grassy area before
reaching outfall N.
• Before reaching Tier Three status a roof was installed over a dumpster and wash area.
Also a trench was installed to redirect water flow to a ditch filled with rip -rap material in
an effort to slow down water flow and help settle solids. The costs just for these two
installations were over $42,000.
• So far J. C. Steele has spent an additional $57,000 on the other improvements listed
above.
• J. C. Steele has also collected rain samples from the machine shop roof in May 2014.
These samples were collected in the outfall #3 area before the water hit the ground.
The copper level was 0.026 and the zinc level was 0.41 both of which exceed the
benchmarks set forth in our permit.
Our permit requires notification to the DWQ Regional Office Supervisor in writing when Tier
Three status is reached. Mark Beaver with J. C. Steele has contacted Donna Hood with NCDENR
in Mooresville by phone and Zahid Khad with NCDENR in Mooresville by letter.

J. C. Steele & Sons, Inc. is committed to following the requirements set forth in our stormwater
permit by the Division of Water Quality. According to the Tier Two requirements, we are
required to submit a monthly monitoring report for outfalls not meeting our permit
benchmarks. If no discharge occurs during the sampling period, then we are required to submit
a monthly monitoring report indicating "No Flow".
This letter is to inform you that J. C. Steele & Sons, Inc. was unable to capture stormwater
samples per our permit requirements for the period February 1, 2014 to February 28, 2014.
This letter is for our Foundry's Individual Permit No. NCO00018 and for our Shop's Permit No.
NCG030255. A monthly rain log is kept which documents the rain events and the reasons for
not being able to do sampling. Please see the "rain log" for the time period mentioned above.
In closing, J. C. Steele & Sons, Inc. respectfully submits this letter informing your group of our

W31/2012 Outfall #3 at Machine Shop
" • A cover was built over the pressure wash area and chip hopper area. The intent is to
" keep stormwater from flowing in this area.
Cost: $29,662
5/27/2013 Outfall #3 at Machine Shop
• A concrete trench was installed across the driveway at the ramp leading up to the back
of the machine shop. The water from the trench flows into a ditch filled with rocks and
then onto a concrete pad before flowing into outfall #3. The intent was to direct the
water flow in this area to the rock filled ditch to help settle any solids in the water.
• Cost: $13,134
6/28/2013 Outfall #1 Driveway at Hut
• Replaced the broken concrete with new concrete. We can now sweep this area better
and get up more of the dirt and bits of metal that used to get caught in the storm water
flow. The old concrete area was broken up so bad that you couldn't sweep this area
very well. All the material in this area would wash to outfall #1.
* Cost: $9,054
9/16/2013 Outfall #1 at Machine Shop
• A pit filled with rock was installed prior to the water flow reaching outfall #1. The intent
is to have some of the water soak into the ground and to help the solids settle before
the water reaches outfall #1. During light rains the water flow never reaches outfall #1.

The Mooresville Regional Office staff have reviewed your request dated April 25, 2012 for a
determination that stormwater discharge outfall (SDO)1 and 3 be granted representative outfall
status for stormwater outfalls 2 and 3a. Based on the information and reaps provided and site
visit performed by Ms. Donna Hood of this Office on 01/09/2013, we are approving this
request. In accordance with 40 CFR §122.21(g)(7), you are authorized to sample outfall number
1 as a representative outfall for outfall 2 and sample outfall 3, representative of outfall 3a. This
approval is effective with the next sampling event. We also want to remind you that the permit
still requires Qualitative Monitoring be performed at alll SDOs regardless of representative
status.
PIease remember that any actions you initiate in response to benchmark exceedences as directed
in the tiered response provisions of your permit must address all drainage areas represented by
SDOs 1 and 3, where appropriate.

Inspection Summary:
J.C. Steele submitted for Representative Outfall Status (ROS) on April 25, 2012. The facility
requested ROS for Outfalls 3a and 2, to be represented by Outfall 3 and Outfall 1, respectively. A site review confirmed
the requested ROS outfalls are representative of the stormwater discharge associated with outfalls 3a and 2. Additionally,
there are serious safety concerns with Outfall 2, as it discharges to an active railroad spur line. For the. safety of
employees, qualitative observation at this outfall should not be taken from the railroad tracks but observed from the
concrete lot, behind the fence. The ROS request is approved as requested.

Rain started around 9:00 am as light rain. At 2:00 }gym grabbed stormwater
samples and sent them to the lab. Shortly after sending the samples to the lab,

In response to your renewal application for continued coverage under stormwater General Permit NCG03D000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:

• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http:Llportal.ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit

Some of the changes include:
Part 11:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections 8, C. Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections 8, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections 8, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections 8, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections 8, C. The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts ill and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

Statesville, Iredell County, NC. The facility operates under NPDES General Permit
NCG030255. During a recent site inspection, the facility has discovered a new outfall at the site.
A stormwater drain which was previously thought to have been tied into an existing outfall is
located near a northwestern wall at the Machine Shop. The stormwater drain is piped
underneath the building and discharges to the storm drainage system located along Mulberry
Street The facility has designated the new outfall as Outfall 3a.
Since manufacturing operations in Drainage Area 3a are similar to operations in Drainage Area
3, we request Representative Outfall Status (ROS) for Outfall 3a. Stormwater exposure in
Drainage Area 3a includes scrap equipment, cast parts, a drum crusher, painted metal parts
and a dust collection system. In addition, we request Representative Outfall Status for Outfall
2. Drainage Area 2 consists mainly of roof drain discharge. Stormwater exposure in this
drainage area includes cast parts and painted metal parts. Since stormwater exposure in the
area associated with Outfall 1 is similar to Outfall 2, we request ROS for Outfall 2. Please find
attached a Representative Outfall Status Request Form (Attachment A), two copies of the Site
Plan (Attachment B), and Analytical Monitoring results (Attachment Q.

On behalf of my client, I am submitting this petition letter requesting representative outfall
status. This facility has three outfalls that discharge stormwater runoff from industrial activity
areas. We are requesting representative status for SDO-001 (see enclosed Map 2) for the
following reasons:
1 Most of the SDO-001 drainage area encompasses industrial activity areas.
2. Most of the industrial activity occurring at this facility occurs within the SDO-001
drainage area.
3. The drainage area has high imperviousness.
4. The drainage area is the largest of the three.
Outfall SDO-002 carries runoff from a shipping/ receiving access road and a gravel trailer
parking lot. Outfall SDO-003 carries runoff from a shipping/ receiving access road and from a
paved areas where the dumpster and some scrap debris is located.

Your facility is currently covered for stormwater discharge under General Permit NCG030000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will he expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,.000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed

rescission process has been completed.
