from the subject facility has been reviewed. Based upon the July 8, 1997 submittal of
revised design calculations and plans, the basins should perform as acceptable water quality
control structures to treat runoff from the proposed development.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Todd:
You have our approval to drain and place fill material in 4.55 acres of wetlands or waters for the purpose
of constructing a office/distribution facility near Manufacturer's Road and Norfolk Southern Railroad in
Greensboro, as you described in your application dated 19 September 1996. After reviewing your application,
we have decided that this fill is covered by General Water Quality Certification Number 2671. This
certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in the attached certification
and any additional conditions listed below. Additional written DWQ approval is required for a stormwater
management plan. This plan shall be submitted before wetland filling occurs. Additional impacts may
require minimization, additional stormwater management and compensatory mitigation in accordance with
15A NCAC 2H.0506. In addition, you should get any other federal, state or local permits before you go
ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non-Discharge and Water Supply Watershed regulations.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina'General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act. If you have any questions, please telephone John Dorney at 919-733-1786.

SUBJECT: Section 401 Certification for Mylan Pharmaceuticals, Inc.. Guillord County,
North Carolina. DWQ ID: 960933
Biologists with the Wildlife Resources Commission have reviewed the subject
document. Our comments are provided in accordance with provisions of the Clean Water
!let of 1977 (33 U.S.C. 466 et seq),
Wan Pharmaceuticals, Ina, proposes to drain and fill a 4.55 acre pond in order to
construct a 144,000 square foot structure and associated site improvements. Them arc
approximately 11 acres of waters of the U.S. at this site.
We have no objections to draining and filling the pond; however, we, are concerned
about stormwater runoff and its impacts on water quality in South Buffalo Creek. The
applicant indicates a stormwater management plan is not applicable. The pond the
a lieant is proposing to fill probably serves to filter runoff from the surrounding land.
Filling this pond will eliminate that filtering capability. In addition, construction will
increase the amount of impervious surface at the site further reducing the filtering
capability at this site.
We request that the certification be conditioned as follows:
1. Kequire the applicant to develop a stormwater control structure of sufficient size to
filter runoff from the proposed development and the watershed drainage area.
2. Place deed restrictions on the property to protect any remaining wetlands from
further impacts by current or future owners.

3. Require that hydrology of remaining wetlands be protected. Suilicient stompwater
should be routed to wetland areas to maintain hydrology; however, enorgy should
be dissipated to prevent scouring of the wetland area.
4. Require a minimum 100-foot forested buffer of native trees and shrubs along; any
perennial stroarn and a minimum of a 35-foot forested buffer along any intermittent
stream to maintain stability of stream banks and temperature of water,
