Beginning in 2013 the facility began sampling the stormwater and comparing the analytical results to the benchmark values as required by the Permit. The facility has had four exceedances of the benchmark values at three of the six outfalls on site. As required by the Tier Three response actions in the Permit, Eaton is providing notification of benchmark value exceedances for Copper. The benchmark value exceedances of Copper occurred at Outfalls 002, 003 and 006. A spreadsheet summarizing the analytical results and the laboratory reports are attached. As a result of the exceedances of the benchmark values, Eaton initiated the response actions for Tier One and Tier Two as required in the permit to limit the impact of Copper on the stormwater. These actions include: • Verified existing daily check of shot peen/clean dust collector area is performed by Heat Treat Technicians. (outfall 002) • Verified procedures for changing dust collector filters at the shot peen/clean area contain specific filter handling and controls and were provided in the work order documents. (outfall 002 ) • Added the back pad area to the monthly 6S audit schedule. (outfall 003, 006) • Reviewed outfall area housekeeping expectations with lawn maintenance contractor. (all outfalls) • Review of the BMPs. Eaton believes the BMPs are properly installed and working to minimize the impact on stormwater. Eaton has also reviewed the manufacturing activities to identify potential sources of Copper. The facility operates an enclosed fabrication area where solid carbon steel components are processed through heat treating, shot blasting/peening and machining processes. Both the carbon steel (i.e. ETN22 grade) and the steel shot media contain less than 0.25% Copper. Considering the enclosed manufacturing processes and the BMPs in place, it is not believed these operations contribute to the benchmark level exceedances. In addition, there have been no changes to the manufacturing operations that could have increased the potential of this metal to be present in the stormwater discharge. Prior to the Permit coverage renewal in December 2012, analytical sampling for metals such as copper and zinc were not a requirement, therefore we do not have any historic data to reference these samples against. While it does not appear that the response actions have resulted in any impact on the copper concentrations in the stormwater, Eaton believes additional stormwater sampling should be conducted to collect more representative data to compare with the benchmark values to further evaluate the impacts of the response actions that have been taken at the facility before concluding the response actions have not had a result on the stormwater impacts. While Eaton has promptly responded with follow-up actions, continues to inspect the drainage area and evaluate the facility for opportunities to reduce impacts to stormwater, Eaton believes that more sampling is needed to further evaluate the conditions and actions taken. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections 8, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections S, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections 8, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements_ • Sections 8, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections 8, C. The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action.
