Mike,
For your records, NCG030225 has been made "inactive" as of this morning. Bradley told me we don't have to revoke or
rescind the permit since it is already expired. Inactivating it just means they won't keep getting invoices, which were
getting returned to us anyway.
So all that's left to do now is figure out if the new owner of the facility, Carolina Plastics Recycling, needs to apply for a
new permit (probably NCG13). As I understand it, you and the FRO staff person assigned to Anson Co will inspect the
site in the coming months to determine if there are any stormwater outfalls.
Thanks for your help on this. I can't express how much I appreciate all the help you've given me as I get more and more
involved in these permitting issues. Let me know if I can return the favor.

On an entirely unrelated topic, I am trying to track down a company whose NCG03 permit has expired and they're
about 4 years overdue.in payments. I was wondering if you had any information about the company.

Hi Mike,
a) I think the absence of a discharge trumps all other considerations. And simplifies getting to the appropriate
endpoint here, which is: they don't need our permit.
b) Here's one expedited path that would work for us:
a. First, let's get the current owner to send us a rescission request, citing the key fact that they don't have
any regulated industrial activity area drainage leaving the site. This should be on their letterhead, and
signed by some officer of the company (not the EHS & Maintenance Manager.)
b. Presuming that the sale was some few years ago, I would relate that we've been relatively unsuccessful
getting our requested signatures from past owners once some time has passed. Unless the most recent
sale was in 2009, or unless the old owners are still participating in the business, let's skip the
requirement to have both parties sign the transfer of ownership form. But, still let's have them fill out
the transfer form as much as they can.
c. In addition, let's have the current owner supply some executed documentation of the transfer:
warranty deed, bill of sale, sales contract, quit claim deed, etc. This sort of documentation is in the
possession of the current owner, or is obtainable by his phone call to his attorney that handled the
transaction.
d. We'll use your email today as indication that FRO approves the rescission, based on no point -source
discharge of stormwater from the areas of industrial activity.
e. Since the permit was apparently issued in error, I don't think we have authority to make them clean up
the facility before we approve the rescission request. We're just correcting our error using the
administrative tools available to us.
c) So, in summary, here's the documentation we need:
a. Permittee's rescission request letter, supported by
b. N/0 Change form, with just one signature (easily obtainable from our website), and
c. With executed sales documentation (already in the possession of the current owner), and
d. FRO concurrence (already in hand by your email below).
How does that sound as far as FRO is concerned?

Subject: Carolina Plastics in Anson County
7 Need some advice/recommendations. I visited the subject facility yesterday with the intention of getting the facility
under the correct general stormwater permit. The facility is presently under the NCG030000 permit, however they are a
plastics recycling company with SIC code 3089 (as provided to them by the local economic development office), which
would fall under the NCG050000 permit. Although, they are very similar to the proposed facility that is planned here in
Fayetteville that would fall under SIC code 5093 and maybe covered by NCG13 or an individual stormwater permit.
According to the plant manager who I met with yesterday, the company mainly receives bottles from manufacturers
that do not pass specs so the bottles have never been used for their intended purpose of containing soda, detergent,
etc. He also relayed that while operations involved turning these bottles into plastic flakes for reuse, this has ceased and
they are now simply in the process of bailing the remaining bottles stored on the grounds for subsequent shipping
overseas. Now, here's where things get tricky. After walking the site and observing the mounds and mounds of plastic
bottles of just about every type covering the property, I could not find a single stormwater outfall! The area is flat, there
are no drains in the parking or roadway areas, and the only ditch is one that comes off the highway and parallels the
property prior to turning at the back of the facility and going under an abandoned railway. There are no ditches or other
conveyances that would collect storm flow and carry it off the property in a concentrated manner. Also, there is
vegetation present at the back of the plastic bottle piles and there is no stream or apparent wetlands on the property.
My thoughts are that they obviously need to send a letter to SPU that references ownership/name change (BIMS has the
facility as Southern PET Recyclers, but the facility is currently owned by New Horizons Plastics and the facility name is
Carolina Plastics) along with a request to rescind coverage under NCG03 because it does not apply to their industrial
activity. I'm unsure, however, about having them submit an NOI for coverage under the NCG05 or NCG13 permit due to
the lack of a point source discharge of stormwater.

Your facility is currently covered for stormwater discharge under General Permit NCG030000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day:
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 11 categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Stormwater Staff member listed below or check the Stormwater & General
Permits Unit Web Site at http://h2o.enr.state.nc.us/su/stormwater.htmI
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.'

Payment of the required annual administering and compliance monitoring fee of $80.00 for this year has not
been received for the subject permit. This fee is required by Title 15 North Carolina Administrative Code 2H.0105, under
the authority of North Carolina General Statutes 143-215.3(a)(1), (1a) and (1 b). Because this fee was not fully paid within
30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 ncac 2H.0105(b) (2) (k)
(4), and G.S. 143-215.1 (b) (3).
Effective 60 days from receipt of this notice, subject permit is hereby revoked unless the required Annual
Administering and Compliance Monitoring Fee is received within that time. Discharges without a permit are subject to the
