Location description: The proiect site is located approximately 400 feet northwest of the Thompson Street, Juleann
Street intersection near Pittsboro. Chatham Countv North Carolina. The Droiect is identified as the Chatham Park,
Section 5.1, Thompson Street Subdivision.
Description of projects area and activity: This verification authorizes the temporary and permanent impacts to tributar
streams associated with the construction of a residential subdivision as follows: Roadwav Crossing #1: (Impact #S2)
23 linear feet of permanent impact for the installation/extension of an aluminum box culvert, (Impact #S3) 7 linear
feet of permanent impact for the installation/extension of an aluminum box culvert, impacts include replacement of an
existing 4' x 4' concrete box culvert with a 54 linear foot #61 L2 Aluminum Box Culvert; (Impact #S4) 55 linear feet of
permanent impacts for a rip rap velocitv dissipation pad, (Impact S1) 29 linear feet of temporary impacts for
construction access/dewatering and (impact S5) 7 linear feet of temporary impacts for a storm easement. Utilitv
Crossing #1: (Impact #S6) 22 linear feet of temporary fill for the installation of a waterline crossing; Utilitv Crossing
#2: (Impact #S7) 21 linear feet of temporary fill for the installation of a sewerline crossing; Utilitv Crossing #3:
(Impact #S8) 22 linear feet of temporary fill for the installation of a sewerline crossing.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the
enclosed
Conditions, your application signed and dated 3/23/2019, and the enclosed plans labelled Thompson Street SD Impact
Maps and Thompson Street Widening Impact Maps received on March 23, 2019. Any violation of the attached
conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order,
a Class I administrative penalty, and/or appropriate legal action.
Special Condition:
1. In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with
the provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility
Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby
incorporated as special conditions of this permit authorization.
Remarks:
Currently, the U.S. Army Corps of Engineers still consider Chatham Park as a single and complete non-linear project. The
term single and complete non-linear project is defined in the January 6, 2017 Federal Register, 33 CFR, Chapter II, Issuance
and Reissuance of Nationwide Permits; Final Rule and states, that it is the total project proposed or accomplished by one
owner/developer or partnership or other association of owners/developers. A single and complete project must have
independent utility. Independent utility is also defined in the 2017 Nationwide Permit rules. A project is considered to have
independent utility if it would be constructed absent the construction of other projects in the project area. Portions of a multi -
phased project that depend upon other phases of the project do not have independent utility. As such, the Corps of Engineers
considers the proposed Chatham Park, Section 5. 1, Thompson Street Subdivision, as a component of the larger project,
Chatham Park. While we have requested additional plans, including proposed impacts to jurisdictional waters, for the entire
Chatham Park development, you have not provided those to date.
The use of more than one Nationwide Permit (NWP) for a single and complete project is prohibited, except when the acreage
loss of waters of the United States authorized by the NWPs does not exceed the acreage limit of the NWP with the highest
specific acreage limit. The threshold limits of the applicable NWPs are 0.5 acre of non -tidal waters, including the loss of no
more than 300 linear feet of stream bed, unless the district engineer waives the 300 linear foot limit for intermittent and
ephemeral stream beds by making a written determination concluding that the discharge will result in minimal adverse
effects. Based on the information that has been submitted to date, impacts associated with the following three (4) projects:
SAW -2015-01520 (Freedom Parkway), SAW -2013-02291 (Bojangles Sanitary Sewer), SAW -2016-02486 (Chatham Park
Way, Phase 1) and SAW -2019-01278 (Chatham Park, Section 5. 1, Thompson Street Subdivision) are located within the
Chatham Park PDD boundaries. Cumulatively, the total permanent impacts resulting in a loss of waters, do not exceed the
threshold limits of the applicable NWPs.

However, when either of these threshold limits (linear feet and/or acreage) is exceeded by subsequent projects within the
boundary of Chatham Park (including but not limited to the three (3) projects listed above), an Individual Department of the
Army permit may be required for all subsequent proposed work.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified,
suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or
modified, this verification will remain valid until the expiration date identified below, provided it complies with all
requirements of the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is
modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities
which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit,
will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit's
expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify,
suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification.
You should contact the NC Division of Water Resources (telephone 919-807-6300) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act
(CAMA), prior to beginning work you must contact the N.C. Division of Coastal Management Morehead City, NC, at (252)
808-2808.
This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required
Federal, State or local approvals/permits.

SECTION I - The following identifies your rights and options regarding an administrative appeal of the above decision.

A: INITIAL PROFFERED PERMIT: You may accept or object to the permit.
• ACCEPT: If you received a Standard Permit, you may sign the permit document and return it to the district engineer for final
authorization. If you received a Letter of Permission (LOP), you may accept the LOP and your work is authorized. Your signature
on the Standard Permit or acceptance of the LOP means that you accept the permit in its entirety, and waive all rights to appeal the
permit, including its terms and conditions, and approved jurisdictional determinations associated with the permit.
• OBJECT: If you object to the permit (Standard or LOP) because of certain terms and conditions therein, you may request that the
permit be modified accordingly. You must complete Section II of this form and return the form to the district engineer. Your
objections must be received by the district engineer within 60 days of the date of this notice, or you will forfeit your right to appeal
the permit in the future. Upon receipt of your letter, the district engineer will evaluate your objections and may: (a) modify the
permit to address all of your concerns, (b) modify the permit to address some of your objections, or (c) not modify the permit
having determined that the permit should be issued as previously written. After evaluating your objections, the district engineer
will send you a proffered permit for your reconsideration, as indicated in Section B below.
B: PROFFERED PERMIT: You may accept or appeal the permit
