After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2727. This certification allows you to use Nationwide Permit Number 33 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a hearing. NA l _4 Owner's Signature Dace PROJECT DESCRIPTION MI-10 Pump Station Gate Repair 404 Nationwide Permit # 33 The flap gates on the pump station for the MI-10 impoundment (a managed wetland) on Mattamuskeet National Wildlife Refuge requires repairs and minor modifications to correct a water ram effect causing excessive water loss when holding water during the winter months. To repair the flap gate on the outlet end of the pump requires the water be removed from the proposed work site. A coffer dam will be installed across the basin between the pump station and the Waupoppin Canal and a portable pump used to pump out the basin to allow personnel and equipment to access the flap gate. A 404 Nationwide Permit #33 is being requested to install the temporary earthen coffer dam. The coffer dam will be approximately 40 feet in length by approximately six feet in width and will represent approximately 0.005 acres of temporary fill in a man-made- canal. The water depth averages 2-3 feet and the earthen fill is estimated to be approximately 20 cubic yards. The source of fill material will be the nearby spoil from the man-made canal. The basin behind the coffer dam will pumped and represents a temporary drainage of approximately 0.015 acres of aquatic habitat.
