Dear Mr. Thompson:
On March 12, 2018, the Fayetteville Regional Office of the Division of Energy, Mineral and Land Resources
(DEMLR) received a copy. of your letter dated March 4, 2018 requesting regulatory relief from monthly
monitoring due to consecutive exceedances of the benchmark value for zinc at outfall 001. Please keep in
mind that benchmark exceedances are NOT limit violations or violations of permit conditions; however, you
are obligated to follow the tiered response actions outlined in your permit.
The letter summarizes actions taken by the facility since 2013 including a facility evaluation to determine the
possible cause of the exceedances, better housekeeping requirements, installation of curbing and a
StormCeptor unit to collect and capture any friction material particles, and placing reject mixed friction
material into a lined open top hopper. The letter also references that the facility is working on a solution to
place reject friction material into sealed bags prior to transporting them to the open top hopper. In addition to
these actions, stormwater sampling for zinc has been conducted at roof drains as well as areas of
stormwater run-on (ditches from the road and adjacent facility) where a number of the results show similar or
higher values for zinc.
In response to your request for regulatory relief from monthly monitoring, a site inspection was conducted on
May 23, 2018. The purpose of the inspection was to ensure compliance with the conditions of NPDES
Stormwater General Permit NCG030000 and to review and discuss the aforementioned actions taken by the
facility as well as the results of the additional sampling. During the inspection, it was relayed that there have
also been exceedances of the benchmark value for copper and additional sampling of roof drains and areas
of run-on have been conducted. At the time of inspection, the facility was found to be in compliance with the
tiered response actions and other conditions of the NCG030000 permit. An inspection report related to the
May 23, 2018 compliance inspection will be provided under separate letter.
Based on the facility's compliance with the conditions of the NCG030000 permit, actions taken by the facility
to address possible causes of the zinc and copper exceedances along with the results of the additional
sampling, we are granting regulatory relief in the form of a collapsed Tier 2 - Tier 3 response. Upon receipt of
this letter, Railroad Friction Products Corporation may resume the permit specified semi-annual analytical
monitoring at the Maxton facility. This relief letter remains in effect through the subsequent reissuance of the
NCG030000 permit. This decision applies only to the zinc and copper benchmarks. A benchmark
exceedance of any other parameter listed in your permit will trigger the tiered response actions as
described in the permit.

been above the listed benchmark values. As a result, we have instituted Tier Two monthly monitoring
for zinc per permit requirements. All zinc test values are included in Table 2 located in Appendix A of
this letter.
Prior to January 1, 2013, RFPC was not required to test our storm water for zinc. Once RFPC began
testing for zinc and the zinc test values were noticed to be above listed benchmark values, RFPC took
the following corrective actions, all of which have been previously communicated to DWQ.
Possible Solutions
However, as noted above, the tested values for zinc remain higher than listed benchmark values in our
permit. Overtime, RFPC became concerned that it was possible that storm water zinc values of storm
water entering our property (based on known surface water flo rm water enters onto our
property from two primary locations from areas west) were a _ fi ve the listed benchmark value.
For this reason, we began testing storm water at these tw „iCE pstream of our facility. See Figure
tin Appendix A that shows these two locations. The res ',°° a s� below in Table 1.

I have been hired to assist in mitigating a drainage issue at Railroad Friction
Products in Maxton NC Permit No. NCG030108 (see attached). ??No
attachment?? In their semi-annual stormwater effluent monitoring it was
discovered that the zinc levels where above the limit. We would like to retrofit
of a proprietary stormwater system, specifically a Stormceptor unit, to scrub
the water prior to it leaving the site: Currently they have no BMP's on -site.

On November 29, 2007, I, Michael Lawyer from the Fayetteville Regional Office of the Division
of Water Quality, conducted a site inspection at the Railroad Friction Products Corporation facility
located at 13601 Airport Road in Scotland County, North Carolina. A copy of the Compliance
Inspection Report is enclosed for your review. Your time and assistance provided during the inspection
is greatly appreciated. Stormwater from this facility drains to an Unnamed Tributary to Shoe Heel
Creek, a Class C;Sw water located in the Lumber River Basin. The site visit and file review revealed
that the subject project is covered by NPDES Stormwater General Permit-NCG030108.
Accordingly, the following observations were noted during the Division of Water Quality

In response to your renewal application for continued coverage under stormwater General Permit NCG030000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permifpackage:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG030000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit.
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Part I Section A — A new notation that the No Exposure Exclusion from permitting option may be available to the
permittee.
• Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL,
may not be eligible for renewed coverage under the General Permit.
• Part II Section B Table 1 — An increased sampling frequency from once per year to twice per year.
• Part II Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of the option to
avoid sampling based on cutoff concentrations.
• Part II Section B — New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on
the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two
requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive
monitoring events show no benchmark exceedences.
• Part II Section B — A new provision that four exceedences of any particular benchmark will trigger increased DWQ
involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for
an individual permit, or may direct the implementation or installation of specific stormwater control measures.
DWQ received a number of comments on a series of general permits similar to this one. A full response to comments can be
found at http://ncwaterquality.org/su/industrialgpinfo.htm. Some comments resulted in permit modifications, others are
addressed in the response document or Fact Sheet..A few specific requests for clarification are addressed below.
1. What is the deadline for having a revised SPPP that reflects the provisions of the new General Permit? DWQ will require
that the permittee have a revised, complete SPPP no later than six months after the date of issue of that permittee's new
Certificate of Coverage.
2. Must analytical results be by a certified lab? What about pH measurements? All analytical results obtained to satisfy
NPDES permit requirements must be certified, as directed in North Carolina regulations at 15A NCAC 2H .0800, and as
administered by DWQ's Laboratory Section Certification Branch. This includes field pH measurements.

Please note: The November 1, 2007 transmittal letter contains a DWQ error.
We have since made several efforts to correct our error at the bottom of the
first page. Specifically:
"2. Must analytical results be by a certified lab? What about pH
measurements?" The corrected DWQ response is that according to federal
rule, all parameters reported in response to the requirements of this permit
must be sampled and analyzed in accordance with approved EPA methods.
However, the analyst or laboratory performing the analyses does not have to
hold a DWQ certification. This is almost a moot point for any commercial lab
offering services in North Carolina, because such a lab would almost
certainly already be certified by DWQ.
This issue comes into play more often when a facility may have an on -site
lab of their own, and they wish for their own staff to sample and analyze the
stormwater. In such a case the lab would not have to be certified, but the
analyst would have to conduct the analyses by EPA methods.

In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in

facilities in any of the I 1 categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial

is hereby authorized to discharge stormwater from a facility located at
Railroad Friction Products Corporation
Airport Road approximately 500 yards from US Hwy 74 Bypass
Laurinburg
Scotland County
to receiving waters designated as an unnamed tributary to Lumber River in the Lumber River Basin
in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I,11, III
and IV of General Permit No. NCG030000 as attached.
This Certificate of Coverage shall become effective June 18, 1993.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
