This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.) You must obtain a copy of the new NCG030000 General Permit from our website here: https:Hdeq,nc.gov/about/divisions/energy-mineral-land-resources/npdes-stormwater-gps. In addition to the full permit, the 2018 print package on the website includes revised monitoring forms. The Division is also notifying you, in accordance with Part III Section B. 3. of the general permit and 15A NCAC 2H .1027(i), that you are required to make application for coverage under an individual permit for continued coverage of your stormwater discharge. The Director has determined that discharge from your facility is a significant contributor of pollutants to surface waters. This determination has been made based on site inspections along with review of available discharge monitoring results. We appreciate the efforts that you have made recently to address the discharge issues at your site, but it is apparent that an individual permit would more effectively establish a framework for pursuing stormwater discharge compliance. Once the individual permit is issued, your coverage under general permit NCG030000 will be rescinded. Failure to submit the individual permit application in the timeframe specified may result in enforcement actions including revocation of coverage under the general permit. The General Permit authorizes discharges of stormwater, and it specifies your obligations with respect to discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all changes in the reissued permit. Significant changes to the General Permit are outlined in documents available on the website above. Your facility has six months from receipt of the permit to update your Stormwater Pollution Prevention Plan (SPPP) to reflect any new permit requirements. How does the new General Permit affect Tier Stotus? The first sample period of your permit begins on January 1, 2019_ Tier 3 actions in Part IV of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. Likewise, Tier 2 actions are triggered by two consecutive benchmark exceedances beginning on the effective date of this permit and do not count prior exceedances. However, if your facility is already in Tier 2 (monitoring stormwater discharges monthly) or Tier 3, you must continue monthly monitoring until relieved through conditions of the permit or by DEMLR staff approval. When does electronic DMR reporting start? We are working toward on -boarding permittees with NPDES stormwater permits into the DEQ's eDMR system next year. Permittees will receive notification when our eDMR system is really for registration to begin reporting monitoring data electronically. It was agreed that after 5 to 6 samples we may look at the RO if they are going to apply for one. They would like to send us result for the TTO and would like to reduce or eliminate sampling since they are compliant with it for a long time. I asked them to forward the previous two years and we will look at it and give our feedback regarding the request. They are in Tier 2. At least one zinc value was approximately 50 mg/L (vs. permit benchmark of 0.067 mg/L, or current benchmark of 0.126 mg/L revised in 2013.) They have galvanizing processes on site. There is a complication involving ROS and a plant expansion that rearranged the three previously identified outfalls. I advised Samar: + One of us would be available to discuss if he wants to call us during/after the afternoon meeting. I'm happy to assume the lead contact role with Samar for the moment. + 50 mg/L is two to three orders of magnitude over the benchmark. Given that they have zinc in the process, and that this.exceedance is relatively very large, we are not so receptive to concluding that the source is environmental (soils), or background, or neighbors, or fencing, or galvanized culverts, or roofing, or siding in the absence of any strong evidence that these may be alternate sources accounting for the magnitude of the exceedance. • The site discharges to two different receiving waters. • All three outfalls should be tested in response to the exceedance at one: on the basis that under ROS the exceedance at one is responded to as though the exceedance were at all three; and on the basis that this exceedance is so egregious that we want to test all outfalls to see if they can narrow down the potential hot - spot source. • In addition, as to potential sources for this magnitude of discharged zinc: o Sloppy handling of baghouse wastes o Aerial deposition from the process o Process wastewater connected to the storm drainage system o Infiltration of contaminated waters into the storm drainage system o Poor housekeeping: floor wash down squeegeed out the doors; street sweeping inadequate or insufficiently frequent; sand blasting of galvanized pieces outside o Loading/unloading docks where powders or liquids are handled o Outside storage of mobile sources of zinc o Legacy deposits from current or past outside operations (sand blasting; painting; waste storage; bone yard discards; rinsing of drums, vessels, containers; etc.) + BIMS shows NOVs from MRO in 2006, 2008, 2009. —$3100 penalty assessment in 2010. Oily stains on the ground, copper sulfate, and lime discharged to the ground surface adjacent to a stormwater conveyance, with substantial residuals and the inspector's (Wes Bell) opinion of substantial risk to stormwater. Notation of outside sand blasting activity. Failure to conduct training, failure to update SPPP, failure to conduct visual monitoring, failure to conduct analytical monitoring. MRO's initial 2006 inspection was in response to a complaint. Samar and I discussed the site circumstances in light of the several complications at this site: • Does the presence of multiple receiving waters impact how we look at the zinc exceedance and ROS? • Does the magnitude of the exceedance influence how we advise the facility wrt Tier 2 or Tier 3 responses? We had chatted awhile back about the Galvan facility in Cabarrus County. They are a galvanizer and at one time had a permit from DWQ to discharged from lagoons on site. This resulted in groundwater contamination and as you can see from their attached stormwater results (first under permit with Tiers) that they are already a Tier I facility. There is groundwater infiltration at Outfall 002 but the concentrations of zinc when we tested in a non -rain event were an order of magnitude less than the zinc concentrations in the stormwater sampling that was done in June. They have proposed some changes on site and Wes and I will be doing a follow-up inspection in early October. There is still groundwater contamination (treatment system turned off due to non-use of supply wells in the vicinity) and also soil contamination in the lagoon area. We will also going to take some upstream and down stream samples in Back Creek from the two UTs they drain into moth of which we sampled earlier this year and had elevated zinc, chloride, sulfide, and TDS concentrations. Because of this and that Back Creek is impaired for biological integrity (added in 2003) we are probably going to push for individual permit for them. I guess we'll wait to see if any of items they have proposed in their Tier '1 response have an effect on the contaminants the stormwater. Relevant information is attached and I guess I'm just asking it be placed in their permit file for a future date when we move towards individual permit. I'd say they presented fair reasons to consider before enforcing for this deficiency (I lean towards not doing so). I did notice that at the first opportunity, their consultant MACTEC "did not have personnel available to mobilize to the site in time." I'd advise the company that if that is a repeating problem (not rain events between 10 PM and 5 AM), it may want to reconsider whom it contracts to do the sampling. I also usually make the recommendation to try and get a make-up sample if possible. Technically, they still violate the permit if they do not get the sample for the period. Whether DWQ pursues enforcement action is based on the reasons behind it. I hope that helps! MRO reserves the right to practice discretion as you all deem appropriate. In reviewing the file, it was noted that a groundwater remediation system was in operation under an interim corrective action plan (ICAP) until 2002, At that time, Galvan received permission to de -activate the system but continue groundwater monitoring. In'2004, the DWQ requested that Galvan update the comprehensive site assessment (CSA) and amend the ICAP. This office received a report on February 12, 2006 that included an updated well survey but a work plan for the CSA was never received. A departmental reorganization in 2007 resulted in the transfer of the oversight of this incident to the inactive Hazardous Sites Branch of the Division of Waste Management_ It has been determined, however, that regulatory authority for this site should remain with the DWQ since the groundwater contamination occurred as a result of activities related to a DWQ permit (NC0005576). In order to meet the regulatory requirements, you must submit an updated site assessment report to the Aquifer Protection Section of the Mooresville Regional Office within 90 days of receipt of this Notice.
