Thanks for returning my call. Here is the correspondence we discussed today about our stormwater permit. I looks like
Mr. Bennett did provide me with an electronic copy of the certificate of coverage, but it did not include the actual
permit and I never did receive the original update version in the mail with the correct address as he indicated I would.
As I mentioned, I did not sample to the updated parameters that are now required in the new permit for the first half of
2013 as I was unaware of the changes because of this problem.
If you can get the updated document sent to me at the below address as we discussed and also make a note to our file,
possibly with this email as to what occurred, I would appreciate it.

I submitted the attached renewal paperwork in March of 2012 but have not received the new permit that is listed on
your website. As such, we have continued to comply with the conditions of the previous expired permit.

In response to your renewal application for continued coverage under stormwater General Permit NCG030000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG030000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/wq/ws/su/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit
http://portal.ncdenr,org/web/wq/ws/su/npdessw (click on 'General Permits' tab) to review that information
for your specific General Permit carefully.

Your facility is currently covered for slormwater discharge tinder General Permit NCG030000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to (lie Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we arc informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must he completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of m least $250,00. Larger
penalties may he assessed depending on the delinquency of the request. Discharge of storrnwater from your facility
Without coverage under a valid slormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). if you feel your facility can certify a condition of "no exposure", i.c. the facilty industrial
materials and operations are not exposed to storrnwater, you can apply for the no exposure exclusion. FOr additional

If the subject storrnwater discharge to waters of the state has been terminated, please complete the enclosed

■ A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.

Charlotte Stormwater Review Section of the report.
It is requested that a written response be submitted to this Office by April 29, 2009,
addressing the above -noted violations in the enclosed report. In responding to the violations,
please address your comments to the attention of Ms. Marcia Allocco at the letterhead address.
The subject facility will have 90 days from the letterhead date to come into compliance
with the above -noted violations. A follow-up evaluation will be conducted by CMSWS after
June 29, 2009 to ensure compliance with the facility's Stormwater Permit and/or compliance
with the City of Charlotte Stormwater Ordinance.

This is in response to the Notice of Violation (NOV-2009-PC-307).
Issue: Has the facility evaluated feasible alternatives to current practices?
Response: Reference to a feasible study is spelled out in our original SWPPP. A review of the plan and
discussions of possible improvements takes place annually. We will add documentation of this
annual review to the SWPPP. The plan is reviewed and signed by our Operations Manager.
(see attachment A) Several years back we added a concrete pad with diking where our scrap
metal bins are located. We did this to collect rainwater that comes in contact with the scrap
metal and divert it to our wastewater treatment facility. We did not conduct a feasibility study,
we did it because we thought it was good for the environment. Just in the past few weeks we
have discussed and have ordered a "tub" to place our double -walled diesel fuel tank in just in
case the fuel delivery man overflows the tank.
Issue: Does the Plan include a Stormwater Facility Inspection Program?
Response:Yes, weekly, except for vacation or holidays, the empty drum storage area, storm drains,
outside storage area and our outside double walled above ground storage tanks are inspected.
(see attachment B) In July of 2008 we hired Tanknology, Inc. to conduct Tank Tightness
Testing on three of our above ground tanks. This is not required but we thought it was good
practice.
Issue: Has the Stormwater Pollution Prevention Plan been implemented?
Response: Yes.
Issue: Has the facility conducted its Qualitative Monitoring semi-annually?
Response: Weekly, except for vacation or holidays, all four outfalls are inspected. If it is raining
the discharge is sampled and inspected for oil sheen, suspended solids, foam, odor, clarity,
floating solids and color. If there are any out of the ordinary findings, these findings are
documented in the comments section. (see attachment B) If it is dry during the weekly
inspection, the outfalls are checked for any illicit water flow or other items out of the ordinary.
Any findings are documented in the comments section. The form has been used since 2004 and
copies of previous inspections are available for review. The facility was inspected by
Charlotte -Mecklenburg in 2006 and these forms were determined to be acceptable. Based on
the results of this inspection, the facility will change to the form located on the NCDEC
website.
Issue: Has the facility evaluated all illicit (non stormwater) discharges'?
Response: During the weekly audit the outfalls are checked for illicit flow and any other out of the
ordinary issues. Any findings are documented on the audit check sheet. The facility will change
to the form located on the NCDEC website. The Operations Manager will review any findings.
Issue: Severe crosion was observed at Stormwater Outfalls A and C.
Response:The erosion problems were brought up by Trane and our plans for erosion control discussed.
As is plainly seen in the pictures taken during the site visit, Trane had added Rip/Rap to the
area to resolve the erosion problem but additional storm events have shown that additional
control measures are needed. Additional Rip/Rap and bales of straw will be added to the site to
control erosion and allow vegetation to establish.
Thank you for giving us the opportunity to respond to the Notice of Violation. Rest assured Trane takes
all environmental issues very seriously and will make appropriate adjustments to our processes.
We have always considered ourselves as being an environmentally responsible facility and will continue
to do so.

H. STORM WATER MANAGEMENT PLAN
A. MATERIALS MANAGEMENT PLAN
The General Pen -nit has established requirements for the development of a storm water
management plan. The Plan will include proposed pollution prevention measures and a
schedule for implementation and compliance. The specific requirements arc as follows:
A. I.b. Storm Water Management Plan, The storm water management plan shall contain
a narrative description of the materials management practices employed which
control or minimize the exposure of significant materials to storm water,
including structural and nonstructural measures. The storm water management
plan, at a minimum, shall incorporate the following:
(I) A study addressing the technical and economic feasibility of changing the
methods of operations and/or storage practices to eliminate or reduce
exposure of materials and processes to storm water. When,..,er
practicable the perrmittee shall cover all storage areas, material handling
operations, manufacturing or fueling operations to prevent materials
exposure to storm water. In areas where elimination of exposure is not
practicable, the: storm water management plan shall document the
feasibility of diverting the storm water runoff away ftom areas of potential
contamination.
A.1. Analysis of Methods of Operations
A review was conducted that addressed the feasibility ofrevising any procedures with the
goal of improving stone water quality. 'hhe factors considered were technical
practicality, water quality benefits, and economic costs.
The first aria of operation that was reviewed was the installation of roofs or other
covering for processes that may be exposed to storm water. The Permittee will evaluate
the feasibility of installing shed -type roofs in certain areas where hazardous materials or
metal parts are currently exposed. These areas include the used compressor and oil
motor stators storage areas of{the northwestern side of the building, the hazardous
materials storage areas on either side of the wastewater treatment plant, the scrap metal
and used compressor storage areas off the southwestern corner of the building, and the
used compressor storage and scrap metal storage areas off the eastern side of the building
near the loading dock.
A.2. Proposed Operational Changes
At the time this plan was prepared, no major operational changes were planned for the
subject facility. Cost could not be justified.
All drums containing liquids should be placed on pallets or racks. The use of pallets will
reduce the risk of drum corrosion. Any leaks that might occur will also be more readily
visible.

Forklifts are used daily in moving; heavy objects around the plant. Future employee
training will continue to emphasize the need for careful operation around containers of
liquid compounds.
Where possible, the Permittee will continue to divert wash flows away From storm catcli
basins and into drains connected to the WWTP.

Your facility is currently covered for stormwaler discharge under General Permit NCG030000, '['his permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to hove
the permit reissued by late summer of' 2002. Once the permit is reissued, your facility would he eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will he expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250,00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwaler NPDES permit would constitute a violation of NCGS 143-215. l and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). [f you feel your facility can certify a condition of "no exposure". i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

The follow-up evaluation was conducted as part of a cooperative working agreement between Mecklenburg
County and the Division of Water Quality. In addition, the evaluation was conducted on behalf of the City of
Charlotte in compliance with the City's NPDES Permit, NCS000240, fart 11 Section H. Thank you for your
assistance and cooperation during the follow-up evaluation.
The follow-up compliance evaluation found that the Trane US Inc. facility has implemented the corrective actions
as stated in the subject facility's response letter dated April 24, 2009. The corrective actions included:
Updating and implementing the Stormwater Pollution Prevention Plan in compliance with the General
permit and
• Providing ground cover at outfalls A and C to prevent soil erosion.

the SPPP has been fully implemented and now contains a feasibility study and a
stormwater facility inspection program.
