7. Report:
On May 16, 2014 1 conducted a large quantity generator (LQG) closure inspection at Apex
Tool Group, LLC located in Gastonia, NC. The facility has ceased operations and no longer
occupies the facility. I met with Mr. Matthew Somers, who is based at Apex Tool's South
Carolina facility, at the time of the visit. Mr. Somers had contacted the facility properiy owner
for permission to conduct the closure inspection.
The facility ceased manufacturing operations at this facility in July 2013 and their last day of
occupancy was on December 3, 2013. The facility is approximately 250,000 square feet in size.
The facility previously manufactured hand tool sockets for brands such as Craftsman. While in
operation The facility operated a wastewater pre-treatment system permitted for discharge to
City of Gastonia's ?OTW which F006 being the facilities primary hazardous waste stream.
Mr. Somers explained that 6 large volume of hazardous waste was generated during the
plant's decommissioning and clean -out throughout the last half of 2013 and was reported on
their 2013 Biennial Hazardous Waste Report. Mr. Somers also explained that both the NC
Division of Air Quality and Division of Water Resources made visits to the plant at the end of
2013,

During the inspection we conducted a waikthrough of the former manufacturing plant. All
areas within the facility were visually inspected as well as the area around the outside of the
plant_ Mr. Somers explained that the floor areas around the former electroplating lines,
wastewater treatment areas and other manufacturing areas were cleaned using power
washing equipment. All above ground tanks were also removed from the property and their --
secondary containment areas were cleaned. Holes were drilled within all outside secondary
containment area walls to allow for drainage. Mr. Somers submitted several emails in April 2014
which briefly described actions taken during the facility clean -out. Process equipment was
either sold -for reuse or moved to different Apex Tool facility. All wastewater treatment system
'equipment has also been removed from the site.
Mr. Somers has submitted a subsequent notification form to deactivate the facility's EPA ID
Number. No containers or tanks of waste or product materials were observed and no areas of
concern were observed during the closure waikthrough.
The property and structures are currently owned by HB Gastonia, LLC with a mailing cddress of
505 S. Flogler Drive, Suite 1400, West Palm Beach, FL 33401.

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or
decree_

Your facility is currently covered for stormwater discharge under General Permit NCG030000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 1 I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.
