On the request form you state manufacturing at the subject site ceased in 1997 and that no activities which would require permit coverage are currently occurring at the site. In accordance with your request, NPDES General Permit NCG030018 is rescinded, effective immediately. Please be advised that this permit rescission is based wholly upon your statement that the activities which would require general permit coverage at the site have ceased or been eliminated - Division staff has not visited the site to obtain independent verification. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. As described in this letter, GE is submitting a request to rescind the Stormwater General Permit as a result of changes in operations at the Hickory site since the permit was issued. Based on these changes, GE has determined that a Stormwater General Permit is not required. GE terminated active manufacturing operations at the Hickory site in January 1997. As a result, the manufacturing activity for which the Stormwater General Permit was issued (Metal Fabrication, Stormwater General Permit NCG030000) no longer applies, and GE is requesting rescission of the Stormwater General Permit. In addition, since there are no active operations or materials present at the Hickory site that are potentially exposed to stormwater, no other Stormwater General Permit is necessary to address the current site status. Following receipt of a letter from the DWQ dated June 6, 2002, regarding the Stormwater General Permit for the Hickory site (received by GE on June 11, 2002), GE contacted Mr. Mack J Mr. Bradley Bennett June 18, 2002 Page 2 Wiggins of DWQ to discuss the specific conditions at the Site and presented the rationale supporting the request to rescind the Stormwater General Permit. Mr. Wiggins concurred with GE's determination that a renewal permit is not required, and indicated that the DWQ would approve the request for rescinding the Stormwater General Permit and provide written confirmation of the agency's approval t . The Stormwater General Permit for the Hickory site expires on August 31, 2002. Therefore, GE would appreciate DWQ's prompt issue of an approval letter providing written confirmation of the agency's concurrence on rescinding the Stormwater General Permit. A condition of no exposure exists at an industrial facility when ail industrial materials and activities are protected by a storm resistant shelter to prevent. exposure to rain, snow, snowmelt, and/or runoff. Industrial materials or Activities include, but are not limited to, material handling equipment or activities, industrial machinery, raw materials, intermediate products. by-products, final produces, or waste prodirt:. Material handling activities ku:tude the storage. Loading and unloading, transportation, or conveyance of any raw material, iraennedrate product, final product or waste product. A storm rent shelter is not required for the following industrial materials and activities: - drums. barrels, tanks, and sirn4r containers that are tightly seated, provided those containers are not deteriorated and do not leak. 'Sealed" means banded or otherwise secured and without operational taps or valves: - adequateiy maintained vehicles used in material handling,; and - final product, other than products that would be mobxlired in storm water discharges (e.g-, rock saft). A No Exposure Certification must be provided for each facility quafifying for the no exposure exclusion. Zahid, I met with Kristen Yost at Commscope this afternoon. We went around the site and only have a couple of items which need further follow-up. Commscope has dosed their facility in Illinois and is moving equipment to this facility. They need to store extra fiber and fiber storage rolls on site. These will be exposed to stormwater, hence the need to change their permit from a No Exposure Certification back to NCG030000. 1. There is a 20,000 gallon propane tank located at the North Plant. This tank is still in operation. it was unknown at the time of this site visit if the tank was a single wall or double wall tank. There is no secondary containment around the tank. Ms. Yost will confirm with the propane provider as to the construction of the tank and get back with us. 2. There is a 20,000 gallon propane tank located at the South Plant. This tank has been decommissioned, cleaned, and all hoses and pipes removed. However, where the piping came out of the top of the tank is open to the elements. Again, the construction of this tank is unknown as to being single or double walled and there is no secondary containment. Commscope has not decided whether they are going to keep the tank on site or not. 3. Just for clarification purposes, there is an offsite drainage feature below the South Plant (just beyond the paved road) that brings in stormwater flow from a wooded area. This ties in with the stormwater system which discharges at SDO- 003. If you have any questions or need further assistance, please do not hesitate to contact me.
