South Old Oregon Inlet Road, Snort Nags HP d, as requested in the permittee's application letter dated 8/16/19, including the attached workplan drawings 2 dated 8/8/19 & AEC Hazard Notice dated 10/11/18. This permit, issued on 2113/19 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1 } Unless specifically altered herein, this Minor Modification authorizes the following changes to the previous Minor Modification that was issued on 11/6/18: increase the length of the existing damaged pipe that is authorized to be replaced to a total of 221 linear feet, increase the width of the trestle and cofferdam to approximately 75 feet, and add two permanent 15" timber piles on either side of the last concrete collar to delineate the end of the ocean outfall, all as depicted on the attached workplan drawings. NOTE: Based upon coordination with appropriate agencies, the activities authorized by this Minor Modification are allowed to take place during the moratorium established in Condition No. 3 of the Minor Modification issued on 11/6/18. Any work in subsequent years shall adhere to the full moratorium. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Department of Transportation Permit No.137-13 Page 2 of 2 ADDITIONAL CONDITIONS 2) The National Park Service (NPS) issued Special Use Permit #USA19-5700-020 for the proposed activities on 8/27/19. Nothing in this permit authorizes any activity that has not received approval from NPS, if required, for work within the Cape Hatteras National Seashore. 3) If it is determined that additional permanent and/or temporary impacts are necessary that are not shown on the attached workplan drawings or described in the authorization request, a permit modification and/or additional authorization from DCM may be required. In addition, any changes in the approved plan may also require a permit modification and/or additional authorization from DCM. The permittee shall contact a representative of DCM prior to commencement of any such activity for this determination and any permit modification. 4) The permittee and/or its contractor shall contact the DCM Transportation Project Field Representative in Elizabeth City at (252) 264-3901 to request a pre -construction conference prior to project initiation. 5) This Minor Modification does not eliminate the need to obtain any additional permits, approvals or authorizations that may be required. This includes approval, if required, from the U.S. Army Corps of Engineers (USACE) and the N.C. Division of Water Resources (DWR). 6) This Minor Modification shall be attached to the original of Permit No. 137-13, which was issued on 12/20/13, as well as the amendment issued on 3/28/14, and all subsequent modifications, letters of refinement and renewals, and copies of all documents shall be readily available on site when a Division representative inspects the project for compliance. 7) All conditions and stipulations of the active permit remain in force under this Minor Modification unless altered herein. NOTE: A minor modification application processing fee of $100 was received by DCM for this project.
