Based on this review, we have identified significant uses which would be removed by this project. These uses are water storage, pollutant removal and stream bank stabilization. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands. Therefore, we are moving toward denial of your 401 Certification as required by 15A NCAC 2B.0109. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you operate your farm without filling these wetlands? Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Please respond within two weeks of the date of this letter by sending a copy of this information to me and one copy to Mr. Samar Bou- Gazale at Mooresville Regional Office at 919 North Main Street, Mooresville, N.C. 28115. I met with Steve Chapin of the U.S. Army Corps of Engineers today and we walked over area UN A. After viewing the area and keeping in mind this has been the wettest summer we have had in these parts in years, I have decided not to appeal the minimal effects decision for area UNA. I have stated in my previous appeals that I felt area UN B was caused by the previous owner's attempt to reroute a waterway. Mr. Chapin and I walked over area UN B and viewed the rerouted waterway. Area UN B was not wet like area UN A even through we have had much more rainfall than normal this summer. After consulting with Mr. Chapin, I have decided to request a section 404 permit for area UN B. This permit would include cleaning up area UN B and returning the waterway to its original channel. I am also requesting a Water Quality Certification from the State of North Carolina. The Findings of Fact in the appeal decision by Mr. Robinette, dated July 10, 1995, states the field review determined that converting these wetlands to crop production would have an adverse effect on wildlife and would eliminate the natural water quality benefits provided by these wetlands. Area UN B is 0:8 acre located on a 140 acre tract of land. Approximately 20 acres of that 140 acres are used for crop production. The balance of the 140 acres are left to mother nature with the exception of cutting timber which is done under the guiding hand of Tim Pickett with the U. S. Forestry Service. Hunting Creek joins and four branches cross this 140 acre tract. This says nothing about everyone else's property up and down the creek. I don't believe anyone can prove that cleaning up the 0.8 acre in area UN B will have a major adverse effect on wildlife, and if it does not have a major adverse effect then it must have a minimal effect. I .... Regarding the elimination of the natural water quality benefits, I feel the Water Quality Certification for the State of North Carolina will soon show that cleaning up area UN B will not have a major adverse effect on the water quality. In conclusion, I agree to leave area UN A's 0.4 acre as it is for now. I request you grant a Minimal Effect Determination for area UN B for the reasons stated.
