Mr. Maddock gave us a copy of Mr. Howard's November 13, 1996 letter addressed to Mr. Maddock concerning the referenced approval and conditions. I enclose a copy of the deed covenant that was imposed by the State as a condition of the permit. Our client is in agreement with the State's desire to protect wetlands on his property. Since I had some confusion over the wording of the covenant as proposed by the State, I spoke with Peter Colwell of your office on December 3, 1996. Mr. Colwell confirmed our reading of the covenant that the covenant was not intended to prevent future applications for fill; rather, the covenant is intended as an additional way to put folks on record notice that wetlands on this property cannot be filled without first obtaining a permit from the State. In order to clarify the language proposed by the State to reflect this agreed-upon intent of the language, we would like to propose for your consideration the following revised language (additions are shown underlined and deletions are shown as strike- outs) : Mr. John Dorney December 9, 1996 Page 2 "A portion of this lot has been determined to meet the requirements for designation as a regulatory wetland. Any subsequent fill or alteration of this wetland shall conform to the requirements of state wetland rules adopted by the State of North Carolina in force at the time of the proposed alteration. The intent of the deed restriction is to prevent additional wetland fill without obtaining a permit from the State of North Carolina authorizing such fill. se The property owner should not assume that a future application for fill will be €ez fill will be approved. The property owner shall report the name of the subdivision in any application pertaining to said wetland rules. This covenant is intended to ensure continued compliance with wetland rules adopted by the State of North Carolina and therefore benefits may be enforced by the State of North Carolina. This covenant is to run with the land and shall be binding on all parties and all persons claiming under them." Please advise me in writing if the State will agree to this slightly modified deed restriction language. Unless we hear from you otherwise, we will assume that once this language is approved by your office and the permit is issued and our client takes title to the Property, that our client will fully satisfy this condition by recording said covenant once in the Dare County Registry prior to the transfer of any lots. That recordation will bind all subsequent lot transfers since the language quoted above is a real covenant which runs with the land. PROJECT SUMMARY: The applicant would like to construct a 105' wooden bulkhead along a lot on Roanoke Sound an average distance of 14' waterward of the normal water line, and a maximum distance of 20' waterward of the normal water line. The proposed bulkhead will tie into existing bulkheads on either side of the property. Thomas Kirkpatrick Bio Report Page 2 SITE DESCRIPTION The project site is located in Manteo on the Roanoke Sound and State Road 1120, more specifically, lot 17 Mother Vineyard Subdivision. The property is approximately 22,900 square feet in area and is bounded on the northeast side by the Roanoke Sound and along the southwest side by a man-made canal. State Road 1120 bisects the lot approximately 20' from the man-made canal. According to the Flood Insurance Rate Map the property is located in a V6 zone. Elevation of the property is estimated to be 37 above Base Flood Elevation (BFE). No structural improvements have been made to the property to date. The subject property is heavily wooded except an area containing 404 wetlands. High ground vegetation includes Loblolly Pine (Pinus taeda), Live Oak (Quercus virginiana), Wax Myrtle (Myrica cerifera), Sea Ox- eye (Borrichia frutescens), and Common Goldenrod (Solidago nemoralis). Vegetation found in the 404 wetlands includes, but is not limited to, Salt Meadow Cordgrass (Spartina patens), Cattail (Typha latifolia), Black Needle Rush (Juncus roemerianus), and Pennywort (Hydrocotyle umbellata). A distinct erosion scarp has formed along the shoreline on the water-ward side of a natural berm separating the Roanoke Sound from 2,024 square feet of 404 wetlands. The normal water line at the southeast corner of the property is approximately 20' landward of the bulkhead on the adjacent lot, and is approximately 5' landward the bulkhead on the northwest corner. Shoaling has occurred along the northwest corner as the result of a groin extending into the water off the Tysinger property (lot 16). Approximately 30 square feet of riprap is located at the landward end of the Tysinger's return wall to prevent erosion behind the bulkhead. Approximately four to six square feet of Salt Meadow Cordgrass has emerged between the riprap material. Riprap is also located at the landward end of the Tillet bulkhead on lot 18 and encroaches into the project site. The shoreline is littered with fallen trees and exposed roots resulting from erosion that is occurring at an estimated rate of two feet per year. PROJECT DESCRIPTION The applicant, Thomas Kirkpatrick, would like a permit to construct a 101' bulkhead along a lot in Mothers Vineyard, currently listed as being owned by Jeffery Malamey. Field measurement of the site suggests that the bulkhead will be approximately 105' in length. According to the application the bulkhead will be placed an average of 10' waterward of the normal water line and a maximum of 20', while field measurements suggest an average of 14'. The location of the bulkhead will allow the applicant to tie into the waterward edge of existing bulkheads on either side of the property. The area of shallow water habitat and public trust waters to be filled is approximately 1,400 square feet, based on field data. The average depth of the water along the alignment of the proposed bulkhead is 1.14' . Additional filling activities will include the filling of 2,042 square feet of 404 wetlands and 1,458 square feet of high ground. The total area to be filled will be approximately 4,900 square feet. Kirkpatric Property Roanoke Island, Dare County, NC Dear Ms. Mathis, As requested in your correspondence dated October 21, 1996 we have amended the application for a LAMA Major development permit for the subject site, and have included it and a revised site plan form your review- The subject 22,900 square foot site is located on S.R. 1120 on Roanoke Island, Dare County, North Carolina. The property is located on the Roanoke Sound and is undeveloped. The property is currently owned by Jeffery and Amber Malarney. Mr. Thomas Kirkpatrick currently holds the property under contract for purchase and has retained Environmental Professionals, Inc. (EPl), through Beach Realty, to provide representation for the purpose of securing a LAMA Major development permit to construct a bulkhead- The proposed bulkhead will connect existing bulkhead fronting property to the east and west of the subject property. The bulkhead will be constructed of treated wood piles, whalers, and tongue and groove sheeting. The piles and sheeting will be washed into place using a low pressure pump. Tiebacks will be constructed of threaded galvanized rebar and connected to buried anchors. The bulkheaded area will be backfilled with clean fill material that will be brought to the site. The construction of bulkhead and backfilling will result in impact to 2042 square feet of U.S. Army Corps of Engineers Section 404 wetlands, 1465 square feet of area below NWL, and an area approximately four square feet containing Spartina patens, a coastal wetland specie. The project is proposed to provide adequate area upon the site for residential development including waterfront features.
