Dear Mr. Thomas:
On December 1, 2006, the Division of Water Quality (DWQ) advised you of our field-based
determination on an appeal request you submitted for a stream feature located on the subject
property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The stream feature
is referred to as feature "A" in the correspondence issued by this office. It is our understanding
that you wish to provide some additional documentation for us to consider with respect to our
review of this feature. You are hereby notified that we will consider the additional data you wish
to furnish with respect to this feature, provided that it is received in this office by close of
business on January 5, 2007. Upon review of the data you provide, a final determination of
applicability of the Neuse Buffer Rules with respect to feature "A" will be issued by this office.
In your response, please be sure to include a narrative that articulates how you believe the data
provided will affect the overall review.
This letter only addresses the applicability to the buffer rules and does not approve any activity
within the buffers. Nor does this letter approve any activity within Waters of the United States
or Waters of the State. If you have any additional questions or require additional information
