You have our approval to place fill material in 1,405 square feet of weili,mds or waters for the purpose of
constructing a parking area and access road at US 64/264 along the north and west sides of Washington Baum
Bridge, as you described in your application dated 27 June 1996. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project. you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in the attached certification
and any additional conditions listed below. This certification is not valid unless the DWQ Coastal
Stormwater Program approves the stormwater plan for this project. In addition, you should get any other
federal, state or local permits before you go ahead with your project including (but not limited to) Sediment
and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Off\,Ce of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are fmal and binding unless you ask for a hearing. .

Dear Preston:
Our office has calculated the contiguous wetland area associated with the parking lot
expansion, We have used the Corps/NCDCM field flagged wetland line as the southern
edge and the open water pools on the northern edge for the area calculation, The
contiguous wetland vegetation, including both 404 and tidal wetlands, totals
approximately 33,550 square feet or 0,77 acres, Glen Futrell has also performed a field
survey using the landward limit of marsh grass and has come up with only 0.43 acres,
Although we do not agree with NCDCM/regional staff's interpretation of the Dare
County Land Use Plan regarding wetlands, the limited size of the contiguous wetlands at
this site would suggest that the proposed wetland impacts are otherwise consistent with
the staff's County wetland policy,
The plat we used to make our calculation is attached with the contiguous wetland area
highlighted, Perhaps this information will be helpful in making your final permit

Please reference the application of Roanoke Properties, Ltd.,
for Department of the Army (DA) authorization and a State Water Quality
Certification to place fill material in wetlands and construct an access
road and parking area, on property located off the north side of U.S.
Highway 64/264, adjacent the Roanoke Sound, Manteo, Dare County, North
Carolina, Your receipt of this letter verifies your acceptance of a valid
request for certification in accordance with Section 325,2(b) (ii) of our
administrative regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of the
same law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action, Therefore, if you have not acted on the request, or asked for an
extension of time, by August 27, 1996, the District Engineer will deem that
waiver has occurred.

Site Description
The applicant, Roanoke Properties Limited Partnership, and the North Carolina
Department of Transportation have executed a right-of-way encroachment agreement which
grants Roanoke Properties the right to construct an access road and parking lot on DOT's
property. The agreement allows improvements within a 1,200' long section of highway
right-of-way located between the boat basin at the Pirates Cove Marina and the western end
of the new Washington Baum Bridge in Dare County. A 100' wide, 800' long entrance
canal connects the Pirates Cove Basin with Roanoke Sound. The waters of Roanoke Sound
in the vicinity of this project are classified as SA by the NC Division of Environmental
Management.
During the years 1989 through 1993 this 21/2 acre site was highly disturbed by
activities involving construction of the new bridge, removal of the old one' and the
construction and subsequent removal of a temporary access road. The right-of-way extends
60' - 120' north of the new four lane bridge and its western approach. Lying north of the
DOT right-of-way is a 1,000' long, 2' deep slough with a width of 15' - 40'. An eroding
spoil bank 10' - 30' wide and 2' - 5' high separates the slough and the Pirates Cove Basin.
At several locations portions of the spoil bank have completely eroded, allowing an exchange
of water between the slough and basin. Elevation of the site ranges from l' above mean sea
level at the edge of the slough to approximately 30' above mean sea level at the tallest part
of the bridge approach. Under the bridge and south of the bridge is a 63 space asphalt
parking area designed to serve a three-ramp boat launching facility constructed by the NC
Wildlife Resources Commission in accordance with CAMA Major Permit #6-92.
For the purpose of description the 1,200' long site will be divided into two areas as
follows:
1) The 400' long section abutting the bridge approach, and
2) The 800' long section lying north of the bridge.
The portion abutting the approach is narrower (60' - 90' wide) with a 20' wide regularly
flooded mudflat sparsely vegetated with bulrush (Scirpus spp.), lying just landward of the
normal water level of the slough. Within a 10' wide strip landward of the mudflats are
irregularly flooded clumps of black needlerush (Juncus roemerianus) with a scattering of salt
meadow grass (Spartina patens). On the slope above the wrack line is a 5' - 6' wide strip
vegetated with groundsel tree (Iva frutescens) and salt meadow grass (Spartina patens).
Higher on the slope are various upland species used by NC DOT to stabilize the
embankment.

Within the 800' long section just north of the bridge, the normal water level of the
slough is delineated by a near vertical bank which gradually increases in height as one nears
the east end of the slough. From west to east the dominant vegetation along this bank
changes from salt meadow grass (Sparrina patens) to black needlerush (Juncus roemerianus)
to saw grass (Cladium jamaicense) and at the higher portion of the bank to shrubby
vegetation such as wax myrtle (Myrica cerifera) and wild black cherry (Prunus seratina). A
10' tall, 50' - 60' wide berm lies 30' - 50' landward of the slough and parallels the bridge.
This berm is stabilized with vegetation such as common reed, virginia creeper, poison ivy,
prickly pear, weeping lovegrass, Kentucky fescue, wild onion, pepper weed, crab grass and
dog fennel.
Proposed Development
The applicant proposes to construct forty-five 9' x 18' parking spaces of porous asphalt
atop the 50' wide berm located north of the bridge. The parking spaces will be adjacent a
22' wide drive aisle constructed of standard asphalt. A 500' long access road of standard
asphalt varying in width from 12' - 16' will be constructed along the lower portion of the
slope which forms the bridge approach and connect the 45 space parking lot with an existing
18 space parking lot permitted under Modification of CAMA Major Permit #202-87 dated
August 3, 1995. The access road will be installed landward of a 500' long, 4' tall wooden
bulkhead constructed an average distance of 30' landward of NWL. All construction is
proposed above coastal wetlands, however 1,405 square feet of non-coastal wetlands will be
filled as a result of the proposed development. The 6' wide dock and 5 pedestrian
accessways along the southern side of the Pirates Cove Basin shown on the applicant's plat
dated April 29, 1996 were reviewed in 1992 as a proposed modification to CAMA Major
Permit #202-87 and are not part of this application.
Anticipated Impacts
Construction of the 500' long access road will result in the filling of 1,405 square feet
of non-coastal wetlands.
Increased runoff will occur as a result of the installation of 26,000 square feet of
asphalt. An additional 15,500 square feet of land disturbing activity will occur as a result of
the creation of grassed swales and fill slopes, and the installation of four stormwater basins.
No archeological/historical significance has been associated with this site. No unique
remnant species or geological formations are known to exist within the project area.

Site Descri{ltion
The applicant, Roanoke Properties Limited Partnership, and the North Carolina
Department of Transportation have executed a right-of-way encroachment agreement which
grants Roanoke Properties the right to construct an access road and parking lot on DOT's
property. The agreement allows improvements within a 1,200' long section of highway
right-of-way located between the boat basin at the Pirates Cove Marina and the western end
of the new Washington Baum Bridge in Dare County. A 100' wide, 800' long entrance
canal connects the Pirates Cove Basin with Roanoke Sound. The waters of Roanoke Sound
in the vicinity of this project are classified as SA by the NC Division of Environmental
Management.
During the years 1989 through 1993 this 21/2 acre site was highly disturbed by
activities involving construction of the new bridge, removal of the old one and the
construction and subsequent removal of a temporary access road. The right-of-way extends
60' - 120' north of the new four lane bridge and its western approach. Lying north of the
DOT right-of-way is a 1,000' long, 2' deep slough with a width of 15' - 40'. An eroding
spoil bank 10' - 30' wide and 2' - 5' high separates the slough and the Pirates Cove Basin.
At several locations portions of the spoil bank have completely eroded, allowing an exchange
of water between the slough and basin. Elevation of the site ranges from l' above mean sea
level at the edge of the slough to approximately 30' above mean sea level at the tallest part
of the bridge approach. Under the bridge and south of the bridge is a 63 space asphalt
parking area designed to serve a three-ramp boat launching facility constructed by the NC
Wildlife Resources Commission in accordance with CAMA Major Permit #6-92.
For the purpose of description the 1,200' long site will be divided into two areas as
follows:
1) The 400' long section abutting the bridge approach, and
2) The 800' long section lying north of the bridge.
The portion abutting the approach is narrower (60' - 90' wide) with a 20' wide regularly
flooded mudflat sparsely vegetated with bulrush (Scirpus spp.), lying just landward of the
normal water level of the slough. Within a 10' wide strip landward of the mudflats are
irregularly flooded clumps of black needlerush (funcus raemerianus) with a scattering of salt
meadow grass (Spanina patens). On the slope above the wrack line is a 5' - 6' wide strip
vegetated with groundsel tree (Iva frutescens) and salt meadow grass (Spanina patens).
Higher on the slope are various upland species used by NC DOT to stabilize the
embankment.

Within the 800' long section just north of the bridge, the normal water level of the
slough is delineated by a near vertical bank which gradually increases in height as one nears
the east end of the slough. From west to east the dominant vegetation along this bank
changes from salt meadow grass (Spartina patens) to black needlerush (Juncus roemerianus)
to saw grass (Cladium jamaicense) and at the higher portion of the bank to shrubby
vegetation such as wax myrtle (Myrica cerifera) and wild black cherry (Prunus seratina). A
10' tall, 50' - 60' wide berm lies 30' - 50' landward of the slough and parallels the bridge.
This berm is stabilized with vegetation such as common reed, virginia creeper, poison ivy,
prickly pear, weeping lovegrass, Kentucky fescue, wild onion, pepper weed, crab grass and
dog fennel.
Proposed Development
The applicant proposes to construct forty-five 9' x 18' parking spaces of porous asphalt
atop the 50' wide berm located north of the bridge. The parking spaces will be adjacent a
22' wide drive aisle constructed of standard asphalt. A 500' long access road of standard
asphalt varying in width from 12' - 16' will be constructed along the lower portion of the
slope which forms the bridge approach and connect the 45 space parking lot with an existing
18 space parking lot permitted under Modification of CAMA Major Permit #202-87 dated
August 3, 1995. The access road will be installed landward of a 500' long, 4' tall wooden
bulkhead constructed an average distance of 30' landward of NWL. All construction is
proposed above coastal wetlands, however 1,405 square feet of non-coastal wetlands will be
filled as a result of the proposed development. The 6' wide dock and 5 pedestrian
accessways along the southern side of the Pirates Cove Basin shown on the applicant's plat
dated April 29, 1996 were reviewed in 1992 as a proposed modification to CAMA Major
Permit #202-87 and are not part of this application.
Anticipated Impacts
Construction of the 500' long access road will result in the filling of 1,405 square feet
of non-coastal wetlands.
Increased runoff will occur as a result of the installation of 26,000 square feet of
asphalt. An additional 15,500 square feet of land disturbing activity will occur as a result of
the creation of grassed swales and fill slopes, and the installation of four stormwater basins.
No archeological/historical significance has been associated with this site. No unique
remnant species or geological formations are known to exist within the project area.
