Box 2511 Winston-Salem, NC 27102 Dear Mr. Bell: You have our approval to place fill material in 0.023 acres of wetlands or waters for the purpose of a road crossing at Hanes Landfill Grassy Creek crossing, as you described in your application dated 9 May 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2732. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. '? ?Z FOR 8 igh I kim HANES MILL SOLID WASTE LANDFILL VICINITY MAP - Dote 5/96 figure 1 TO: Mark Danvetz MEMORANDUM FROM: Michael Wolfe DATE: July 26, 1994 SUBJECT: Hanes Mill Landfill Standard Environmental Review Project No. 00162-080-018 Forsyth County, North Carolina is proposing an expansion of their Hanes Mill Landfill operations. In consideration of the potential for environmental impact due to such expansion, you and I discussed the project and scheduled a field review of the site. Prior to our visit to the landfill I contacted the Natural Heritage Program (NHP) of the North Carolina Department of Environment, Health and Natural Resources to obtain records of rare, threatened or endangered species in the vicinity of the project. The NHP had no such records of occurrence near the landfill, but they did provide a list of threatened and endangered (T&E) species known to occur in Forsyth County. The species listed were: bog turtle (Clemmys muhlenbergia), bog rose (Arethusa bulbosa), small-anthered bittercress (Cardamine micranthera), yellow fringeless orchid (Platanthera Integra), Small's portulaca (Portulaca smallii), and white irisette (Sisyrinchium dichotomum). Following is a summary of our findings at the proposed expansion area, and a review of the relevant considerations for each of the above species. The northern boundary of the project area is cut through by a small, intermittent stream which would be affected by construction activity. This stream averages 3 to 5 feet in width, has a bed of silt, sand and gravel, and has a nearly perpendicular bank of about 3 feet. Length of the stream through the project area is about 1800 feet. There is no distinctive floodplain associated with this stream and the only wetlands area is about 200 square feet and evidenced by a patch of arrowhead (Sagittaria latifolia). Total area of impact to waters of the United States, including wetland areas, at this project site would be less than 1/3 of an acre and, thus, qualifies this project under both the Nationwide Permit #26 and the North Carolina Department of Environmental Management (NCDEM) General Certification #2671 (see attached). The tree canopy along the south side of the stream is dominated by red maple, sycamore, tulip poplar and white oak. The understory includes green ash, black cherry, redbud, black gum, winged elm, American holly, sweet-gum, sourwood and possumhaw. The herbaceous component is primarily Microstegium, but beyond the areas of dominance by this species there is also Solomon's seal, cranesbill, beggar's tick, Michaux's lily, black cohosh, windflower and mock strawberry and other herbs. Upslope and further south of the stream the forest was apparently cut about 12 years ago and is now strongly dominated by small-diameter sweet-gum, green ash, tulip poplar, red oak and dogwood. The north side of the stream has less forest cover and is more strongly impacted by Microstegium. The conditions described above generally do not offer supportive habitat for the T&E species of concern. The bog turtle prefers boggy/marshy areas which this site does not hold, nor was the species observed. Similarly, the bog rose of sphagnum bogs and wet meadows was not observed in this area and would not be expected in the conditions at this site. The small-anthered bittercress was not found in the area. The dense growth of microstegium along the stream banks would restrict the growth of this species and the general physical conditions of the streambank area are not those preferred by Cardamine micranthera. The yellow fringeless orchid is associated with pine barrens and swamps, Small's portulaca with granite outcrops, and white irisette is associated with a basic soil variant of the oak-hickory type forest. None of these conditions are represented at the project site and none of these species were found there. In summary, because the project impacts less than 1/3 acre of wetlands it qualifies for construction under Nationwide Permit #26 and the NCDEM General Certification #2671. My survey of the area revealed no T&E species, and conditions at the proposed project site are such that none of the species of concern would likely be there. From the perspective of environmental permitting concerns, it is my finding that this project may proceed without further review. The remaining issue to be resolved is review and approval by the North Carolina Department of Cultural Resources, pursuant to North Carolina Solid Waste Management Rules and Law (Administrative Code Title 15A, Chapter 13, Subchapter 13B, Section .1622). Cultural Resources generally takes about three (3) weeks to respond to a request for review of a proposed project. Their determination may be that the project has the Department's approval to proceed, or they may require an archeological survey or some other stipulation prior to approval. We have conducted a search of our maps and files and have located the following structures of historical or architectural importance within the general area of the project: Paul's House, located 0.6 mile southwest of SR 1669, junction of US 52. Ziglar House, southwest corner, junction of US 52 and SR 1669. House, south side of SR 1669, 0.4 mile southwest of US 52 We evaluated these structures and determined none of them retain the historical or architectural detailing necessary for listing in the National Register of Historic Places. There are no known archaeological sites within the proposed project area. Based on our present knowledge of the area, it is unlikely that any archaeological resources which may be eligible for inclusion in the National Register of Historic Places will be affected by the project construction. We, therefore, recommend that no archaeological investigation be conducted in connection with this project. The above comments are made pursuant to Section 106 of the National Historic Preservation Act of 1966 and the Advisory Council on Historic Preservation's Regulations for Compliance with Section 106, codified at 36 CFR Part 800.
