APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Stark:

You have our approval to drain four ponds and place fill material in 0.05 acres of wetlands for
the purpose of preparing a site for commercial/industrial development at Fayetteville St., Cornwallis
St. and proposed Martin Luther King Blvd., as you described in your application d~ed 26 Sept. and 7
December 1995. After reviewing your application, we have decided that this fill is ~overed by General
Water Quality Certification Number 2671. This certification allows you to use ]\ationwide Permit
Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify ~s and you may be required to send us a new application.
For this approval to be valid, )IOU must follOw the conditions listed in the attached certification.
Wetland fill is allowed only on the uppellliost and lowermost fingers of the ''fetland as discussed in
the field with your engineer Mr. Duane Stewart. A dry retention basin shall be installed upslope of
the remaining wetlands to alter the mnoff from the developed site to non-erosive velocities. The
stream channel downstream of the wetland shall be stabilized or buried with a drop inlet to prevent
erosion into the wetland from the downstream direction. In addition, you should get any other federal,
state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may a';k for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which confOllliS to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions arc final and binding unlcss you ask for a hearing.

Dear Mr. Dorney:

I am writing in response to your September 28, 1995, letter
to Mr. Richard Stark requesting additional information concerning
the proposed draining and filling of 2.214 acres of isolated
waters and associated wetlands on property located in Durham
County east of Fayetteville Road, south of Cornwallis Road and
north of proposed Martin Luther King, Jr., Parkway. (The
proposal has been designated as DEM Project # 95918.) The
request for additional information was based on your
determination that information provided in the Joint Application
did not adequately demonstrate the need to fill the ponds and
wetland areas as proposed and, that absent such a demonstration,
approval of the project would violate North Carolina's
Antidegradation Policy. You also specifically inquired whether
it would be possible to construct the project so as to renovate
pond number 3 and preserve wetland number 2.

Following a thorough evaluation of the available options, M
L Durham Associates Limited Partnership, Inc. ("M L Durham
Associates") has determined for a variety of reasons that it
cannot fully comply with the recommendation to renovate pond
number 3 and preserve wetland number 2. M L Durham Associates
has, however, developed a proposal which it believes protects
existing uses of pond number 3 and wetland number 2 while at the
same time allowing optimum use of the property. That proposal
calls for renovating and relocating pond number 3 so as to create
a wet stormwater retention basin. The new stormwater retention
basin will encompass approximately one-half of the area currently
occupied by pond number 3 and approximately one-half of the area
currently occupied by wetland number 2. The remainder of the

areas currently comprising pond number 3 and wetland number 2
would be filled. The final grade of the parcel of property on
which the wet stormwater retention basin will be located will be
engineered so as to divert surface water runoff to the basin. (I
have enclosed a site plan graphically depicting the proposal.)
In addition, another wet stormwater retention basin will be
constructed on the adjoining parcel of property. A final
decision as to the exact location of this retention basin has not
been made; however, due to the grade of the adjoining parcel, it
will need to be located somewhere other than the current location
of wetland number 2 in order to effectively drain the property.

M L Durham Associates believes that there are a number of
environmental and practical advantages to the above proposal.
From an environmental perspective, while there will be some
initial disturbance, wetland flora and fauna will continue to be
present on the property. Further, the current use of retaining
stormwater until it can infiltrate to the subsurface will
actually be enhanced both in terms of the volume of water which
can be retained and the amount of land which will drain to the
retention basin. From a practical perspective, locating the
retention basin on a single parcel of property will eliminate
dual ownership and the inherent maintenance conflicts arising
from such ownership. M L Durham Associates, therefore, requests
the issuance of a 401 certification for the project as outlined
herein.

Dear Mr. Stark:

The Division of Environmental Management, Water Quality Section has reviewed your plans for the

Based on this review, we have identified significant uses which would be removed by the wetland fIll proposed.
These uses are streambank stabilization, pollutant removal and wildlife habitat. Furthermore, insufficient
evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands.
Therefore, we are moving toward denial of your 401 Certification as required by 15A NCAC 2B.OI09. Until we
receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers
and/or the N.C. Division of Coastal Management place your project on administrative hold.

Please provide us with information supporting your position that your project must be constructed as
planned and that you have 110 practicable alternative to placing fill in these waters and/or wetlands. Specifically
can you construct your project by renovating pond number 3 and preserving wetland number 27 The wetland
could serve to reduce the size of the storm water pond which would be required to protect downstream waters.
We have no objections to filling ponds I, 2 and 4 or wetland number 1. Any documentation such as maps and
narrative that you can supply to address alternative designs for your project may be helpful in our review of your
401 Certification. Please respond within two weeks of the date of this letter by sending a copy of this
information to me and one copy to our Mr. Danny Smith at the Raleigh Regional Office at 3800 Barrett Drive,

Biologists with the North Carolina Wildlife Resourcos Commission have
reviewed the subject certification and arc familiar with habitat values of the project area.
An on-site investigation was conducted on September 22, 1995. Our comments are
provided in accordance with provisions of the Clean Water Act of 1977 (33 V.S.C. 466 ct
seq.).

'111e applicl1I1t propo9cs to fIll 2.214 acres of wetlands. It appears that the mf\iority
or these wetland acres are ponds. These ponds probably provide habitat for various types
wildlife in the surrounding area. One of the ponds is located on a tributary of Northeast
Creek and recei ves stonnwater from development of the surrounding area, Therefore,
this wetland is providing important water quality fWlctions.

We will not recommend denial of the permit to fill the ponds. However~ we do
request that stonnwatel' control devices (Le. wet retention ponds) be installed to replace
the lost wetland functions when this land is developed. Construction of a stormwater
control structure will help protect th~ downstream fisheries ulld uquatic resourccs of
Northeu::It Creok and its tributary.
