Authorizing; Town of Benson Manager Implement NPDES Phase I Stormwater Permit
WHEREAS, The Slonnwatcr Phase If Final Rule is the nest step in EPA's effort to preserve, protect, and improve
the Nation's water resources from polluted stormwater runoff,, and
WHEREAS, The Phase 11 program expands the Phase I program by requiring additional operators of MS4s in
urbanized areas and operators of small construction sites, through the use of NPDES pennits, to implement
programs and ractices to control polluted stormwater, and
WHEREAS, Phase 11 is intended to further reduce adverse impacts to water quality and aquatic habitat by instituting
Ilie use of controls on the unregulated sources of stormwater discharges that tttve the greatest likelihood of causing
continued environmental degradation.
NOW THEREFORE BE IT RESOLVED, BY THE TOWN OF BENSON BOARD OF COMMISSIONERS:
That Matt R. Zapp, Town Manager, and successors so titled, is hereby authorized to execute and file permit
application on behalf of the Town of Benson with North Carolina Department of Environment and Natural
Resources (NCDENR).

INTRODUCTION
North Carolina's number one water quality problem is stormwater runoff pollution. As stormwater flows
across impervious surfaces, it picks up various pollutants, such as oil & grease, excess nutrients, bacteria
and sediment. Polluted stormwater flows down our storm drains and ditches where it is discharged,
untreated, into our streams, rivers, and lakes. Stormwater runoff pollution causes adverse impacts to
aquatic ecosystems, poses human health risks, and can greatly increase the cost of treating our drinking
water.
Program Background
In 1972, the National Pollutant Discharge Elimination System (NPDES) program was established under
the authority of the Federal Clean Water Act. Phase I of the NPDES Stormwater program was established
in 1990. It required NPDES permit coverage for municipalities with populations of 100,000 or more.
Phase II of the NPDES Stormwater program was signed into law in December 1999. The Phase 11
program extended permit coverage to smaller (< 100,000 pop.) communities and public entities that own
or operate a municipal separate storm sewer system (MS4). It required these' smaller communities to
develop a stormwater program and obtain an NPDES permit for stormwater discharges.
In North Carolina, the Department of Environment and Natural Resources, Division of Water Quality
(NCDWQ) administers the NPDES Stormwater program. The program requires the Town of Benson to
develop, implement, and enforce a stormwater program designed to reduce the discharge of pollutants
from the MS4 to the maximum extent practicable. The program is implemented through an NPDES permit
in phases over five years. Pursuant to the permit the stormwater program included the best management
practices (BMPs) for the following six minimum measures!
1. Public education and outreach on stormwater impacts;
2. Public involvement/participation;
3. Illicit discharge detection and elimination;
4. Construction site stormwater runoff control (Erosion Control);
5. Post -construction stormwater management for new development and redevelopment;
6. Pollution prevention/good housekeeping for municipal operations.
The Town of Benson's Stormwater Program is administered by Public Utilities Department. The Public
Utilities Diurector oversees the program. Attached is a copy of the organizational chart.

1.4 MS4 Conveyance System
The Town of Benson's stormwater conveyance system consists of a variety of components ranging
from curb and gutter systems conveyed by concrete pipe to simple sheet flow. The predominant

conveyance components within the corporate limits include curb and gutter conveyed by pipe
material, while conveyance in the ETJ primarily consists of open ditch/Swale. There also exists
various detention systems within the Town's jurisdiction, however these are on private property.
The Town maintains the conveyance system components located within jurisdictional right-of-way,
while the North Carolina Department of Transportation (NCDOT) maintains systems within their
right-of-way. Systems located on private property are maintained by the owner. The Town's
maintenance program consists of regular inspection, vacuuming basins and lines, sweeping streets
and leaf/debris removal.

3. Existing Water Quality Programs
3.1 Local Programs
The following programs and ordinances are being implemented within the Town's jurisdiction.
Unified Development Ordinance (UDO) -- The Town adopted and implemented a unified
development ordinance in 2007 which integrated zoning requirements, subdivision regulations,
physical development standards and penalties for violations
Flood Damage Prevention Ordinance — Protects water quality by regulating development within
flood hazard zones.

3.2 State Programs
State programs, including Neuse Rules, Water Supply Watershed Rules and NPDES Wastewater
Discharge, are implemented at the local level. The Town of Benson relies on NCDOT to maintain
stormwater facilities and programs within their roads rights -of way.

the Public Utilities Director oversees the program. Attached is a copy of the organizational chart.

implement the Town's construction (erosion and sedimentation control) and post -construction

6.4 Legal Agreement (for any inter -local agreements)
Recognizing the need for assistance and the benefits of local agreements, the Town entered into
an inter -local agreement with Johnston County in July of 2011. Under this agreement, Johnston
County provides the Town with services to implement the Town's stormwater management
program to include pre -construction and post -construction programs. Attached is a copy of the
inter -local agreement.

7. Stormwater Management Program
The following sections describe the Town's stormwater management program and measurable
goals for each BMP. While the BMPs under each minimum measure are not expected to change
over the life of this stormwater management plan, measurable goals may be modified, removed,
or new goals added. Changes may be necessary to meet changes in resources, or to be more
effective in reducing impacts to the MS4. Modifications to these goals will be documented within
the required annual report:
7.1 Public Education and Outreach
The Town's stormwater public education and outreach program includes membership in the
Clean Water Education Partnership (CWEP), distribution of educational and informational
materials at community events, inserts in utility bills, and information in the Town's monthly
newsletter. The Town will also post educational and informational material on its website and
social media outlets.
The goals and objectives of the Town are to distribute educational materials to the community or
conduct equivalent outreach activities addressing impacts of storm water discharges on water
bodies and the steps the public can take to reduce pollutants in storm water runoff.
The target pollutants and/or stressors are:
Excess nutrients — Excess nutrients can lead to nigh algal growth in downstream waterbodies
causing low oxygen levels.
Sediment — Sediment can adversely impact waterways and aquatic environments. Due to recent
drought cycles, maintaining vegetative cover has been an issue. For new construction, erosion
control is necessary to keep sediment on site.
Litter/Yard Waste — Litter and yard waste can block stormwater conveyances. As litter and yard
waste decompose it introduces chemicals and additional nutrients into the storm system.
General Household and Landscape Chemicals — this includes fertilizers, pesticides, automotive
chemicals, and detergents and can cause significant impacts to aquatic environments.
Target Audience
Two primary target audiences have been identified, local citizens and business owners. Local
citizens include single-family residences, churches, schools, and other civic groups. Business
owners, especially restaurants and developments with high impervious surfaces will be targeted.
Measurable Goals
Develop and distribute educational materials through educational programs, community
events and utility bills inserts.
Provide stormwater information in the Town's monthly newsletter which is distributed to
every utility customer.
The Town of Benson is a member of the Clean Water Education Partnership (CWEP).
CWEP leverages resources from multiple local governments to conduct educational and
outreach programs geared towards reducing stormwater runoff pollution. Programs
include mass media campaigns such as television, radio, internet, and printed materials.

Evaluation
The Town's Public Education and Outreach program will be evaluated by assessing progress
towards each measurable goal listed above. Information and date towards completion of each
measurable goal will be tracked. Progress will be reported in the annual reports to the state.
7.2 Public Involvement and Participation
The Town's stormwater public involvement and participation program includes maintaining an
informational website with contact information and participation in local events and festivals, NC
Big Sweep, and input from the Town board.

• The Town will conduct one public meeting to allow local citizens to review and provide
input on the stormwater management plan.
• The Town shall provide stormwater content and information for the Town's website and
social media page. The Town shall publish a "Stormwater Hotline" for Johnston County
for citizens to report concerns or make requests.
• The Town shall distribute handouts and information on stormwater impacts and answer
citizens questions on stormwater pollution at local events and festivals. [i.e., rain gardens
to local citizens through events, festivals, and information requests.
• The Town shall coordinate its participation in the annual NC Big Sweep.
• The Town shall report annually to the elected board and the planning board on the
stormwater program seeking input on pertinent issues. Stormwater impacts from new
development and redevelopment shall be noted during the annual report.
Evaluation
The Town's Public Involvement and Participation program will be evaluated by assessing
progress towards each measurable goal listed above. Information and data towards completion
of each measurable goal will be tracked. Progress will be reported each year in the annual report.
7.3 Illicit Discharge Detection and Elimination
The objectives of the Town's Illicit Discharge Detection and Elimination Program is to:
a. implement and enforce a program to address the detection and elimination of illicit
discharges into the MS4.
b. Maintain a storm sewer system map, showing the location of all major outfalls and the
names and location of all waters of the state that receive discharges from those outfalls;
c. Prohibit, through ordinance, or other regulatory mechanism, non -storm water discharges
except as allowed in this permit and implement appropriate enforcement procedures and
actions;
d. Implement a plan to detect and address non -storm water discharges, including illegal
dumping, to the MS4;
e. Inform public employees, businesses, and the general public of hazards associated with
illegal discharges and improper disposal of waste; and
f. Address non -storm water discharges or flows (i.e., illicit discharges) if identified as
significant contributors of pollutants to the MS4.

Currently, the Town is developing an illicit discharge detection and Elimination Ordinance. The
Town shall annually review the IDDE ordinance or other regulatory mechanisms, or adopt any
new ordinances or other regulatory mechanisms that provide the permitee with adequate legal
authority to prohibit illicit connections and discharges and enforce the approved IDDE Program.
The Town has developed and shall maintain a current map showing major outfalls and receiving
streams. The Town maintains a Geographic Information System (GIS) database that includes
drainage areas, receiving streams, land use information, zoning, soils, floodplain data, water
duality designations, impervious cover and other pertinent data. This information is updated
periodically often based on actual site reconnaissance, such as on site surface water
identifications.
The Town will develop written procedures for conducting investigations of identified illicit
discharges.
The Town tracks all investigations and document the date(s) the illicit discharge was observed;
the results of the investigation; any follow-up of the investigation; and the date the investigation
was closed.
The Town trains appropriate municipal staff who as part of their normal job responsibilities, may
come into contact with or otherwise observe an illicit discharge or illicit connection to the storm
sewer system,
The Town informs public employees, businesses, and the general public of hazards associated
with illegal discharges and improper disposal of waste. The Town conducts at training sessions
for employees and provides information regarding appropriate training sessions provided by other
entitles.
The Town shall promote, publicize, and facilitate a reporting mechanism for the public and staff to
report illicit discharges and establish and implement citizen request response procedures.
The Town tracks the issuance of notices of violation and enforcement actions as administered by
the permittee.
7.4 Construction -Site Stormwater Runoff Control
Pursuant to 40 CFR 122.35(b) and the maximum extent practicable (MEP) standard, the [Town,
City or Village] relies on the NCDENR Division of Land Resources (DLR) Sediment and Erosion
Control Program to comply with this minimum measure. The NCDENR Division of Land
Resources (DLR) Sediment and Erosion Control Program effectively meets the MEP standard for
Construction Site Runoff Controls by permitting and controlling development activities disturbing
one or more acres of land surface and those activities less than one acre that are part of a larger
common plan of development as authorized under the Sediment Pollution Control Act of 1973
and Chapter 4 of Title 15A of the North Carolina Administrative Code. The NCDENR Division of
Land Resources (DLR) Sediment and Erosion Control Program continues to be monitored by the
EPA to ensure the State effectively meets the MEP standard established by the Sediment
Pollution Control Act of 1973 and Chapter 4 of Title 15A of the North Carolina Administrative
Code.
7.5 Post -Construction Stormwater Management
The objectives of the Town's Post -Construction Stormwater Management Program is to:
a. Implement and enforce a program to address storm water runoff from new development
and redevelopment projectsthat disturb greater than or equal to one acre, including
projects less than one acre that are part of a larger common plan of development or sale,

that discharge into the MS4. The program shall ensure that controls are in place that
would prevent or minimize water quality impacts.
b. Implement strategies which include a combination of structural and/or non-structural best
management practices (BMPs) appropriate for the community;
C. Use an ordinance or other regulatory mechanism to address post -construction runoff
from new development and redevelopment projects; and
d. Adequate long-term operation and maintenance of BMPs.
The Town maintains through an ordinance, or other regulatory mechanism, adequate legal
authorities to meet the objectives of the Post -Construction Site Runoff Controls program. In May
2007, the Town adopted an UDO to require additional stormwater controls. It should be noted that
the Town is currently evaluating its UDO and will be updating post -construction stormwater
requirements. In addition to the specific post -construction stormwater requirements listed above,
the Town employs other policies, practices and regulations that help protect water quality of its
receiving waters. Measures currently in place help to protect natural resources, protect open
space, preserve trees, regulate redevelopment and street design.
The Town, through agreement with Johnston County, has the authority to review designs and
proposals for new development and redevelopment to determine whether adequate stormwater
control measures will be installed, implemented, and maintained.
The Town has the authority to request information such as stormwater plans, inspection reports,
monitoring results, and other information deemed necessary to evaluate compliance with the Post -
Construction Stormwater Management Program.
The Town, or its agents, has the authority to enter private property for the purpose of inspecting at
reasonable times any facilities, equipment, practices, or operations related to stormwater
discharges to determine whether there is compliance the Post -Construction Stormwater
Management Program.
The Town is evaluating the DWQ BMP Design Manual for consideration of adoption. The Town]
utilizes both structural and non-structural BMPs to treat and control post -construction stormwater.
Non-structural BMPs include stream buffers, flood hazard zone protection, landscape
requirements, and educational materials. Structural stormwater BMPs include those listed in the
NCDWQ stormwater BMP manual.
The Town, through agreement with Johnston County, conducts site plan reviews of all new
development and redeveloped sites that disturb greater than or equal to one acre (including sites
that disturb less than one acre that are part of a larger common plan of development or sale). The
site plan review addresses how the project applicant meets the performance standards and how
the project provides for long-term maintenance.
The Town maintains an inventory of projects with post -construction structural stormwater control
measures installed and implemented at new development and redeveloped sites, including both
public and private sector sites located within the Town's jurisdictional area that are covered by its
post -construction ordinance requirements.
The Town provides mechanisms so that development activities maintain the project consistent
with approved plans.
The Town requires an operation and maintenance plan for the long-term operation of the
structural BMPs required by the program.
To ensure that all stormwater control measures meet the Town's performance standards and are
being maintained pursuant to the maintenance agreement, the permittee has a written inspection
program for structural stormwater controls installed pursuant to the Town's post -construction

program. The Town inspect new structural stormwater BMPs at the time the project is complete
to ensure compliance with approved plans. New BMPs are tracked using GPS/GIS technology.
Annual inspection reports are submitted by the owner. Fallow -up inspections are conducted as
warranted and inspection reports are provided to owner outlining follow up actions.
The Town maintains records of inspections, findings and enforcement actions.
The Town makes available through paper or electronic means, ordinances, post -construction
requirements, design standards checklist, and other materials appropriate for developers.
The Town tracks the issuance of notices of violation and enforcement actions as administered by
the permittee.
7.6 Pollution Prevention/Good Housekeeping for Municipal Operations
The Town's pollution prevention/good housekeeping program includes three primary
components:
1. Operation and Maintenance (O&M) of facilities and operations owned and operated by
the Town with the potential for generating polluted stormwater runoff,
2. O&M of municipally -owned streets, roads, and public parking lots within the jurisdictional
area, and
3. O&M of municipally -owned or operated structural stormwater controls.
The Town maintains an inventory of facilities and operations owned and operated by the Town
with the potential for generating polluted stormwater runoff. The following facilities are owned by
the Town and included in the Good Housekeeping plan:

The Town also maintains public road rights -of -way (ROW) in portions of their jurisdiction that are
not owned by NCDOT, including catch basins and conveyance systems.
The Town maintains and implements an O&M program for municipal owned and operated
facilities with the potential for generating polluted stormwater runoff, municipally -owned streets,
roads, and public parking lots and Municipally -owned or operated structural stormwater controls.
The O&M program specifies the frequency of inspections and routine maintenance requirements.

Within non-NCDOT road ROW, the Town maintains and implements an O&M program for
municipally -owned streets, roads, and public parking lots within the jurisdictional area. The Town
maintains and implements an O&M program for municipally -owned or operated structural

The Town conducts appropriate Good Housekeeping training for new employees and provide
"refresher" training to employees as warranted. As staff time and resources allow, expand Good
Housekeeping training to all Town employees, even those not directly involved with Good

JOHNSTON COUNTY
AGREEMENT CONCERNING STORM -WATER MANAGEMENT
This Agreement, dated this day of >> 2 11, by and between the Town of
Benson, a North Carolina Municipal Corporation (hereinafter referred to as "'Town"); and the
County of Johnston (hereinafter referred to as "County"); (hereinafter collectively referred to as
"Parties").
WITNESSETH:
THAT WHEREAS, the Town is a regulated public entity under the National Pollution
Discharge Elimination System (NPDES) having been so designated by the Environmental
Management Commission (EMC) of the North Carolina Department of Environment and Natural
Resources (NCDENR); and
WHEREAS, as a regulated public entity under the NPDES stormwater program, the
Town is required to develop a stormwater management program and apply for a stormwater
permit; and
WHEREAS, the deadline for submitting said permit is on or about August 9, 2011; and
WHEREAS, the "Town wishes to delegate to the County the authority to administer and
enforce the Town's stormwater management in accordance with the provisions contained in the
Town's Phase lI NPDES Permit within the Town's corporate limits as well as its extra -territorial
jurisdiction (ETJ) so that the "Town may satisfy the aforementioned stormwater management
program and permit requirements through the County; and
WHEREAS, the County wishes to accept the delegation of the authority from the Town
to administer and enforce the Town's stormwater management in accordance with the provisions
contained in the Town's Phase II NPDES Permit within the Town's corporate limits as well as its
ETJ and further wishes to aide the Town in satisfying the aforementioned stormwater
management program and permit requirements by and through such delegation; and
WHEREAS; both Parties wish to ensure that new development within the corporate
limits and ET.1 of the Town be subject to a sound stormwater management plan consistent with
the EMC and NCDENR guidelines; and
WHEREAS, the County has the means and ability to administer completely the Town's
stormwater management program and permitting consistent with EMC and NCDENR;
NOW Tl-IERE[=ORE, in consideration of the premises and the mutual promises and
covenants herein contained, and other good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged, the Parties, intending to be legally bound, agree
as follows:
I . The Town hereby delegates to the County the Authority to administer and enforce
the Town's stormwater management in accordance with the provisions contained
in the `fown's Phase I1 NPDES Pennit, as submitted by the Division of Water
Quality of the NCDENR, within the Town's corporate limits and its ET.I.
2. The Town and County Agree that stormwater management plan review fees shall
be submitted by developers directly to the County, and shall be based on the
County's review fee rate at the time of submittal.
3. The term of this agreement shall be perpetual continuing until such time as it is
terminated or the Town implements its own Stormwater Ordinance.
4. This agreement may be terminated with 30 days written notice of'such intent by
either party. Notice shall be served on the "Town Manager of the Town and
County Manager of the County.
5. Each Party hereby submits themselves to the_jurisdiction of the courts of the State
of North Carolina in any future proceeding or action brought by either of them to
enforce the provisions of this agreement.
6. A modification or waiver of any of the provisions of this agreement shall be
effective only if made in a writing and executed with the same fonnality of this
agreement.
7. Every provision of this agreement shall be binding upon each of the Parties and
their respective successors and assigns.
8. This agreement contains the entire understating and agreement of the Parties, and
there are no representations, warranties, covenants or undertakings other than
those expressly contained herein.
9. The requirement for bonding improvements as required in Section 5.3 of the
Johnston County Stormwater Manual shall be mandatory.
10. The County shall ensure compliance with all deadlines imposed on the Town by
EMC and/or NCDENR.
