Subject: Evaluation of the Town of Zebulon's Stormwater Management Program,
Stormwater Permit No. NCS000557
Dear Mr. Ray:
The North Carolina Department of Environment and Natural Resources (NCDENR), Division of
Water Quality (DWQ) conducted an audit of the Town's Stormwater Management Program on February
26, 2013. DWQ was represented by.Bill Diuguid and Mike Randall, from the DWQ Stormwater
Permitting Unit.
The compliance evaluation is conducted to evaluate the Town's compliance with the
requirements of Section 402(p) of the Clean Water Act (CWA), 33 U.S.C. § 1342(p), the regulations
promulgated there under at 40 Code of Federal Regulations Part 122.26, and the North Carolina National
Pollutant Discharge Elimination System (NPDES) Permit No. NCS000557.
The staff was very helpful during the audit and should be commended on the initiatives they've
taken to managing stormwater under the conditions of the Town's permit.
The staff provided a description of the storm sewer system, identified the receiving streams, and
whether or not the receiving streams are impaired and any associated water quality issues. The staff also
provided a description of the Town's Public Education and Outreach Program, Public Involvement and
Participation Program, Illicit Discharge Detection and Elimination'Program, Sediment and Erosion
Control Program, Post -Construction Program, and Pollution Prevention and Good Housekeeping
program.
The Town's Public Education and Outreach Program is based on community wide issues. Staff
provided a description of the target audiences and target pollutants as well as the likely sources of those
pollutants and their impacts. The Town maintains an internet web site designed to convey the program's
message, distributes stormwater educational material to appropriate target groups, and promotes and
maintains a stormwater hotlinelhelpline.

The Public Involvement and Participation Program includes volunteer opportunities and other
mechanisms designed to promote ongoing public involvement.
The Town maintains a current inventory of facilities and operations owned and operated by the
Town (with the potential for generating polluted stormwater runoff). The Town also maintains and
implements a SWPPP for their public works program. The SWPPP includes a site description and site
plan that show drainage areas, stormwater and sanitary piping, manholes, cleanouts, drains, inlets,
outfalls, oil water'separators, and stormwater control devices. The SWPPP identifies industrial activities
and facilities, storage practices, best management practices, secondary containment requirements,
structural BMPs, erosion and sediment controls, procedures for spill response, loading and unloading,
vehicle and equipment maintenance, waste handling and disposal, and employee training requirements.
Positive Findings
Wake County currently administers and enforces the Town's Erosion and Sedimentation- Control
and Stormwater Ordinances. As part of the NPDES Phase 11 Stormwater Permit requirements, Wake
County will be responsible for enforcement of the Illicit Discharge Detection and Elimination program,
the Construction Site Runoff Control Program, and the Post -construction control Program for new
development and redevelopment.
Also, the Town does participate in the Clean Water Education Partnership (CWEP).
From what we were able to observe the streets, parking lots, and stormwater system were in
excellent condition — free of trash and debris, floatables, pollutants, oil and grease.
Finally, the SWPPP provides excellent procedures for activities such as spill response, loading
and unloading, vehicle and equipment maintenance, waste handling, and disposal.
Recommendations
Recommendations represent practices that should be considered to improve the overall
effectiveness to improve stormwater management.

Discrepancies
Discrepancies are findings that would :not likely cause a Notice of Violation, a fine, or other
enforcement action. Discrepancies are normally a result of poor management practices, failure to follow
Standard Operating Procedures, minor differences of interpretation or administration oversights or where
compliance could not be determined at the time of the audit.

other enforcement action if corrective action is not taken. The State did not identify any findings that

In accordance with your application for a stormwater discharge permit received on August 3,
2011, we are forwarding herewith the subject state - NPDES permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum
of Agreement between North Carolina and the US Environmental Protection agency dated May 9,
1994 (or as subsequently amended).
If any parts contained in this permit are unacceptable to you, you have the right to an adjudicatory
hearing upon written request within thirty (30) days following receipt of this letter. This request
must be in the form of a written petition, conforming to Chapter 150E of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer
27447; Raleigh, North Carolina 27611 -7447. Unless such demand is made, this decision shall be
final and binding.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Environmental Management or permits required by the Division of Land
Resources, Coastal Area Management Act or any other State, Federal or Local governmental
permit that may be required.

In compliance with the regulations promulgated and adopted by the North Carolina Environmental
Management Commission, and the Federal Water Pollution Control Act, as amended,

is hereby authorized to discharge stormwater from their municipal separate storm sewer system located:
within the Town of Zebulon's corporate limits and ETJ.
to receiving waters of the State, Beaverdam Creek and unnamed tributaries to Beaverdam Creek, Little
Creek and unnamed tributaries to Little Creek, Moccasin Creek and an unnamed tributary to Moccasin
Creek, and Little River and unnamed tributaries to Little River within the Neuse River Basin in
accordance with the discharge limitations, monitoring requirements, and other conditions set forth in Parts
I, II, 111, IV, V, VI, VII and VIII hereof.
This permit shall become effective December 1, 2012.
This permit and the authorization to discharge shall expire at midnight on November 30, 2017.

Subject: NPDES Phase 11 Stormwater Program
State Designation Process
Town of Zebulon, Wake County
Pursuant to Session Law 2006-246, Section 5, the Environmental Management Commission
(EMC) at its regularly scheduled meeting on January 14, 2010, considered the designation of the
Tbwn of Zebulon as a regulated public entity that owns or operates a municipal separate storm
sewer system (MS4) subject to the National Pollution Discharge Elimination System (NPDES).
Following proper deliberation in accordance with the procedures delineated in Session Law 2006-
246, Section 5, the EMC determined that the Town of Zebulon shall be designated as a regulated
public entity that owns or operates a MS4 subject to the NPDES requirements.
Under the provisions of Session Law 2006-246, Section 5, Designation of Regulated Entities,
the Town of Zebulon was identified as a candidate for potential designation because the town is
located near impaired waters. In October 2009, the Town of Zebulon was notified that it had been
identified for consideration under the state designation procedures. Public notice of potential
designation was given, and comments on potential designation were accepted through November
30, 2009.
After review of the public comment, the EMC determined that the Town of Zebulon met the
required criteria for formal designation under Section 5(1)(d)(4) of the Session Law because the
town's 10-year growth rate met designation criteria. The town's MS4 also discharges stormwater
that adversely impacts water quality in Little Creek.

As a regulated public entity under the NPDES stormwater program, the Town of Zebulon is
required to develop a stormwater management program and apply for a stormwater permit. The
deadline for suhmitting your application for a Phase 11 NPDES permit for stormwater management
is 18 months from the date of receipt of this notification.
