Subject: Request for Waiver
DWQ has reviewed the comments received, the requirements of state laws and
administrative rules, the rights of the municipalities, and our mandate to protect public health and
environmental quality. Based on that review, DWQ is granting the City of Claremont's request to
rescind permit No. NCS000503 and grant a waiver from the requirements otherwise applicable to
municipalities that own or operate a municipal separate storm sewer system (MS4) within an
urbanized area.
Pursuant to Session Law 2006-246, the City of Claremont may subsequently be required
to seek coverage under an NPDES permit if circumstances change.
Although requirements to seek an NPDES Permit to administer the six minimum
measures in 40 CFR 122.34 has been waived for the City of Claremont, any new development
that cumulatively disturbs one acre or more of land located in the City of Claremont, must
comply with the standards set forth for waters classified as Watershed IV Protected. DWQ
believes this, along with existing stormwater programs implemented by the City of Claremont,
are adequate to protect water quality. .

Dear Mr. Randall:
This letter is a formal request to have the City of Claremont's Stormwater Discharge
Permit number NCS000503 rescinded and a waiver granted pursuant to 40 CFR 122.32. The
City of Claremont has a population of 1,086 with the majority of the population served by City
water and sewer lines. The City also serves water to some County residents living outside of the
corporate limits.
The City of Claremont does not drain into water bodies that are, presently, either
impaired or do not meet water quality standards. The City is located entirely in a Water Supply
Watershed IV Protected Area. Due to these water quality regulations already in place, the City
of Claremont does not anticipate that future discharges from the City will have negative impact
on water bodies receiving the area's drainage. There are existing municipal programs (listed
below) in place to ensure the City of Claremont's operation and activities have minimum
contribution to the pollutant loadings of the local reservoirs.
Visits have been made to the streams that receive discharge from the City of Claremont at
their confluence points as well as upstream and downstream of those confluence points. The
streams appeared in good Condition, with no signs of discoloration or impurities.
The City of Claremont will continue to protect its water quality through its Stormwater
management efforts as outlined below:
1. Catawba County currently provides Sedimentation and Erosion Control permitting. For
projects that require a Sedimentation and Erosion Control Permit, the City of Claremont
will not approve plans unless a copy of the erosion control permit approval letter is submitted
with the plans. The City will continue to work with the County to troubleshoot
construction sites and undeveloped land that may have erosion or sedimentation
problems;
2. The City of Claremont will encourage low density development and low impact
development through our Zoning, Subdivision and Watershed Ordinances;
3. City staff has attended and will continue to attend workshops and conferences to insure
"Good Housekeeping" practices are used in the City's facilities and by the workers in the
field;
4. The City will continue to use workshops, newsletters, direct mailings and its website to
provide information to its residents and businesses about minimizing our impact on the
local water supply;
5. City staff will continue to work with the region's Stormwater Working Group to
spearhead public outreach and support opportunities;
b. The City anticipates adopting an Illicit Discharge Ordinance in 2007 or 2008 to give staff
legal authority to monitor activity within the corporate limits that may result in degrading
water quality,
7. The City of Claremont presently maintains 12.5 miles of street of which the majority are
ribbon type with properly maintained ditch lines;
8. The City participates in the NCDOT semi-annual roadside litter sweep program and is
active in the leadership of the Catawba County chapter of Keep America Beautiful;
9. The City utilizes NC Department of Corrections inmates to provide labor for roadside
cleanup;
10. The City will continue to monitor its wastewater discharge into the local creeks in
accordance with the current NPDES permit, which will alert staff if there is a change in
sedimentation;
11. The City will continue its proactive approach to water quality by monitoring outfalls,
completing preventative maintenance to the Cities catch basins and storm water sewer
facilities as is standard policy of the Public Works Department.

2000 U.S. Census - Notification of Coverage
Marion Dean McGinnis:
In 1990 the U.S. Environmental Protection Agency's (EPA) Phase I stormwater program was promulgated under the
Clean Water Act. Phase I relies on National Pollutant discharge Elimination System (NPDES) permit coverage to
address stormwater runoff from: (1) "medium" and "large" municipal separate storm sewer systems (MS4s) generally
serving populations of 100,000 or greater, (2) construction activity disturbing 5 acres of land or greater, and (3) ten
categories of industrial activity. The NPDES Stormwater Phase It Final Rule was promulgated in December 1999 and is
the next step in EPA's effort to preserve, protect, and improve the Nation's water resources from polluted stormwater
runoff. The Phase 11 program expands the Phase 1 program by requiring additional operators of MS4,; in urbanized areas
and operators of small construction sites, through the use of NPDES permits, to implement programs and practices to
control stormwater runoff. Phase 11 is intended to further reduce adverse impacts to water quality and aquatic habitat by
instituting the use of controls on the unregulated sources of storm water discharges that have the greatest likelihood of
causing continued environmental degradation.
The NPDES Stormwater Phase Il Final Rule requires nationwide coverage of all operators of small MS4s that are
located within the boundaries of a Bureau of the Census defined "urbanized area" based on the latest decennial Census.
The Bureau of Census has recently released data detailing the 2000 Census urbanized areas and using GIS data files
produced by the Bureau of Census, North Carolina Department of Environment and Natural Resources staff has
compiled a list of municipalities and counties that we believe fall in whole or in part within one or more of the seventeen
census -designated urbanized areas in North Carolina.
We are writing to you to notify you that the City of Claremont has been identified as being located within a census
designated urbanized area. As a regulated community, you are required to develop a stormwater management program
and apply for stormwater permit coverage, if you own and operate a small MS4 or file a certification that the City of
Claremont does not own or operate a small MS4. The deadline for suhmilting your application package or
non -ownership certification is 18 months from the date of this letter. Application and certification documents, as well as
additional information on the NPDES stormwater program, are available for download at our web site . Our web address
