Dear Mr. Maynard:
The Division of Water Resources (Division) has reviewed the submitted variance request received on
February 15, 2019 for the subject project, with additional information received June 23, 2019 and
July 24, 2019. The Division will grant the variance requests for the installation of gravity sewer as well as
manholes being located near wetland area in accordance with the provisions for alternative design under
15A NCAC 02T.0105(n):
1. Pursuant to the variance request received February 15,2019 with additional information received
June 23, 2019 and July 24, 2019,from James H. Fentress,Jr., P.E. on behalf of the Windsor Place
Apartments, LLC, a variance is granted for the construction and operation of approximately 65
linear feet of 8-inch gravity sewer located within wetlands,as indicated on the provided plans and
supplementary documentation.
2. An alternative design is also approved for the construction of manholes MH-3 and MH-4, located
immediately beside the wetlands areas as shown on the provided plans, and subject to the
following requirements:
a. Manholes shall be provided with a watertight frame and cover with gasket.
b. Watertight pipe connections shall be provided consisting of a flexible watertight rubber
boot or compression type connector.
c. Structures shall be tested in accordance with ASTM C1244.
d. All structures not included as part of a USACOE 404 Permit or Division 401 Certification
shall maintain a separation of no less than 10 feet from wetlands.
Regardless of the variance approval, in the event that the wastewater collection facilities fail to perform
satisfactorily, including the creation of nuisance conditions,the Permittee shall take immediate corrective
action, including those as may be required by this Division, such as the construction of additional or
replacement facilities.

All other elements of this project shall be constructed in accordance with all applicable rules and statues
including, 15A NCAC 2T; the Division of Water Resources', (Division) Gravity Sewer Minimum Design
Criteria adopted February 12, 1996 as applicable;and the Division's Minimum Design Criteria for the Fast-
Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable. Approval of the
variance request does not constitute approval of the permit.
