Coleman, Jr. - I 2Dai Town Manager Town of Cary , PO Box 8005 Cary, NC 27512-8005 SUBJECT: Inspection-NPDES Stormwater Compliance Permit No. NCS000427 Dear Mr. Flynn: This document provides a summary of the compliance inspection conducted by the Division of Water Quality on May 9, 2007, The Town of Cary has done an effective job managing stormwater under the conditions of their permit. All of the six minimum measures had innovative and effective measures that exceeded the permit requirements including the Block Leader program, bi-annual surveys, detailed maps for tracking illicit discharge detection and elimination program, ongoing dry weather stream walks and a very aggressive and effective construction program. The Town recently completed a survey of municipal operations and in the process of completing a comprehensive evaluation of municipal operations, and although no deficiencies were observed the Town has taken the initiative to upgrading stormwater pollution prevention measures. During the inspection staff indicated that city buses are fueled at the Fleet Maintenance facility. Coverage under the general permit, NCG08,'is applicable to all owners or operators of stormwater point source discharges associated with activities that have vehicle maintenance areas, including fueling, associated with activities classified Local and Suburban Transit and Interurban Highway Passenger Transportation, The Town has submitted a Notice of Intent for coverage under NCG08 for the fleet maintenance facility. At the time of the inspection, the state had not issued a certificate of coverage. However, the Town has taken the initiative to develop and implement the permit requirements. Currently, the Town is implementing components of a SWPPP for the facility under our Phase II permit issued in July 2005, The Town of Cary has also taken the initiative to report all SSO's reaching stormdrains or surface waters to the town's stormwater section. The town took the initiative to developed a process to ensure copies of spills and resolution, follow up reports and SSO prevention and pre-treatment education and enforcement documentation are available to regulatory officials for review. SSO's are being mapped on GIS and tracked for areas with recurring issues that need further investigation and follow up. Under the initiative of the Town denuded areas, erosion control for the site, and stabilization of the site will be documented. The town's staff were very helpful during the inspection and should be commended on the initiatives they've taken to managing stormwater under the conditions of their permit. Sullins, Deputy Director Division of Water Quality November-8;'2004 7 NOV - g 2001 4a7 Subject: NPDES Permit Number NCS000t4-7` Town of Cary On July 12, 2004 the North Carolina General Assembly ratified Senate Bill 1210 (S 1210) - Phase II Stormwater Management. The Governor signed the bill on August 2, 2004. This bill addresses implementation of the federal NPDES Phase II stormwater program in North Carolina. In S 1210, the General Assembly provided a framework that will allow state and local government agencies to begin implementing the program. The bill establishes minimum stormwater management requirements for municipal storm sewer systems and also applies stormwater controls to some developing areas around these municipalities. Phase 11 Draft permits for local governments were publicly noticed the week of November 1, 2004 for those communities identified in the 1990 U.S. Census. Your community's permit has been noticed and copies of the draft permit are available at: http://h2o.enr.state.nc.us/su/phase2_draft_permits.htm We look forward to receiving your comments on this draft permit and continuing to work together for the benefit of your community and North Carolina. In addition to the extensive BMPs for Public involvement and Participation already identifies[ in your Stromwater Management Plan, Town of Cary should conduct a least one public meeting to allow the public an opportunity to review and comment on the stormwater management program. Also, the fact sheets on illicit connections and spill management developed to inform businesses, commercial property managers, restaurant owner/operators, and automotive businesses should be provided to the general public as well. Please revise Section 7 of the Town of Cary's Stoomwater Management Program Report with the additional information requested and send a copy of the updated section to my attention so that I may update the copy of the Program Report that the Division has reviewed. Please provide the requested information by Friday, June 18, 2004.
