PROJECT SUMMARY: Replacement of an existing 100'x 8' dock with a 100'x 8' dock parallel to the shore and a 50'x 10' pier extending into Harbor Village Creek. Three 10'x 2' finger piers and 12 mooring pilings will be installed with the dock and pier for a total of six boats slips. The slips will allow boats up to 50' in length. Barry Austin III Bio Report Page 2 SITE DESCRIPTION The applicant's property is located along Harbor Village Creek approximately 560' northeast of Hatteras inlet. The property is developed and contains three dwellings with associated septic systems, a fish house with a dock, and some separate fuel dock dispensers. Landward of the fuel dock is a fuel storage area with retaining walls to prevent spillage into the creek. The existing docks and fuel dispensers are over the water and adjacent to a federally maintained channel. Vegetation on the applicants property is minimal and consists of domestic grasses and ornamental trees and shrubs. The property is approximately 1.27 acres in size with 194.31 linear feet along Harbor Village Creek. The property is in a flood zone AE with a base flood elevation of 6'. Avon fish house is situated along the southwest corner of the property and extends over the water. In 1994 the fish house/ net house was destroyed by Hurricane Emily, and minor permit #94-001 was issued to rebuild the structure. In 1996 a two-story addition was built on the northeast side of the fish house without a CAMA Permit. The un permitted work appears to be inconsistent with the 30% impervious lot cover requirements established in the NC Administrative Code. A Notice of Violation with a restoration plan has been issued to the applicant. The restoration plan requires that lot coverage be reduced to the maximum allowed or that an engineered stormwater runoff plan be submitted and implemented. From the northeast corner of the property and extending approximately 15' waterward of the normal water line is an existing dock that runs parallel with the shoreline. The dock is approximately 100'x 8' and is in poor condition. Currently three fuel dispensers are on the dock and it appears that there have been up to six dispensers at one time. The depth of the water along the waterward side of the dock is between 7.5' and 8' below the normal water line. Harbor Village Creek is classified as SA water and is closed to shellfishing. The creek is approximately 230' wide at the applicant's property and there is a federally maintained channel adjacent to the property. Located northeast of the fish house is a small dwelling positioned parallel to the shore. The dwelling is approximately nine feet from an existing bulkhead. On the waterward side of the bulkhead there is a three-foot wide strip of riprap along the shore. PROJECT DESCRIPTION The applicant would like to reconstruct and reconfigure an existing dock located along Harbor Village Creek in Hatteras Village. The new dock will conform to the size of the existing dock, but will be closer to the shore and will have three 10'x 2' finger piers to allow for the mooring of up to six boats 50' in length. On the southwest end of the dock will be a 50'x 10' pier running perpendicular to the shore, extending into the creek. Twelve mooring pilings will be set in conjunction with the dock and pier to tie offiboats. Fred B. Austin III Bio Report Page 3 The southwest end of the dock will abut an existing dock at the fish house also located on the property. The landward corner of the new dock, where the two will abut, is approximately 3.5' waterward of the normal waterline and 7.5' waterward of an existing bulkhead. According to the plans submitted the applicant proposes to set three new fuel dispensers at the waterward end of the pier to replace the existing dispensers on the existing dock. The proposed structure will result in the shading of 1,360 square feet of water, 560 square feet more that the existing dock shades. No submerged aquatic vegetation was found in the area where the applicant proposes to place the new dock and pier. Harbor Village Creek is approximately 230' wide at the applicant's property and the existing federally maintained channel is 150' wide. The waterward end of the proposed pier will extend approximately 61.5' waterward of the normal water line. The enclosed plat of Rollinson Channel, provided by the Army Corps of Engineers in Wilmington, indicates that the proposed dock may extend into the channel, but the date and scale of the plat make it impossible to precisely determine the location of the channel. The dredge depth of the channel is between 10' and 12' below mean low water and the depth measured at the waterward end of the proposed dock is 12' below the normal water line. ANTICIPATED IMPACTS 11 The proposed pier may extend into a federally maintained channel. 21 The construction of the proposed dock will result in the shading of 1,360 square feet of the creek. 31 The docking facility will provide moorings for six large boats up to 50' in length and may result in an increase in the amount of fuel oil and debris in the adjacent water. 41 The increase in the number of boats will increase the traffic in and out of the applicant's property. 51 No emergent or submergent wetlands will be disturbed. 61 Temporary localized turbidity will occur during construction of the dock and pier. 7] No archeological sites, remnant species or geological formations are known to be associated with the property in question. 81 No submerged aquatic vegetation was found in the project area.
