Enclosed please find an application for Division of Environmental Management (OEM) 401 Water
Quality Celtification for wetlands impacts associated with development of the subject parcel.
Environmental Professionals, Inc. (EPI) is representing the propelty owner, Mr. Mickey Hayes, and shall
correspond on his behalf EPI has attached U.S. Anny Corps of Engineers (Corps) correspondence
addressing fill of the subject parcel under Nationwide Pennit # 26, a pennit application, seven copies of a
plat showing isolated wetlands that have been tilled upon the subject parcel, and a site location map.

The 23 acre parcel is located on Duck Woods Road, east of Duck Woods Golf Course, west ofan
unnamed canal, and nOlth of Southern Shores Block 227-A (see attached location map and Plat). The
wetlands upon the site were reviewcd by Mr. Ilayes private consultant in 1990, and verified by the Corps
to be isolated in correspondence fi'olll Mr. G. Wayne Wright, December 6, 1990 (CESAW-CO-91-D-028-
Southem Shores). In accordance with Nationwide Pennit # 26, up to one acre ofisoJated wetlands could
be impacted upon the parcel. The wetland alignment was reverified in 1994 (letter to Mr. Hayes fi'om Mr.
Wright, dated April 20, 1996 Action 1. D, 199401675) for a period not to exceed three years from the date
of correspondence.

Acting in response to the Corps detennination, Mr. Hayes filled 32,782 square feet of isolated wetlands
upon the subject parcel during late spring of 1996. Mr. Art Copolla of the Corps has reviewed the subject
development and has stated that the impact has been perfonned in accordance with Nationwide Permit
requirements.

We have prepared the attached application package for your review and subsequent guidance. We
appreciate your response to this penllitting issue so that we may satisfy OEM 40 I Water Quality
Certification requirements. Please contact me or Mr. George Wood if additional infonnation is needed.

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Hayes:

You have our approval to place fill material in 0.75 acres of wetlands or waters for the purpose of
constructing a residential development at Duck Woods Road, as you described in your application dated 29
AugustJ996. After reviewing your application, we have decided that this ftll is covered by General Water
Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26
when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in the attached certification
and any additional conditions listed below. Mr. William Moore of our Washington Regional Office shall be
contacted to determine whether coastal stormwater roles apply to this project. In addition, you should get any
other federal, state or local permits before you go ahead with your project including (but not limited to)
Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are fmal and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Enclosed please find an application for Division of Environmental Management (OEM) 401 Water
Quality Certification for wetlands impacts associated with development of the subject parcel.
Environmental Professionals, Inc. (EPI) is representing the propeJ1y owner, Mr. Mickey Hayes, and shall
cOll'espond on his behalf. EPr has attached U.S. Anny Corps of Engineers (Corps) correspondence
addressing fill of the subject parcel under Nationwide Penn it # 26, a pennit application, seven copies of a
plat showing isolated wetlands that have been filled upon the subject parcel, and a site location map.

The 23 acre parcel is located on Duck Woods Road, east of Duck Woods Golf Course, west ofan
unnamed canal, and nOl1h of South em Shores Block 227-A (see attached location map and Plat). The
wetlands upon the site were reviewed by Mr. (Iayes private consuItwlt in 1990, and verified by the Corps
to be isolated in cOITespondence from Mr. G, Wayne Wright, December 6, 1990 (CESA W-CO-91-D-028-
Southem Shores). In accordance with Nationwide Pennit # 26, up to one acrc of isolated wetlands could
be impacted upon the parcel. The wetland alignment was reverified in 1994 (letter to Mr. Hayes fi'om Mr.
Wright, dated April 20, 1996 Action to. 199401675) for a pcriod not to exceed three years from the date
of correspondence,

Acting in response to the Corps detennination, Mr. Hayes filled 32,782 squw'e feet of isolated wetlands
upon the subject parcel during late spring of 1996, Mr. Art Copolla of the Corps has reviewed the subject
development and has stated that the impact has been perfonned in accordance with Nationwide Pennit
requirements.

We have prepared the attached application package for your review and subsequent guidance. We
appreciate your rcsponse to this pCllnitting issue so that we may satisfy OEM 401 Water Quality
Certification requirements. Please contact mc or Mr. Georgc Wood if additional infonnation is needed.

The 23 acre parcel is located on Duck Woods Road, east of Duck Woods Golf Course, west ofan
unnamed canal, and nOlth of Southern Shores Block 227-A (see attached location map and Plat). The
wetlands upon the site were reviewed by Mr. Hayes private consultant in 1990, and verified by the Corps
to be isolated in cOlTespondence f1'om Mr. G. Wayne Wright, December 6, 1990 (CESA W-CO-91-D-028-
Southern Shores). In accordance with Nationwide Pcnnit # 26, up to one acrc ofisoJated wetlands could
be impacted upon the parcel. Thc wctland alignment was reverified in 1994 (letter to Mr. Hayes fi'om Mr.
Wright, dated April 20, 1996 Action 1.0, 199401675) for a period not to excecd three years from the date
of con'espondence.

Acting in response to the Corps detennination, Mr. Hayes filled 32,782 square feet of isolated wetlands
upon the subject parcel during late spring of 1996, Mr. Art Copolla of the Corps has reviewed the subject
development and has stated that the impact has been perfonned in accordance with Nationwide Penn it
requirements.

We have prepared the attached application package for your review and subsequent guidance. We
appreciate your response to this pennitting issue so that we may satisty OEM 40 I Water Quality
