Dear Sirs:
You have our approval to construct a town home development and boat dock in 2,338 square feet waters
at 716-720 East Front St., New Bern, NC, as you described in your application dated 26 July 1996. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Number 3025.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in the attached certification
and any additional conditions listed below. Additional approval of the stonnwater management plan by the
Division of Water Quality is required. In addition, you should get any other federal, state or local pennits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stonnwater, Non-Discharge and Water Supply Watershed regulations.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which confonns to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

8. PROJECT SUMMARY: The applicant is proposing to demolish two buildings and construct a 13
unit townhouse development with a ten slip boat dock in the Neuse River.

9. NARRATIVE DESCRIPTION: The applicants property consists of a :t 34,000 ft.2
lot located at the intersection of East Front Street and Queens Street and adjacent to the
Neuse River in the City of New Bern, Craven County. Two, one story buildings are
located on the property with one being used as a cabinet shop while the other is
primarily used for storage. Asphalt parking areas are located to the north and west of
the buildings and two old railroad spurs terminate on the property. The applicant has
calculated an impervious surface coverage of :t 2,200 ft. 2 of area within the Estuarine
Shoreline Area of Environmental Concern. The shoreline area immediately adjacent to
the Neuse River consists of a :l:: 5' to 25' wide wetland area vegetated with scirpus,
phragmites, hibiscus, taxodium distichum, etc. Also along the shoreline are various
amounts of rip rap material which have been placed in the water over the years.
Immediately offshore of the property a large number of deteriorated pilings exist which
are apparently the remains of a large wharf area. Water depths within the wharf area
range from -1.5' to -8' normal water level (NWL) deep. A federally authorized
channel is also located just offshore of this property. The waters of the Neuse River at
this location are classified as SC Nutrient Sensitive Waters and are closed to the
harvesting of shellfish. The project appears to be located just within the City of New
Bern's Historic District.
The applicant is proposing to demolish the existing buildings and build a 13 unit
townhouse project in their place. Two buildings are proposed with one having 6 units
and the other 7. The typical footprint for each unit will be :l:: 20' wide x 40' long with
the roof peak of each unit being :t 42' above the existing ground elevation. Parking
will be provided underneath each unit. Between the buildings the applicant is
proposing to use pavers stone for vehicle support and a :l:: 90' long x 25' wide storm
water retention pond is proposed to be located waterward of the buildings and parking
areas. Overflow from the pond would be handled by a grassed swale system with the
stormwater overflowing into adjacent wetland areas. The applicant is also proposing to
construct a :l:: 180' bulkhead/retaining wall between the upland and wetland areas and
some minor grading will occur on the landward side of the bulkhead. The applicant is
proposing to remove the deteriorated wharf pilings and construct a :l:: 305' long x 6'
wide pier into the Neuse River. Six finger piers and associated tie up pilings would
provide permanent mooring spaces for 10 boats in water depths up to -10' NWL deep.
Waterward of the pier, the applicant is proposing to construct a :l:: 31' long x 16' wide
gazebo.
10. ANTICIPATED IMPACTS: The project as proposed will result in the demolition of
two buildings and associated parking areas and the redevelopment of the site with 13
townhouses. The units would be contained in two buildings with parking and drives
being provided underneath and adjacent to the structures. The applicant has calculated
that :t 20,550 ft.2 of the lot will be covered with impervious areas with a :t 24%
impervious coverage within the Estuarine Shoreline AEC. A stormwater infiltration
and detention facility are also proposed but has not received Division of Environmental
..
Management approval at this time. The proposed bulkhead is to be located landward
of state and federal jurisdictional wetlands but a written concurrence of the wetland
delineation by the US Corps of Engineers (COE) has not been provided at this time.
The proposed pier will be :!: 320' in total length and will be the longest pier in the
area. The applicant has indicated his desire to go out so far is in order to provide a
sales market for owners of deep draft vessels. By being in such deep water, the boats
would be able to safely moor during all tidal conditions. A federally authorized
channel is also in close proximately to proposed pier and the COE will need to assess
the projects impacts to the navigation and future maintenance of the channel. It is
anticipated that the old wharf pilings will be pumped up which, in addition to the
driving of new pilings, will increase turbidly levels in the area. These elevated levels
should be short term in duration and cease once the piling removal/installation is
completed. The project appears to be located within the boundary of the City of New
Bern's Historic District and therefore must be designed to be compatible with the
District. The applicant has not provided any information in the application package
which would address compliance with the local requirements of that District.

SUBJECT: Jurisdictional Wetland Delineation of the East Front Street Parcel,
New Bern, Craven County, North Carolina
(ECO Project No. 96-10)
Dear Mr. Jarvis:
In response to your recent request, ECO, Inc. staff completed a field delineation of the u.s.
Army Corps of Engineers (USACOE) wetlands on the above-referenced project site on June
12, 1996. One jurisdictional wetland area was identified along the Neuse River shoreline.
ECO, Inc. conducted the wetland delineation in accordance with the methodology established
in the 1987 U.S. Army Corps of Engineers (USACOE) Wetland Delineation Manual. A total
of 6 consecutively numbered flags were hung along the wetland boundary. An exhibit
showing the approximate wetland boundaries is also enclosed.
Routine Wetland Delineation Data Sheets were completed for the wetland community as
required by the USACOE. Copies of the data sheets are enclosed for your files and submittal
to the USACOE. Should you require any further assistance with USACOE consultation on
this project, please let us know. If possible, we would like to hear from you after the
USACOE makes a determination on the subject site.

Dear Mr. Dorney:
Enclosed is the application of Queens Point Developments for Department
of the Army (DA) authorization and a State Water Quality Certification to
demolish two existing buildings, and construct a 13 unit townhouse, a
bulkhead, and a ten slip boat dock, on property located off East Front Street,
adjacent the Neuse River, in the City of New Bern, Craven County, North
Carolina. Your receipt of this letter verifies your acceptance of a valid
request for certification in accordance with Section 325.2(b) (ii) of our
administrative regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of the
same law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by September 23, 1996, the District Engineer will deem that
waiver has occurred.
