Box 69 Currituck, NC 27929 Dear Mr. Doxey: You have our approval to place fill material in 1,500 square feet of wetlands or waters for the purpose of constructing a rip rap structure at the Whalehead Club in Corolla, as you described in your application dated 18 October 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3025. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of WaLer Quality under Section 401 of the Clean Water Act. This should allow the permit to be taken off hold status so we can get the permit for the riprap (concrete breakwater) as soon as possible. With the requirements ofa S.E.P.A. document needed for the dredging, we feel that process would take too long and the riprap is most important at this time. Schecter, Director MEMORANDUM: TO: John Parker, Jr. FROM: Lynn Mathis WJ!L SUBJECT: CAMA Major Permit Application For Currituck County DATE: September 20, 1996 According to Mr. Doxey's letter (Enclosed), dated September 20, 1996, Currituck County wishes to withdraw their request to dredge a channel to the Whalehead boat basin and boat ramp. The CAMA Major Permit request will only include shoreline stabilization and the fIlling of 1,500 square feet of coastal wetlands. The riprap request appears to be consistent with Specific Use Standard om .0208(7) Bulkheads and Shoreline Stabilization and there is strong evidence of erosion along the shoreline. The system being proposed will afford protection to the wetland fringe while allowing continued growth. The second part of the request includes filling approximately 1,500 square feet of coastal wetlands between the pond and the Currituck Sound, along the south side of the property. Over the years wetland species have established between existing riprap material and in an low strip adjacent to the shore. The County's representative Mike Doxey, indicated the reasons behind the filling is for esthetics and to reduce the possibility of the wetland harboring snakes. The applicant has not given sufficient reason the fill the coastal wetland fringe and is not necessary for the full development of the property. I would like to recommend that the project be approved with the following conditions: 1. The riprap will not extend waterward more than 16' feet from the mean high water level along the northern side of the old landing strip. 2. The alignment of the proposed riprap must be staked by a representative of the Division of Coastal Management (DCM) within a maximum of thirty (30) days prior to the start of construction. Failure to initiate construction within thirty (30) days, or erosion of the shoreline by adverse weather conditions, will require the alignment to be re-staked by DCM within a maximum of thirty (30) days prior to the new expected start of construction. 1367 U.S. 17 South. The riprap material must be free from loose dirt or any other pollutant. It must be of a size sufficient to prevent its movement from the site by wave or 4. The riprap material must consist of clean rock or masonry materials such as, but not limited to, granite or broken concrete. Materials such as tires, car bodies, scrap metal, paper products, tree limbs, wood debris, organic material or similar material, are not considered riprap. 5. Box 39 Currituck, NC 27929 Dear Mr. Doxey: This letter is in reference to the application which you submitted on behalf of Currituck County for new channel excavation at the Whalehead Club. You are, perhaps, in receipt of an acknowledgement letter from the Division's Elizabeth City office dated July 18. Such letter indicates that processing has begun. It provides a completion time frame and a statement about a possible need for additional information. Subsequent the processing status indicated in the above-mentioned letter, staff again carefully considered the various aspects of the proposal and has determined the application (RE: Sec. 5 of the application) by law, is incomplete in that an Environmental Assessment or Statement of Compliance with same under the N. C. Environmental Policy Act (N.C.G.S. 113A- 1 to 10) was not made a part of the application. Under this Act, or SEP A, to which it is frequently referred, an EA is required if three of four "keys" are triggered. These are: 1) use of public funds and/or 2) use of public lands, and 3) that a permit is required and, 4) there is the potential for an environmental impact. It would appear that all four keys are triggered by the. subject proposal. Because of aforementioned findings, it is necessary that processing of the application for Currituck County be placed in abeyance until there is compliance with the SEP A. County of Currituck Bio Report Page 2 Project Settin~ The project setting is at the Historic Whalehead Club on Currituck County's Outer Banks. The property is located between Currituck Sound and NC 12, just south of the Currituck Lighthouse and adjacent to Whalehead Bay. The property consists of 16.55 acres and has a variety of structures including the main house, a boathouse with docking facilities for 36 boats, a swimming pool and associated cabana, a sound side walk with gazebo, and a foot bridge that crosses a short canal entrance to a boat basin. Also located on the property, between the sound and the clubhouse, is a 1.4 acre pond that with an average depth of four feet. Approximately 10,250 square feet of the pond lies within CAMA's Area of Environmental Concern. Vegetation growing along the edge of the pond includes, but is not limited to Black Need1erush (Juncus roemerianus), Olney's Three Square (Scirpus americanus), Salt Meadow Cordgrass (Spartina patens), and Sea Ox-eye(Borrlchiafrutescens). Vegetation found in upland areas of the property include a variety of lawn grasses, Loblolly Pine (Pinus taeda), Wax-myrtle (Myrica cerifera), and Live Oak (Quercus virginiana). The waters in the area of the proposed project have a history of containing high levels of submerged aquatic vegetation (SA V) including Eurasian Watermilfoil (Myriophyllum spicatum) and Eelgrass (Zostera marina). The access canal leading into the basin is approximately 34' wide with an average depth of 3' - 3". The foot bridge crossing the canal has a 14' wide open area to allow boats to enter the boat basin. Depths in the boat basin range from 3'- 0" to 4'- 6". There are no visible channels leading to the property near the proposed alignment. Review of aerial photography indicates that around 1984 a channel existed adjacent to the shoreline and ran south of the canal entrance out towards the point along the remnant bulkhead (See Staff Workplat). The shoreline around the property is irregular and shows signs of severe erosion in some places. Two sections along the point contain coastal wetlands. A 165' x 10' wetland fringe is located along the northwest side of the point and extends from the shore to a remnant bulkhead, and along the southeast side there is a 1l0'x 2' fringe. Project Description There are three phases of work to be accomplished under the proposed project: The fIrst phase of the project includes hydraulically dredging a 2,250' x 55'x 6' channel from an existing boat basin to a connecting depth of 6' in the Currituck Sound. The 2,250 channel will start at the mouth of the access canal entering the boat basin where the depth is significantly shallower that the adjacent canal. The project does not include any dredging activity inside the ,. County of Currituck Bio Report Page 3 canal or the boat basin. The depth of the canal is an average of 3' - 0" while the depth in the basin ranges from 3'- 0" to 4'- 6". A second channel, 275'x 55' x 6' will be hydraulically dredged from an existing boat ramp to the main channel. The shorter channel will lead directly to the boat ramp and will not include any dredging around the existing boat slips adjacent to the boat ramp. Depths around the boat slips ranges from l' - 0" to 2'- 0". The average depth of the main channel is currently 4' and will result in 8,166 cubic yards of spoil material. The smaller channel has an average depth of 2'- 0" and will result in approximately 1,622 cubic yards of spoil material. Spoil material from the project will be pumped into a pond located to the rear of the old Whalehead Clubhouse. The pond is 1.4 acres (60,984 square feet) and has an average depth of 4'- 0". A 3'- 0" high berm will be placed around the perimeter of the pond and will have a holding capacity of approximately 11,293 cubic yards (See Enclosed Plan Page 2 of 3). The second phase of the project will include the placement of riprap breakwater system along 1,138' of estuarine shoreline. While the application indicates that the length of the shoreline to be stabilized is 1,138', field measurements indicate that 1,175 of shoreline will be involved. Approximately 356' of the shoreline has a coastal wetland fringe that the applicant proposes to riprap on the waterward side. Wetland vegetation found along the shore includes Olney's Three Square (Scirpus americanus), Cattail (Typha sp.) and Salt Meadow Cordgrass (Spartina patens). The riprap will extend between 8' to 16' waterward of mean high water along areas with coastal wetlands. The remaining shoreline has a severe erosion scarp with no coastal vegetation associated. Riprap along the erosion scarp will extend approximately 3' waterward of mean high water. The total area of shallow water, below Mean High Water, that will be filled by the placement of riprap is approximately 4,593 square feet. The fmal phase of the project will include the filling of approximately 1,500 square feet of coastal wetlands that has emerged in and around an existing section of riprap immediately adjacent to the pond as shown on the plan noted as "Page 3 of 3". While the total area involved is approximately 150' x 10' riprap material is in and around the vegetation, reducing the actual area of coastal wetland that will be affected. Anticipated Impacts 1) The first phase of the project will result in approximately 138,875 square feet of shallow water bottom will be disturbed by hydraulic dredging and increase turbidity in surrounding water. The 1.4 acre pond located adjacent to the sound will be filled by the resulting spoil material and result in the filling of approximately 1,180 square foot fringe ~ County of Currituck Bio Report Page 4 of wetland vegetation located around the perimeter of the pond. Submerged aquatic vegetation is evident in the project area and it is anticipated that it will be impacted. In previous years heavy mats of vegetation have established along the mouth of the basin canal and in the sound. 2) According to the application the placement of riprap along the estuarine shoreline will impact approximately 5,481 square feet of shallow water bottom and result in short term turbidity of surrounding water. 3) The fmal phase of the project will result in the filling of an area of coastal wetlands not to exceed 1,500 square feet. 4) While(~~"cheological sites are known to associated with this prope~~hell midden is presenGJ:g the erosion scarp on the east end of the point. The property is a historical site that is currently being offered to the State of North Carolina by Currituck County. 5) There are no unique remnant species or geological formations known to be associated with this site. 6) The Whalehead Club is listed on the National Historic Register.
