Dear Mr. Teal:
You have our approval to dredge a stream channel and affect 1.17 acres of wetlands or waters for
the purpose of dredging Locks Creek between L.A. Dunham Road and Cedar Creek Road, as you
described in your application dated 12 December 1995. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 2671. This certification
allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. In addition, you
should get any other federal, state or local permits before you go ahead with your proiect.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Dear Mr. Teal:
Please reference your application of December 12, 1995, for Department of
the Army (DA) authorization to excavate material from 1.17 acres of waters and
wetlands associated with an unnamed tributary above the headwaters point of
Locks Creek. The work location lies along the run of the creek between L.A.
Dunham Road and Cedar Creek Road (NC Highway 53/210), in Fayetteville,
Cumberland County, North Carolina. The stated purpose of the work is to
maintain drainage and control flooding in the surrounding
residential/commercial property.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 404 of the Clean Water Act, was provided by Nationwide
Permit No. 26 for discharges of dredged or fill material into headwaters and
isolated waters.
The following shall be included as special conditions of this
authorization:
Excavated material shall be removed from wetlands within 15 days of
excavation. Excavated material shall be permanently disposed of in an upland
disposal area. A suitable vegetative cover shall be established on exposed
creek banks within 30 days of excavation. Tree cutting shall be avoided and
minimized to the greatest extent possible.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions and any
required State authorization. A Section 401 water quality certification is
required from the North Carolina Division of Environmental Management.

This nationwide permit does not relieve you of the responsibility to obtain
other required State or local approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked, which will occur prior to January 21, 1997. It is
incumbent upon you to remain informed of changes to the nationwide permits,
which will be announced by public notice when they occur. If you commence, or
are under contract to commence, this activity before the date the nationwide
permit is modified or revoked, you will have twelve months from the date of
the modification or revocation, to complete the activity under the present
terms and conditions of this nationwide permit.

SUBJECT: City of Fayetteville request for 401 Water Quality
Certification to excavate 1.17 acres of stream
bottom in Lock's Creek, within the Fayetteville
city limits, Cumberland County, North Carolina.

The Wildlife Resources Commission has reviewed the
subject request for Water Quality Certification. A site
visit was made on January 19, 1996. Our comments are
provided in accordance with provisions of the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et. seq.).
The applicant proposes to remove bottom sediments, a
beaver dam, and some trees from the channel of Lock's Creek
to alleviate flooding in a Fayetteville neighborhood. It is
unclear to us whether stream banks are to be altered. The
work description says stumps from trees cut close to the
bank will be left to stabilize the bank, but reference is
also made to shaping the banks. Approximately 0.8 mile of
stream would be affected.
We did not locate the beaver dam during our site visit
nor did we notice many trees obstructing stream flow. We
could not access the entire stream reach, however. The
primary obstruction to stream flow we observed was trash
that had accumulated at the upstream end of culverts. The
stream does carry a heavy sediment load. Raw fill material
at a Cedar Creek Road mini-storage facility is encroaching
on the stream channel and contributing sediments.
Additional sediments appear to be entering the creek where
it runs through residential neighborhoods and has no
buffering margin of riparian vegetation. While Lock's Creek
is too small and degraded in the project area to be
considered a significant fishing stream, sections of its
riparian corridor provide habitat for muskrat, raccoon, and
various songbirds. Better wildlife and fishery habitat was
observed near the lower end of the project.
Removal of bottom sediments will subject downstream
aquatic habitats to elevated turbidity, perhaps degrading
water quality to the point where mortality of aquatic
organisms occurs. Shaping the stream banks would exacerbate
this problem and may destabilize the stream channel,
promoting chronic erosion. Excessive tree removal would
reduce the quality of remaining wildlife habitat as well as
the effectiveness of remaining riparian buffers for
capturing sediments. Finally, regarding stream
sedimentation, no attention has been given to identifying
and controlling sediment sources within the watershed.
Removal of sediments from the stream channel will provide
only temporary flood relief if sedimentation rates are not
reduced. A comprehensive approach to erosion control would
seem a prerequisite step toward minimization of flooding in
the project area. Based on these concerns, we recommend the
following conditions to certification.
1. Avoid excavation between April 1 and September 30, a

Dear Mr. Dorney:
The purpose of this letter is to transmit seven copies of the Joint Form for
Nationwide Permit 26 in accordance with instructions contained on the permit
application. (A table of contents listing the joint form and all attachments follows
this letter.)
The permit and attached documentation is somewhat long and detailed. The
following information is provided as a brief executive summary.
1. Prior to 1988, an area known as Lock's Creek was allowed to develop
outside the City limits of Fayetteville.
2. The City annexed the area in 1988 and immediately began receiving
flooding complaints.
3. The extremely wet summer,,of 1995 resulted in prolonged yard and street
flooding.
4. Matt Flint of the US Army Corps of Engineers, Wilmington District, made a
site visit and recommended applying for a Nationwide 26 Permit.

5. Preliminary design has been accomplished on this project and there are
three alternatives:
a. Do nothing. This is not feasible as residents are living in a wet
area and are having insect, rodent, and reptile problems.
b. Re-locate the families. A very preliminary cost of $600,000 was
estimated. The City does not have the funds to support this course
of action.
C. Clean the creek. If a permit is given, the City has sufficient assets
to remove the sediment from the creek.
6. The creek, is listed on the quad sheets as Lock's Creek, however,
informal information indicated the creek has been dredged in the past. (It
has some characteristics of a manmade ditch.) However, this is based on
hearsay. One property owner stated "I remember when my grandfather
got a drag line and cleaned the ditch".
7. Some of the surrounding land was farmland and some was pasture land.
Again dates are difficult to determine.
8. The City has an approved erosion control plan for the project.
This is the City of Fayetteville's first request for a wetlands permit. If any

Dear Mr. Dorney:
The purpose of this letter is to transmit seven copies of the Joint Form for
Nationwide Permit 26 in accordance with instructions contained on the permit
application. (A table of contents listing the joint form and all attachments follows
this letter.)
The permit and attached documentation is somewhat long and detailed. The
following information is provided as a brief executive summary.
1. Prior to 1988, an area known as Lock's Creek was allowed to develop
outside the City limits of Fayetteville.
2. The City annexed the area in 1988 and immediately began receiving
flooding complaints.
3. The extremely wet summer of 1995 resulted in prolonged yard and street
flooding.
4. Matt Flint of the US Army Corps of Engineers, Wilmington District, made a
site visit and recommended applying for a Nationwide 26 Permit.

5. Preliminary design has been accomplished on this project and there are
three alternatives:
a. Do nothing. This is not feasible as residents are living in a wet
area and are having insect, rodent, and reptile problems.
b. Re-locate the families. A very preliminary cost of $600,000 was
estimated. The City does not have the funds to support this course
of action.
C. Clean the creek. If a permit is given, the City has sufficient assets
to remove the sediment from the creek.
6. The creek, is listed on the quad sheets as Lock's Creek; however,
informal information indicated the creek has been dredged in the past. (It
has some characteristics of a manmade ditch.) However, this is based on
hearsay. One property owner stated "I remember when my grandfather
got a drag line and cleaned the ditch".
7. Some of the surrounding land was farmland and some was pasture land.
Again dates are difficult to determine.
8. The City has an approved erosion control plan for the project.
This is the City of Fayetteville's first request for a wetlands permit. If any
additional information is needed, please call on Gerald Croll at 910-433-1691 or
fax 910-433-1780 so the information can be expedited. Your assistance in the
action will be appreciated by the City and residents of Lock's Creek.
