Dear Mr. Hayes:

The Division of Environmental Management, Water Quality Section has reviewed your plans for the
discharge of fill material into 2.46 acres of waters and/or wetlands located at SR 1104 and SR 1109 in
Cumberland County for development of a residential subdivision. Based on this review, we have identified
significant uses which would be removed by this project. These uses are water storage, pollutant removal and
wildlife habitat. Furthennore, insufficient evidence is present in our files to conclude that your project must be
built as planned in waters and/or wetlands. Therefore, we are moving toward denial of your 401 Certification as
required by 15A NCAC 2B.0109. Until we receive additional information, we are requesting (by copy of this
letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your
project on administrative hold. We also found that some of these wetlands had been filled before the 401
Certification was issued. Restoration of some of these areas may be required if we eventually decide that fill
would not have been approved.
Please provide us with information supporting your position that your project must be constructed as
planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically
can you construct your residential development without fill for lots 192, 180, 181, 179, 175 and 176? Deed
restrictions on all lots with remaining wetlands will be needed. In addition the sewer line will have to be
relocated away from the stream to the edge of the flood plain rather than down the stream channel. Any
documentation such as maps and narrative that you can supply to address alternative designs for your project
may be helpful in our review of your 401 Certification. Please respond within two weeks of the date of this
letter by sending a copy of this information to me and one copy to Mr. Ken Averitte at the Fayetteville Regional
Office at Wachovia Bldg., Suite 714, Fayetteville, NC 28301. I can be reached at 919-733-1786 if you have

SUBJECT: Alliance Group of Fayetteville (W.G. Hayes) 401
Water Quality Certification for filling wetlands
associated with residential subdivision
development, near intersection of SR 1104 and SR
1109, between Fayetteville and Hope Mills,
Cumberland County, North Carolina. DEM ID:
951170.

The Wildlife Resources Commission has reviewed the
subject permit application. A site visit was made on
November 17, 1995. Our comments are provided in accordance
with provisions of the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.).

The applicant has applied for Water Quality
Certification to fill 3 areas totaling 0.99 acre of
headwater riparian wetlands for lot and subdivision road
development. In addition, a total of 1.47 acres of riparian
wetlands are to be excavated (0.21 ac. for access roadway,
1.26 ac. for sewerline).

None of the 3 wetland areas to be filled are isolated
from surface waters. The 0.58 ac. section (see map) has
been cleared of all vegetation and disked. Erosion has
begun to form a gully on the lower end. The 0.26 ac.
portion appears to include a small stream and, except where
a road has been constructed, is still forested with water

oak, sweet bay, red maple, loblolly pine, American holly and
has underlying sphagnum moss. Most of the 0.15 ac. section
also remains forested and includes water oak, sweet bay and
American holly. The remaining vegetated wetlands provide
habitat for raccoon, mink, muskrat, oppossum, gray squirrel
and a variety of songbirds. They also provide water quality
protection, floodwater retention and groundwater recharge
functions. Although the 0.58 ac. section has lost much of
its former water protection, retention and recharge
capabilities, these functions could be restored by re-
establishing a vegetative cover.

Finally, the project map indicates excavation in
wooded, riparian wetlands for sewerline installation would
occur right down the middle of the stream channel. Such
action would result in extremely high turbidities during
construction and would be expected to cause sedimentation of
downstream aquatic habitats.

We consider this project to have significant actual
and/or potential adverse impacts to fish and wildlife
habitats. Therefore, we strongly recommend the following
modifications prior to certification issuance:

1. Avoid filling the 3 wetland areas totaling
0.99 ac. except that required for road
construction. This would render approximately 5
lots (#s 230,226,191,179,175) unbuildable.

2. Re-establish a vegetative cover on the 0.58 ac.
section of wetlands.

3. Relocate the sewerline to the rim of the stream~~~~)
floodplain and install/maintain silt fencing ~
immediately downgradient of excavation. Establish
a vegetative cover after backfilling.

Dear John:

Enclosed is a Joint Nationwide Permit and State 401 Certification
Request by the "Alliance Group of Fayetteville" to impact 2.46
acres of headwater wetlands on an un-named tributary of Little
Rockfish Creek in Cumberland County. Over half of these impacts
will be due to installation of 2210 L.F. of sewerline, but these
impacts will be temporary during construction. This work lies just
up stream of an old residential dam.

The purpose of the work is to enable infra-structure construction
and completion of the county approved 81 lot "Tarleton Plantation"
sub-division on 58 acres of land. Should you have any questions
