Box 300 Edenton, NC 27932 Dear Sirs: You have our approval to place fill material in 0.091 acres of wetlands or waters for the purpose of replacing a bulkhead in the Town of Edenton at the end of South Street, as you described in your application dated 20 November 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3025. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to replace 661 feet of existing bulkhead at an average and maximum distance waterward of 6 ft. beyond the NWL along the Estuarine Shoreline at the Edenton Town Park. ra The Town of Edenton Bio Report Page Two Site Description The applicant proposes to replace several hundred feet of existing bulkhead at the Town park adjacent to the Albemarle Sound and Edenton Bay in the Town of Edenton. The waters of Edenton Bay are classified as Coastal Waters by the Division of Marine Fisheries. These waters are also classified by the Division of Coastal Management as Public Trust/Estuarine Waters and as such, are part of the Estuarine System Area of Environmental Concern. The shoreline is vegetated in lawn grasses and ornamental shrubs with some sparse canopy of Taxodium distichum and Quercus virginiana within the Estuarine Shoreline. The parking lot for the Park and other Town facilities are adjacent to the Town Park and Edenton Bay. The Park and parking lot facility were constructed over old fill and is approximately 4 ft. above the NWL. Other existing shoreline development include several thousand feet of bulkhead, a 200 ft. wide basin, a gazebo dock and a 150 ft. by 8 ft. pier. The pier has a 48 ft. by 8 ft. "L" at the end. Considerable concrete debris is present beyond the existing bulkhead alignment. A boat pump-out facility is also present on the site. This shoreline area has also been identified as having historical significance and some adjacent buildings and properties are listed on the National Historic Register. Proposed Work The applicant proposes to replace 661 feet of existing bulkhead at an average and maximum distance waterward of 6 ft. beyond the NWL at Town Park. The applicant proposes to leave the existing bulkhead in place. Due to the existing concrete debris waterward of the existing bulkhead, the applicant estimates that about 300 cy of this material will need to be removed (excavated) from PTW's to achieve the proposed bulkhead alignment. The proposed alignment will minimize the removal of existing concrete debris located at the toe of the existing bulkhead. This proposed work will replace a portion of the Town's bulkhead which has needed replacement for several years. Anticipated Impacts The proposed work will not directly impact any vegetated wetlands. The proposed bulkhead construction will impact 5,288 sf. of Estuarine/Public Trust Waters. This proposed shoreline stabilization work will cause a temporary increase in turbidity in adjacent waters. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification is required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. According to our administrative regulations, 60 days is reasonable for State action. Therefore, if you have not acted on the request, or asked for an extension of time, by January 19, 1997, the District Engineer will deem that waiver has occurred.
