Dear Ms. Moore:
You have our approval to place fill material in wetlands or waters for the purpose of constructing
sewer lines and pump stations at Hiwassee River Trunk Sewer/Ice Plant Pump Station, as you described in
your application dated 7 November 1996. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3022. This certification allows you to use
Nationwide Permit Number 12 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. In addition, you
should get any other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

Please find enclosed, for your review, a 26A Application executed by the Town of
Murphy and one (1) set of plans and specifications for the above mentioned project. A check
in the amount of $500.00 is included.
This project involves the replacement of approximately 6,000 L. F. of 8-inch gravity
sewer line and one (1) sewer pump station. The existing 8-inch sewer line will be replaced
with 3735± L. F. 18-inch, 1290± L. F. 12-inch, 405± L. F. 10-inch and 600± L. F. 8-inch
sewer line. This portion of the Town of Murphy sanitary sewer system has been plagued with
problems during in recent years resulting from an increase in flow from development within
the service area and ground and surface water infiltration due to deteriorating lines. Several
manholes have repeatedly overflowed causing concerns for public health and the environment,
as well as unpleasant odors. The project will begin at the Number One Pump Station located
near the confluence of the Valley and Hiwassee Rivers and end near the U. S. Forest Service
offices at 201 Woodland Drive. A major portion of this project will located on Tennessee
Valley Authority (TVA) controlled property. Due to existing topographical conditions and the
grade of the existing sewer line, the proposed sewer must be located on the down stream side
of the existing line. As with the existing line, this will place the majority of the proposed
sewer line below the top of gate (1526.50') and the maximum surface contour (MSC -
1532.00') for Lake Hiwassee. Pipe material for the proposed sewer line will be PVC SDR-35
pipe except for those sections which will have less than 3'-0" of cover. Ductile iron pipe will
be used in these sections. All manholes will be precast concrete with water tight lids and top
elevations of 1527.50' (one (1) foot above Lake Hiwasse top of gate elevation). Vented
manholes will be installed not less than one thousand feet apart, with vent elevations of
1533.00' (one (1) foot above the MSC for Lake Hiwassee).

On September 15, 1995 the North Carolina Department of Environment, Health and
Natural Resources issued a sewer moratorium preventing connection of any additional
connections to the Town of Murphy's sewer system until the collection system was repaired
and/or upgraded. It is vital to the Town of Murphy's economic development that this project
begin as soon as possible. Due to the relationship between the proposed sewer line location
and the water elevation of Lake Hiwassee, there is a five to six month window (November -
April) during which this project may be constructed. We propose to begin construction no
later than January 1, 1997 and complete those portions below the normal high water elevation
by April 30, 1997.

Project involves: 3735± L.F. 18", 1288± 12", 405± 10", 600± L.F. 8" gravity sewer line,
and one (1). 300 gpm duplex submersible sewage pump station. The project requires a
sub-aqueous crossing of the Valley River. The crossing will utilize ductile iron pipe,
which will be encased in concrete. Coffer dams will be used and one-half of the stream
channel will be open at all times. -The proposed sewer line will be PVC pipe except for
those areas which have less than 3.0'. feet of cover. Ductile iron pipe will be used in
these areas. Manholes will be precast concrete.' All manholes within TVA controlled
property will have top elevations of 1527.50' (one foot above the top of gate for
Hiwassee Lake) . All manholes will utilize watertight lids. Vented manholes will be
spaced not more than 1,000 feet, apart and will be vented at, 1533.00 (one foot above the
MSC for Hiwassee Lake).
