Flounder will be held for up to several months until they can be sold to overseas markets. Water will be pumped continuously into these ponds from Cedar Island Bay or from two wells. The facility will discharge 432,000 gpd continuously from October through December and 64,800 gpd continuously from January through September. Park containing "review modifications" added to the CAMA application as well as a response to DMF concerns over the project. Modifications to the application include: 1) The relocation of the water intake into Cedar Island Bay. 2) The proposal to use a .125" screen/filter on the intake to reduce larval fish entrainment. 3) A change in the flounder food source from croaker, spot and killifish to only killifish. 4) Discharge lines were changed from aluminized steel pipe to corrugated black-poly pipe. 5) The discharge rate was changed from 150 gpm continuous flow from October through December to 300 gpm. It is my understanding that the project is located within a Capacity Use Area. It is suggested that the applicant contact Mat Wilson with the Division of Water Resources concerning the requirements for obtaining a Capacity Use Permit. As a condition in the CAMA Permit, it is recommended that, upon operation of the facility, the applicants monitor the effluent from the facility monthly for the following parameters: BODS, total and suspended residue, NH3, TKN, N02 and N03. Results of the monitoring data should be submitted to DWQ for review. NARRATIVE DESCRIPTION: The project site is located within a :I: 30 acre tract of land located off NC Hwy 12 and adjacent to Cedar Island Bay and the Cedar Island Harbor of Refuge, in the community of Cedar Island, Carteret County. Many years ago, a previous landowner excavated three canals into the property with the resultant spoil being used to raise the elevation of the adjacent property. A wooden framed two- story residence is located on the property and a deteriorated bulkhead and offshore breakwater exists along the shoreline area. A active clam lease is also located offshore of the property. In 1981, a CAMA permit was issued to the previous landowner which authorized the construction of a condominium and marina project to be know as Mariners Village but this development never was undertaken. Over the years the canal systems have developed into an informal docking area for some of the local commercial fishermen. Typical size of the work boats which use the area are in the 18' to 23' class. The waters of Cedar Island Bay and the adjacent canal and Harbor have been designed by the NC Division of Marine Fisheries as Primary Nursery Areas. The canal and Harbor are classified as SA waters while Cedar Island Bay is classified as an Outstanding Resource Water. The waters of the Harbor and canal systems are closed to the harvesting of shellfish. The applicant is leasing a 5 acre parcel of this property which is located directly adjacent to Cedar Island Bay and a finger canal. The shoreline of the canal can be characterized as having a :I: 3 to 4' high vertical bank with a 0 to 10' border of primarily juncus romerianus growing waterward of the bank. Scattered amounts of spartina patens, myrica cerifera and cedar exist along a :I: 5' to 10' fringe area along the bank with the remaining high ground property consisting of centipede and various grasses and "prickly pears". The shoreline along Cedar Island Bay is a sandy beach area vegetated with spartina patens. The applicant's proposal is to construct 12 upland ponds for the purpose of holding live flounders for the overseas market. Flounders would be graded on size and separated to different ponds. Four of the ponds will be 60' in diameter and eight ponds will be 30'. The ponds will be 3' deep with a mounded berm around each pond. The total disturbed areas for the pond and berm and fill areas has been estimated to be :I: 290' long x 125' wide area. All ponds will be lined with a plastic liner. The food source for the contained flounders would include small live finfish such as croakers, spots and killifish. Water for the pond operation is to be supplied by a 3' diameter aluminized steel pipe which will be placed in the existing canal and within a :I: 7' wide x 26' long x 9' deep trench. Discharge water from the pond will be placed in a 12" aluminized steel pipe and placed back into the canal. The applicant has indicated that the pumping and discharge demands for the pond system will be :I: 150 gallons per minute (gpm). Riprap material will be used to stabilize the excavation cuts for the intake and discharge line cuts. In order to provide a suitable unloading platform for the flounders being brought to the facility by boat, the replacement and enlargement of an existing pier is proposed. Presently this pier is :l: 31' long x 5' wide and is proposed to be enlarged to a width of 11'. The applicant has provided a detailed description of the project including construction techniques, volume of ponds and spoil, timing, etc. and this should be consulted for a more detailed description of the project. 10. ANTICIPATED IMPACTS: The project as proposed will result in the land disturbance of :t: 36,250 ft.2 of high ground property with the majority of the material generated from the pond excavation being used to create berms or dikes around the facility. The applicant has proposed a silt fence around the perimeter of the fill area in an attempt to contain the fill and this could provide some short term stability. There will be some limited excavation below the mean high water line in conjunction with the intake pipe and it is expected that :t: 30 ft.2 of shallow water bottom area and :t: 12 ft. 2 of juncus romerianus would be impacted. It is estimated that :t: 10 yds. 3 of sandy silt material would be excavated and placed on adjacent high ground. The stabilization of the bank areas which are cut for the installation of the intake and discharge lines will cause :t: 60 ft.2 of shallow water bottom area being filled with :t: 5 yds.3 of riprap material. This facility will discharge :t: 216,000 gallons a day of water into the existing canal. The water should be relatively the same salinity of the receiving waters. There will, however, be a concentration of fish excrements from the flounders and from the live bait fish used as a food source for the flounders. To facilitate this need, fish would be caught using "pound-nets" in surrounding waters and transported live, by boat, to the proposed containment area. Holding flounder up to several months would keep fish freshest until the date of sale. Water would be pumped continuously into the proposed earthened ponds and gravity fed out. A total' of four - 60' diameter and eight - 30' diameter ponds are proposed for construction (see figure 1). Plumbing for both intake and discharge water would be necessary using PVC and aluminized steel pipe, respectively. Also proposed is enlargement of a preexisting dock. Pond excavation would entail the use of a front end loader and professional hired help. The fill would then be used to construct the pond levys and build up the surrounding elevation on the leased site (see figure 3). A back-hoe would dig trenches, lay pipe, and back-fill. Construction: Figures 1 & 1 a show a general layout of the proposed site, note the cross hatching. Two proposed fences would be built of 1 "x8"x6' treated lumber for reasons of security (see Figure la), Prior to this proposal a "mapping" of the proposed project was conducted using wood survey stakes to indicate the coordinates as shown in Figure 2. Note the reference orgin is taken from the lower left comer of the property. Next, calculations were done on proposed excavated material (see calculation page), and a conclusion was made not to submit a "sedimentation and erosion control plan"- less than one acre ofland disturbed (see figure 3). Surrounding the edges of the proposed work area would be a silt screen fence 2' high to prevent erosion. The steel reinforcement in the concrete floor would be a combination of 3/8" rebar and 1/2" hardware cloth. 3/8" rebar would be used inside the centre block used for the wall construction Once the concrete has cured 72 hours, backfill would be placed around the outside of the drainage structure (see figure 6). Excavation would then begin on the four 60' diameter proposed ponds (see figure 4) . A 45 degree slope is proposed on the sides for stability of the sand. The fill would be distributed around each dig to build the levy to an elevation of 3' from the proposed pond bottom. The proposed eight - 30' diameter ponds would be constructed similiarly (see figure 5). Trenches would then be dug for the drainage lines in each pond using a back-hoe (see figure 7). After the schedule 40 PVC pipe is glued at the joints and fittings, it would be laid at the bottom of the 11 deep trench and backfilled. A 4 mil. plastic liner would then be laid over each pond site and covered with 1-3" of sand using hand shovels. This would prevent loss of water into the pourous sandy bottom. Lastly, the water intake system would be installed (see figure 8). A back-hoe would be used to dig a 7' x 26' x 9' deep trench to lay a 3' diameter 16 guage aluminized steel pipe horizontally. This would couple up to a 6' diameter 9', vertical, 14 guage aluminized steel pipe or pumping chamber (see figures 8a-b). After the connection the trench would be backfilled. Expected water intake and discharge would be the same. The two 6" diameter pumps proposed are rated at 150 gpm continuous load. The second or auxilliary pump would be employed if the main pump fails. All PVC pipe used on the intake system would be schedule 40 grade and laid above ground for inspection puposes. The proposed dock in figure 10 would be enlarged to provide a suitable whaJf area for the unloading offish. New 8" diameter pilings would be put in place using a standard 2" or 3" trash pump. Fish Company for Department of the Army authorization and a State Water Quality Certification to dredge 12 square feet of vegetated marsh and 30 feet of non vegetated wetlands, and fill 60 square feet of non vegetated wetlands for the purpose of constructing 12 holding ponds for a commercial fish storage facility on an existing canal off of the Cedar Island Harbor of Refuge, in Cedar Island, Carteret County, North Carolina. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification is required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. According to our administrative regulations, 60 days is reasonable for State action. Therefore, if you have not acted on the request, or asked for an extension of time, by October 5, 1996, the District Engineer will deem that waiver has occurred.
