Dear Mr. Meyer:

You have our approval to place fill material in 0.64 acres of wetlands or waters for the purpose of
constructing a waste disposal facility at St. Johns River Waste Management facility, as you described in
your application dated 10 July 1996. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification 1'lumber 2671. This certification allows you to use
1'lationwide Permit 1'lumber 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. In addition, you
should get any other federal, state or local permits before you go ahead with your project
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which confonns to Chapter 150B of the 1'lorth Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh,1'l.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

The purpose of this Permit Application Package is to request the issuance of a Nationwide Permit
26 and a Water Quality Certification for the project known as The John's River Waste
Management Facility, Burke County, North Carolina, The project occurs on lands owned by
Burke County; the site is shown on the attached Drexel and Morganton North, NC Topo Quads,

The proposed expansion of the landfill project will require impacts to 0,64 acres of jurisdictional
wetlands above headwaters, Wetlands will be impacted by the placement of sediment and erosion
control structures and the excavation of the disposal area, Wetland impacts are necessary to
update the sediment and erosion control plan and extend the life of the landfill facility, The
installation of the proposed basins will prevent further degradation of downstream wetlands by
sediment.

Wetlands on-site are classified as channels and naturalized sediment deposits,

The project has been previously reviewed by the USACOE and the US Fish and Wildlife Service.
Both of these agencies were contacted for a 0.32 acre fill activity because of potential adverse
impacts to a federally threatened species, The 0,32 acre impact was approved under Nationwide
Permit 26, This issue has since been resolved and the impacts approved, None ofthe current
proposed activities pose a threat to federally protected species,

The prior approved impacts are shown on Map A and are associated with the .'naturalized
sediment control structure". Attached Map A-2 show the limits of the prior approved impacts,
