On March 16, 2018, Mac Haupt of DWR, conducted an on-site determination to review the perennial call point on Feature F located on the subject property for applicability to the Mitigation Rules (15A NCACO2H .0500). The perennial point on the feature labeled as "F" on the attached map (as previously provided by Soil & Environmental Consultants, labeled Figure 3 -Wetland Sketch Map) was evaluated by Mac Haupt on March 16, 2018. After walking up and down Feature "F" both above and below the prior perennial call point, two areas were selected to utilize the DWR Stream Classification Form. The Feature "X", approximately 200 feet above the called perennial point was evaluated to have a score of 25.5 on the DWR form. Feature "Y" was evaluated to have a corrected score of 34 on the DWR form. The form states that if the score is "greater than or equal to 19 points the stream is at least intermittent and greater than or equal to 30 points is perennial." The forms are attached to this letter. The DWR has determined that the perennial call as previously labeled, on Feature "F", on the attached map (Figure 3) is the correct location for the initial point of the perennial channel. This determination shall replace the determination originally performed by the DWR Winston-Salem Regional Office and shall expire five years from the date of this letter. This determination can be contested as provided in General Statute 150B by filing a written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as OAH) within sixty (60) calendar days. A petition form may be obtained from the OAH at htto://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-3000 for information. A petition is considered filed when the original and one (1) copy along with any applicable OAH filing fee is received in the OAH during normal office hours (Monday through Friday between 8:00am and 5:00pm, excluding official state holidays).
