floating structure in Core Sound. The concerns expressed in my 8
June 1996 letter concerning wastewater disposal will be
adequately addressed when Carteret County issues a permit to this
project to handle the wastewater and dispose of it onshore.

Dear Mr. Cox and Mr. Huber:
The Division of Environmental Management, Water Quality Section has reviewed your
plans to place a 16 foot by 41 foot floating structure into Core Sound for clam harvesting and
bagging. Furthermore, insufficient evidence is present in our files to conclude that your project
must be built as planned and still protect water quality in Core Sound. Therefore, we are
moving toward denial of your 401 Certification as required by 15A NCAC 2B.0109. Until we
receive additional information, we are requesting (by copy of this letter) that the N.C. Division
of Coastal Management place your project on administrative hold.
Please provide us with information supporting your position that your project must be
constructed as planned and that you have no practicable alternative to this project. Specifically
how do you plan to handle the wastewater generated during use of this facility? If a pumpout
facility will be used, can this structure make regular trips to this site? If the sewage is pumped
to another vessel, a pump and haul permit would be needed DEM issues these permits as
temporary solutions to wastewater dilemmas - therefore we are unlikely to issue such a permit
in this case. Any documentation such as maps and narrative that you can supply to address
alternative designs for your project may be helpful in our review of your 401 Certification.
Please respond within two weeks of the date of this letter by sending a copy of this information
to me and one copy to Mr. Jim Gregson at the Wilmington Regional Office at 127 Cardinal
Drive Ext., Wilmington, NC 28405-3845. If we do not hear from you in two weeks, we will
assume that you no longer want to pursue this project and we will consider the project as

RECOMMENDED CONDITIONS OR PERMIT RESTRICTIONS:
It is recommended that the applicant be required to submit a detailed explanation of how domestic
wastewater generated on the floating structure will be disposed of. The permit application states that
there will be holding tanks and pumpout equipment on board, however it is my understanding that the
nearest pumpout facility is located in Beaufort, NC and it is doubtful that a floating structure of this type
would be able to make the trip to Beaufort. If the applicants pumped the wastewater onto another vessel
or vehicle for transport to a suitable disposal site, they would be required to obtain a pump and haul
permit. This Division would be unlikely to issue a pump and haul permit as a permanent solution to a
waste disposal problem. It is also my understanding that septage haulers are not permitted to transport
and dispose of this type of waste.

9. NARRATIVE DESCRIPTION:
Project Setting
Mr. Joseph A. Huber leases 7 acres of public bottom on the east side of Core
Sound from the State of North Carolina for the purpose of cultivating shellfish. Mr.
Huber also has a lease for use of the water column superjacent to the bottom for the
purpose of increasing the productivity of shellfish culture on that leased bottom. The
lease bottom/project site is located approximately 300' from Cape Lookout National
Seashore. The waters of Core Sound at the project site have been classified SA ORW.
According to the applicant, the water depths range between -2' and -3' below MHW.
Obviously, the area is open to shellfishing.
Project Description
The applicants propose to place a 16' X 44' floating structure in the waters of
Core Sound. The two-story structure has a first-story floor area of 704 ftz built upon a
wooden platform attached to nine 12' X 3' pontoons (see attached photographs). The
second floor has 180 ft2 of living space. The structure is of wood frame construction
with a front and back doors and 14 windows. There are both front and back porches
on the structure. The interior includes a vinyl linoleum tile floor covering, a kitchen
containing wooden cabinets, wood grain countertops, a double stainless steel sink, and
a full-size refrigerator. The structure is wired for electricity and includes a ceiling fan
in the middle of the living room. A wooden staircase leads to the second floor. Two
rooms are located upstairs just off the upstairs hallway. The applicant states that there
are self contained tanks with pumpouts equipment on the structure.
The applicants propose to anchor the floating structure inside the water column
lease and harvest the clams. The clams would be brought aboard the floating structure
for grading, counting, and bagging. And according to the applicant, the structure
would allow for year around operation as well as provide for 24-hour security at the
remote site.
Anticipated Impacts
The placement of the floating structure in the Estuarine Waters of Core Sound
would usurp a minimum of 704 ft2 of Public Trust Area. The structure would infringe
upon the public trust rights and provides for the potential of discharges into the Public
Trust and Estuarine Waters of Core Sound. It also appears that the placement of the
structure adjacent to the Cape Lookout National Seashore would have an adverse affect
on the aesthetics of this natural area.

A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission

and cross-sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 71.0203 for a

only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an

Description of Floating Structure

To help manage a maraculture clam operation on shellfish
leases near Core Banks approximately five miles south west
of Atlantic, NC we have built a floating work station. The
structure consist of a covered wood frame 16' wide by 44'
long mounted on 9 stainless steel floats 12' long by 4'
wide. The structure has approximately 650 square feet of
work area including a galley and head. It has an upper
level area of 180 square feet for supplies storage and
sleeping area. There are 224 square feet of covered front
and rear decks for outside work areas.
Our lease site is suite remote and only accessible by water.
When clams are harvested they will be taken aboard this
workstation for grading, counting, and bagging. The grading
operation separates out the clams that are too small for
market. These clams will be put back on the lease for
additional growth. The workstation on the lease site will
allow a year around operation so that we can take advantage
of the premium winter market and will eliminate the long
trip to the mainland and back to the lease for replanting
the undersize clams. This lengthy exposure, traveling to
the mainland and back, can be quite harmful to the clams in
winter. The workstation will also allow us to provide 24
hour security, which is expected to be needed on this remote
site.
The work station will be anchored inside a column "lease.
This column lease, when applied for, had this work station
shown on the application. This 'lease i.s inside a 7 acre
bottom lease and has a water depth of approximately 21-31.
The work station will not hinder navigation or any use of
the public trust more than allowed by the column lease.

9. NARRATIVE DESCRIPTION:
Project Setting
Mr. Joseph A. Huber leases 7 acres of public bottom on the east side of Core
Sound from the State of North Carolina for the purpose of cultivating shellfish. Mr.
Huber also has a lease for use of the water column superjacent to the bottom for the
purpose of increasing the productivity of shellfish culture on that leased bottom. The
lease bottom/project site is located approximately 300' from Cape Lookout National
Seashore. The waters of Core Sound at the project site have been classified SA ORW.
According to the applicant, the water depths range between -2' and -3' below MHW.
Obviously, the area is open to shellfishing.
Project Description
The applicants propose to place a 16' X 44' floating structure in the waters of
Core Sound. The two-story structure has a first-story floor area of 704 ftz built upon a
wooden platform attached to nine 12' X 3' pontoons (see attached photographs). The
second floor has 180 ft2 of living space. The structure is of wood frame construction
with a front and back doors and 14 windows. There are both front and back porches
on the structure. The interior includes a vinyl linoleum tile floor covering, a kitchen
containing wooden cabinets, wood grain countertops, a double stainless steel sink, and
a full-size refrigerator. The structure is wired for electricity and includes a ceiling fan
in the middle of the living room. A wooden staircase leads to the second floor. Two
rooms are located upstairs just off the upstairs hallway. The applicant states that there
are self contained tanks with pumpouts equipment on the structure.
The applicants propose to anchor the floating structure inside the water column
lease and harvest the clams. The clams would be brought aboard the floating structure
for grading, counting, and bagging. And according to the applicant, the structure
would allow for ygar around operation as well as provide for 24-hour security at the
remote site.
Anticipated Impacts
The placement of the floating structure in the Estuarine Waters of Core Sound
would usurp a minimum of 704 ft2 of Public Trust Area. The structure would infringe
upon the public trust rights and provides for the potential of discharges into the Public
Trust and Estuarine Waters of Core Sound. It also appears that the placement of the
structure adjacent to the Cape Lookout National Seashore would have an adverse affect
on the aesthetics of this natural area.

Description of Floating Structure

To help manage a maraculture clam operation on shellfish
leases near Core Banks approximately five miles south west
of Atlantic, iii; we have built a floating work station. The
structure consist of a covered wood frame 16' wide by 44'
long mounted on 9 stainless steel floats 12' long by 4'
wide. The structure has approximately 650 square feet of
work area including a galley and head. It has an upper
level area of 180 square feet for supplies storage and
sleeping area. There are 224 square feet of covered front
and rear decks for outside work areas.
Our lease site is quite remote and only accessible by water.
When clams are harvested they will be taken aboard this
workstation for grading, counting, and bagging. The grading
operation separates out the clams that are too small for
market. These clams will be put back on the lease for
additional growth. The workstation on the lease site will
allow a year around operation so that we can take advantage
of the premium winter market and will eliminate the long
trip to the mainland and back to the lease for replanting
the undersize clams. This lengthy exposure, traveling to
the mainland and back, can be quite harmful to the clams in
winter. The workstation will also allow us to provide 24
hour security, which is expected to be needed on this remote
site.
The work station will be anchored inside a column lease.
This column lease, when applied for, had this work station
shown on the application. This lease is inside a 7 acre
bottom lease and has a water depth of approximately 2'-31.
The work station will not hinder navigation or any use of
the public trust more than allowed by the column lease.

9. NARRATIVE DESCRIPTION:
Project Setting
Mr. Joseph A. Huber leases 7 acres of public bottom on the east side of Core
Sound from the State of North Carolina for the purpose of cultivating shellfish. Mr.
Huber also has a lease for use of the water column superjacent to the bottom for the
purpose of increasing the productivity of shellfish culture on that leased bottom. The
lease bottom/project site is located approximately 300' from Cape Lookout National
Seashore. The waters of Core Sound at the project site have been classified SA ORW.
According to the applicant, the water depths range between -2' and -3' below MHW.
Obviously, the area is open to shellfishing.
Project Description
The applicants propose to place a 16' X 44' floating structure in the waters of
Core Sound. The two-story structure has a first-story floor area of 704 ft2 built upon a
wooden platform attached to nine 12' X 3' pontoons (see attached photographs). The
second floor has 180 ft2 of living space. The structure is of wood frame construction
with a front and back doors and 14 windows. There are both front and back porches
on the structure. The interior includes a vinyl linoleum tile floor covering, a kitchen
containing wooden cabinets, wood grain countertops, a double stainless steel sink, and
a full-size refrigerator. The structure is wired for electricity and includes a ceiling fan
in the middle of the living room. A wooden staircase leads to the second floor. Two
rooms are located upstairs just off the upstairs hallway. The applicant states that there
are self contained tanks with pumpouts equipment on the structure.
The applicants propose to anchor the floating structure inside the water column
lease and harvest the clams. The clams would be brought aboard the floating structure
for grading, counting, and bagging. And according to the applicant, the structure
would allow for year around operation as well as provide for 24-hour security at the
remote site.
Anticipated Impacts
The placement of the floating structure in the Estuarine Waters of Core Sound
would usurp a minimum of 704 ft2 of Public Trust Area. The structure would infringe
upon the public trust rights and provides for the potential of discharges into the Public
Trust and Estuarine Waters of Core Sound. It also appears that the placement of the
structure adjacent to the Cape Lookout National Seashore would have an adverse affect
on the aesthetics of this natural area.

Description of Floating Structure

To help manage a maraculture clam operation on shellfish
leases near Core Banks approximately five miles south west
of Atlantic, NC we have built a floating work station. The
structure consist of a covered wood frame 16' wide by 44'
long mounted on 9 stainless steel floats 12' long by 4'
wide. The structure has approximately 650 square feet of
work area including a galley and head. It has an upper
level area of 180 square feet for supplies storage and
sleeping area. There are 224 square feet of covered front
and rear decks for outside work areas.
Our lease site is quite remote and only accessible by water.
When clams are harvested they will be taken aboard this
workstation for grading, counting, and bagging. The grading
operation separates out the clams that are too small for
market. These clams will be put back on the lease for
additional growth. The workstation on the lease site will
allow a year around operation so that we can take advantage
of the premium winter market and will eliminate the long
trip to the mainland and back to the lease for replanting
the undersize clams. This lengthy exposure, traveling to
the mainland and back, can be quite harmful to the clams in
winter. The workstation will also allow us to provide 24
hour security, which is-expected to be needed on this remote
site.
The work station will. be anchored inside a ,column lease.
This.column lease, when applied for, had this work station
shown on the application. This lease is inside a 7 acre
bottom lease and has a water depth of approximately 21-31.
The work station will not hinder navigation or any use of
the public trust more than allowed by the column lease.
