The only thing in my file for this project so far is the standard scoping comments I made in 2011, so I'll add this determination to our file and it can apply. (The JD is the COE's decision, so it's up to them for 404 jurisdiction. Whichever they prefer I'll go by.) Let me know if you need anything else from us. A recent evaluation of the project has indicated that the new construction limits are not fully covered by the previously completed delineation conducted by NCDOT staff in 2011. Eric was kind enough to track down the PJD verification signed on September 10, 2012 (USACE Action ID Number: SAW-2011-00044). The Department has been working with the Town of Wake Forest to incorporate the design for the proposed Smith Creek Greenway and associated parking lot into our bridge replacement project. It is our understanding of the following issues regarding their project: -The Town informed the Department that Stewart Engineering and Ecological Engineering had been tasked on some planning/design of the Greenway. -The delineation conducted by Ecological Engineering appears to cover of the footprint of the NCDOT bridge replacement project including parts of the Greenway that may be constructed by the Department. The UT to Smith Creek at the Song Sparrow Drive crossing is a perennial stream that is depicted on the Soil Survey of Wake County and the USGS topographic map and is therefore subject to the riparian buffer rule. -All of these parties have indicated approval that this information can be used by the Department. This includes Ed Lynch (Stewart Engineering), David Cooper (Ecological Engineering; now VHB) and Suzette Morales (Transportation Division Manager from the Town of Wake Forest). The Department requests a review of this information to determine if your agency will allow the use of this PJD and Buffer Determination for our bridge replacement project and associated improvements. Wetland WB was added after the site visit. This one actually has a 9/10/17 expiration date; it was after that when we were told that PJD's do not have an expiration date. One issue that is still unresolved is that we have been informed that you conducted an on -site review with Jim Mason on April 21, 2011 and all jurisdictional features were verified. The NRTR (written by Jim) indicated that documentation of the JD verification is pending. I cannot find any copy of a JD. Did you ever issue one? If so, can you send me a copy?
