Dear Mr. and Ms. Blythe:
You have our approval to impact 0.1 acres of wetlands or waters for the purpose of deepening an area
to provide water access at 536 Metcalf Drive SW near Sunset Beach, NC, as you described in your
application dated 16 October 1996. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2733. This certification allows you to use
Nationwide Permit Number 18 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 211.0506 (h) (6) and (7). For this approval to be valid, you must
follow the conditions listed in the attached certification. In addition, you should get any other federal, state
or local permits before you go ahead with your project. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

The subject project is located along the shoreline of Lake Medcalf, near Sunset Beach.
Lake Medcalf is an approximately thirty acre lake which was created some twenty years ago by
the damming of Calabash Creek, a tidal waterbody which is tributary to Little River in South
Carolina. As a result of Hurricane Fran the dam across Calabash Creek broke at the spillway
leaving an approximately twenty foot wide hole in the dam. During the site investigation on
November 5, 1996, the tide was flowing into the mudflat area which was once the freshwater
lake. The old Calabash Creek stream channel was visible as it meandered through the now
exposed mud bottom. The applicants are unsure what the fate of the lake will be. It is my
understanding that the owner of the road/dam does not want to repair it.
The applicants have requested approval to excavate less than one acre of vegetated
shoreline that was once below the ordinary high water line of Lake Medcalf. The purpose of the
proposed work is to remove tree stumps and vegetation in the first twenty feet of shoreline to
provide deeper water for canoe access.
It is my understanding that the COE is calling this area below headwaters, so any
excavation or filling beyond the scope of NWP 18 will require an individual permit. The
applicants have agreed to restrict impacts to less than one-tenth acre and less than 25 cu. yds.
instead of the less than one acre originally proposed. Since the project will be less than one-third
acre within 50 feet of the water body, the applicant has met the minimization criteria set fourth
in 15A NCAC 2H .0506. Therefor this Office has no objection to the project.

Please note that if the lake is left in its current condition, the applicant's project would
probably be considered to be located along an estuarine shoreline. It is unclear what length of
time would have to pass before DCM would make this call.

the lake are very shallow and loaded with growth from tree stumps and mounds of dirt where trees have
fallen. By August, this area is usually dry. I want to clean out the overgrowth and increase the depth by 2 to 4
feet. Any dirt dredged would remain on my property.
13. Purpose of proposed work: Increase water flow to inhibit mosquitoes and eliminate stumps sticking out
of the water.
14. State reasons why the applicant believes that this activity must be carried out in wetlands. Also, note
measures taken to minimize wetland impacts. This activity will improve the lake behind my house. It will have
little to no impact on the local area and should prove beneficial to the local fauna.

100 feet of shoreline The first 10 to 20 feet of the lake are very shallow and loaded with growth from tree

Dear Sirs,
I am applying for a permit from the Army Corp of Engineers. My house is located on a man-made
lake formed from the Calabash River in the town of Sunset Beach. My property consists of slightly less than
100 feet of shoreline The first 10 to 20 feet of the lake are very shallow and loaded with growth from tree
stumps and mounds of dirt where trees fell over. The permit will allow me to hire someone to clean out the
overgrowth and increase the depth about two feet. The dirt dredged would remain on my property. I am
required to contact your office regarding the presence of any Federally listed or proposed for listing
endangered or threatened species or critical habitat in the permit area.
Medcalf Lakes is located a few miles from the entrance to Oyster Bay Golf course off Rt. 179 in
