After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2733. This certification allows you to use Nationwide Permit Number 18 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Deputy State Historic Preservation Officer SUBJECT: Capital improvements at Goose Creek State Park, Beaufort County, GS 94-0079 Thank you for your memorandum of May 5, 1994, concerning the above project There are no known recorded archaeological sites within the project boundaries. However, the project area has never been systematically surveyed to determine the location of significance of archaeological resources. The 1980 survey by Rovner was limited to new roadways. The proposed work items 1 through 5 in your memorandum are in high probability areas for the presence of archaeological resources. We recommend that a comprehensive survey be conducted by an experienced archaeologist to identify the presence and significance of archaeological remains that may be damaged or destroyed by the proposed project. Potential effects on unknown resources should be assessed prior to the initiation of construction activities. We have conducted a search of our files and are aware of no structures listed on the National Register of Historic Places located within the planning area. These comments are made in accord with G.S. 121-12(a) and Executive Order XVI. Marshall Ellis Resource Management Specialist Division of Parks and-Becreation, DEHNR FROM: David Brook Deputy State Historic Pre ?`. servati?on Oiffice SUBJECT: Draft Archaeological Survey Report, Capital Improvements at Six State Parks: Hammocks Beach, Onslow County (GS 94-0080); Pettigrew, Washington County (GS 94-0085); Jockey's Ridge, Dare County (GS 94-0081); Goose Creek, Beaufort County (GS 94- 0079); Fort Fisher, New Hanover County (GS 94- 0045); and Lumber River, Robeson County (GS 94- 0082) We have reviewed the above referenced draft archaeological report submitted by Greg C. Smith of Environmental Services, Inc. and offer our comments for each of the six parks. HAMMOCKS BEACH STATE PARK. Although archaeological site 31ON82 covers most of the park area and h:?s been determined eligible for inclusion in the National Register of Historic Places, the recent investigations indicate that the proposed improvements to the maintenance structure will not affect significant portions of the site. We concur with the report's recommendations that no additional archaeological investigations are warranted at the site prior to construction activities. We also concur with the recommendation that, if footing excavations are required by construction plans, these excavations should be monitored by an experienced archaeologist. If significant cultural features are exposed during excavation, construction should cease in that area and the archaeologist(s) allowed the opportunity to record and recover the feature';; data. PETTIGREW STATE PARK. The survey of the proposed improvements area determined that no cultural resources will be affected by construction activities. We concur with the recommendation that no further archaeological investigations are warranted for the project. JOCKEY'S RIDGE STATE PARK. One previously recorded archaeological site-- 31 DR23--was located near the proposed project area in 1958. The recent survey indicates this site has either been destroyed or will not be affected by the proposed improvements. We concur with the recommendation, that no additional archaeological investigation is warranted for the project. , GOOSE CREEK STATE PARK. An archaeological survey of the proposed improvements area determined that no cultural resources will be affected by construction activities. We concur with the recommendation that no additional archaeological investigation is warranted for the project. FORT FISHER STATE RECREATION AREA. No archaeological remains were identified in the area initially proposed for improvements at Fort Fisher and as a consequence we concur with the recommendation for no additional archaeological investigations in this area. Although your agency proposed a shift in the location of the improvements (as noted in your letter of May 15, 1995 to Greg Smith), additional archaeological investigations are not recommended since the new location is adjacent to existing facilities. LUMBER RIVER STATE PARK. The archaeological investigations at this project resulted in the discovery of two sites (31 RB437&437 * * and 31 RB438). Only 31 RB437&437 * * is located within the park's boundaries. Site 31 RB437&437 is a multicomponent prehistoric and historic period site. The prehistoric component dates from the Late Archaic through Middle Woodland and the historic component is thought to be remnants of the eighteenth century town of Princess Anne. Although the town was short-lived, the state's archives indicate a post office was established in 1844. The report states that additional testing should be undertaken at the prehistoric component of 31 RB437&437* * in the future. Since the site will not be affected by the proposed construction. While we concur that additional archaeological investigations are not necessary at this time, we recommend that active measures be taken to protect site 31 RB437&437 * * from disturbance during construction. Future in-depth archival and archaeological investigations at the site of Princess Anne may reveal additional remains of this important town. Site 31 RB438 is located outside the park boundaries and will not be affected by proposed activities. Should the Division of Parks and Recreation acquire this property at a future date, archaeological investigations of sufficient intensity to determine the National Register eligibility of the site should be undertaken. The report meets our reporting standards and guidelines and those of the Secretary of the Interior. Archaeological site forms for the newly recorded sites and updated forms for the previously recorded sites should be submitted to our office as soon as possible. The above comments are made pursuant to Section 106 of the National Historic Preservation Act of 1966 and the Advisory Council on Historic Preservation's Regulations for Compliance with Section 106, codified at 36 CFR Part 800.
