PROJECT SUMMARY: The application is to bring Mr. Galer's existing mooring buoy into compliance with the Coastal Resources Commission Rules governing freestanding moorings as specified in NCAC 7H.0208(b)(10)(P). Project Name: Herbert W. Galer Mooring Property Owner: Mr. William Van Loan Agent: Mr. Herbert W. Galer Beaufort County Project Setting The project site is located in Beaufort County off SR 1331 at Pamlico Plantation on Broad Creek near Washington, North Carolina. The property is an undeveloped parcel within the subdivision owned by William Van Loan and is situated adjacent the Pamlico Plantation Marina. The vegetation on the project site is primarily upland grasses with some pine trees and hardwoods. The width of Broad Creek in this area is ±3,760 feet. This area of Broad Creek is classified as SB NSW waters by the Environmental Management Commission. Broad Creek has been classified as a Special SecondarX Nursery Area by the NC Division of Marine Fisheries and is closed to shell fishing. Project Description The application is to bring Mr. Galer's existing mooring buoy into compliance with the Coastal Resources Commission Rules governing freestanding moorings as specified in NCAC 7H.0208(b)(10)(P). Mr. Galer's mooring buoy is located ±514 feet waterward of Mr. Van Loan's property and within his riparian area. The mooring buoy is made up of a 350 pound mushroom anchor, a 10 foot long section of three quarter (3/4) inch chain connected by a three quarter (3/4) inch swivel to a 15 foot section of half (%2) inch chain, a 15 inch diameter buoy with two (2) 40 foot long by five eights (5/8) inch nylon "rodes" and a 4 inch diameter floating pick-up pole. The mooring buoy is for use by Mr. Galer during major storm events to tie off 36 foot long sail boat. The radius of the arc of the swing including Mr. Galer's vessel is 100 feet. Anticipated Impacts The potential use area of the mooring is circular in shape and pivots around the 350 pound anchor. This circular area encompasses ±31,400 ft' of Public Trust Waters and creek bottom. However, the evaluation of the impacts of the mooring must also take into consideration that the actual straight line impact along the 100 foot radius at any point during the swing will be considerably less than the total area of the circle. The actual impacts to navigation as well as the shading of shallow water habitat are much less than conventional piers and slip type moorings. The mooring buoy is situated ±960 feet east of the channel in Broad Creek. The normal movement of the anchor during usage may result in short term, localized turbidity. Jeffrey R. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. (Contact the, U.S. Army,..Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the Revised 03195 Form DCM-MP-1 site. Include highway or secondary road (SR) numbers, landmarks, and the like. • A Stormwater Certification, if one is necessary. • A list of the names and complete addresses of the adjacent waterfront (riparian) landowners and signed return receipts as proof that such owners have received a copy of the application and plats by certified mail. Such landowners must be advised that they have 30 days in which to submit comments on the proposed project to the Division of Coastal Management.
