Box 54 Washington, NC 27880 Dear Mr. Moore: You have our approval to place fIll material and dredge in 15,772 square feet of wetlands or waters for the purpose of constructing a home and associated facilities at SR 1309, as you described in your application dated 30 August 1996, After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3025. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. A deed restriction or conservation easement shall be added to remaining wetlands on the property to prevent future fill. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N,C. 27611-7447. This certification and its conditions are fmal and binding unless you ask for a hearing. HENRY MOORE JR. AND STUART B. MOORE Beaufort County Environmental settine The applicant owns a 1.23 acre tract of land off of SR 1309 adjacent to the Pamlico River in Beaufort County. Of the 1.23 acres, a considerable amount of the property has been designated as wetlands by the COE. The wetland delineation is shown on Plat No.2 in the application package. Historically the property has experienced ongoing erosion along the Pamlico River, which is evident by an erosion scarp. No shoreline stabilization efforts have been made until this time. Along the eastern edge of the property a canal is present which connects to the Pamlico River. The applicants' eastern property line is located within this canal. The canal, which has a width of :t20", continues past the applicants' property and thus is adjacent to other properties. The canal has not been maintained in many years and now averages :t l' in depth at normal water. At approximately 100' south of the mouth of the canal the Pamlico River has a depth of :t4' at NWL. Along a majority of the length of the canal, as shown on Plats 2 and 3, much of the adjacent areas have been designated as wetlands by the COE. This area is predominately vegetated with ~ mn,.., Virginia Wild Rye Grass, Smart Weed, Marsh Mallow and many other species. The highground portions of the property is vegetated with both pines and a variety of hardwood trees. On 12 July 1996 Hurricane Bertha had a severe impact on the property. Several large trees have fallen which are crossed throughout the wetland area. Also a rack line indicates that several feet of water was over much of the property. PrQject pro,posal The applicant is proposing the following: (1) The placement of riprap along :t 154' of shoreline adjacent to the Pamlico River. This riprap will average :t5' and will be a maximum of :tl0' beyond the NWL. This riprap will extend from the western property line to the mouth of the canal. Where the riprap is to be waterward of wetland vegetation, it will not be placed atop the wetlands, nor any higher than the ground elevation of the wetlands. (2) The placement of riprap along the edge of the proposed widen canal (see #7) and around the proposed boatbasin (see #9). This area of riprap will have a length of :t 195' and it will be placed as close as possible to the toe of the canal edge. As in #1, since this entire area is bordering wetlands, no riprap will be placed atop any wetlands nor higher than the ground elevation of the wetlands. (3) The placement of three riprap groins in the Pamlico River. The locations of these groins are shown on plat #2. Each groin will extend 15' beyond the NWL. Each will have a bottom width of 5' , a top width of 1.5' and will extend 1.5' above the NWL. . N. Henry Moore Jr. and Stuart B. Moore . Page 2 (4) The construction of a 3.5' wide by 63' long pier with a 16' by 12' L-shaped platform within the Pamlico River. The location of the pier is shown on plat #2. (5) The proposed excavation of a :t 100' long by :t25' wide access channel in the Pamlico River to provide better access to the mouth of the existing canal. This area averages :t3' in depth at normal water and will be excavated to a :t4' depth at normal water. All spoils are to be placed on highground. (6) The maintenance excavation of :t392' of canal. The canal averages :t20' in width, has an existing depth of :tl.3' at normal water and will be excavated to a depth of -4' at normal water. The canal is shown on Plats 2 and 3. All spoils are to be placed on highground. It should be noted that a portion of this canal is on the property of Mr. Perry Fortesque. A letter from Mr. Fortesque is in the application package giving the applicants permission to work on his property. (7) The widening of the southern most :t85' of the existing canal. This widening will extend from the mouth of the canal to the proposed boatbasin (see #9). This widening will involve the excavation of a :t 17' wide strip of wetlands along the western edge of the existing canal. This area will also be excavated to a depth of -4' at NWL. . (8) The maintenance excavation of a :t43' long area which has a width of :t9' and a depth of :t 1.0'. This area is located along the west side of the canal and is being described as an existing boat basin on plat #2. The area actually has very little resemblance to a boatbasin. The area proposed is to be excavated to a depth of -4' at NWL. All spoils are to be placed on highground. (9) The proposed enlarging of the area that is being described asa boatbasin by the excavation of wetlands on both the north and south sides of the area. The excavation will result in a 43' long by 21' wide by -4' deep at NWL boatbasin connected to the existing canal. All spoils will be placed on highground. See plat #2 for details. (10) The construction of a dock along the north and west sides of the new boatbasin. This dock will have a total length of :t60' and will have a width of 2.5". See plat #2 for details. (11) The construction of a 25' long by 15' wide concrete boatramp, of which 15' will extend beyond the NWL. The ramp will be constructed within a wetland area on the northeast side of the canal (see plat #3). This ramp will result in :t270 sq. ft. of wetlands to be excavated and :t407 sq. ft. to be filled. , N. Henry Moore Jr. and Stuart B. Moore Page 3 . (12) The placement of a fill causeway across the canal to provide access to the proposed homesite. Present access is now on the west side of the canal, however, the applicant wishes to obtain access from additional property he owns on the east side of the canal (see plat #3). The causeway will have a 16' top width and will be crossing the canal at an area which has a width of :t20'. A 3' culvert will be placed within the causeway to allow for continued drainage. Riprap will be placed atop the pipe on each side of the causeway. (13) The development of a single family homesite on the highground portion of the property. As part of the landscaping, the applicant is proposing to fill a :t440 sq. ft. area of isolated wetlands (see plat #3). Environmental impact The following environmental impacts will occur: .(1) The placement of riprap to stabilize the shoreline will result in + 1.745 sq. ft. of open water area filled within the Pamlico River and the man made canal. (2) The construction of the three groins will result in + 225 sq. ft. of open water area to be filled in the Pamlico River. (3) The access channel will result in +2.500 sq. ft. of shallow water habitat to be excavated in the Pamlico River. (4) The canal widening will result in + 1.445 sq. ft. of wetland vegetation to be excavated on the west side of the canal. (5) The canal maintenance excavation will result in +7.480 sQ. ft. of shallow water area to be excavated. (6) The boatbasin maintenance excavation will result in + 387 sq. ft. of shallow water area to be excavated. (7) The enlarging of the boatbasin will result in +553 sq. ft. of wetland vegetation to be excavated. (8) The placement of the boatramp will result in +270 sq. ft. of wetland vegetation being excavated. A copy of the deed (with state application only) or other instrument under which the applicant claims title to the affected properties. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project, . An accurate, dated work plat (including plan view and cross-sectional drawings) drawn to scale in black ink on an 8 1/2" by 11" white paper. (Refer to Coastal Resources Commission Rule 7J .0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if an adequate Dumber of quality copies are provided by applicant. (Contact the U.S. Army Corps of Engineers regarding that agency's use of larger drawings.) A site or location map is a part of plat requirements and it must be sufficiently detailed to guide agency personnel unfamiliar with the area to the ':~ Form DCM-MP-l ~ site.
