Certification and ADDITIONAL CONDIT-IONS Mr. Dean Pruitt 2464 Meadow Fork Road Laurel Springs, NC 28644 Dear Mr. Pruitt: You have our approval to place fill material in 0.25 acres of wetlands or waters for the purpose of stabilizing the streambank of Meadow Fork Creek at your property, as you described in your application dated 5 August 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Nuniber 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you maybe required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Work shall not be done during trout spawning period of October 15 to April 15. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for 4 hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes-to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Mickey, Jr., Fisheries Biologist original signed by Joe Mickey DATE: August 5, 1996 C?Oo lp'y RECEIVED AUG 0 81996 ENVIRONMENTAL SCIENCES '-' N!ry SUBJECT: Review of an application by Mr. Dean Pruitt to stabilize eroding stream banks along Meadow Fork Creek, Alleghany County Mr. Dean Pruitt, 2464 Meadow Fork Creek Road, Laurel Springs, North Carolina 28644 (910/372-8966), is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the US. Army Corps of Engineers. A site visit was conducted on August 5, 1996 to discuss project plans with the applicant. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Mr. Pruitt proposes to stabilize approximately 100 feet of eroding stream banks with either riprap, root wads or a combination of both methods. The stream is eroding into a pasture, causing it to by-pass a section of existing channel. Stabilization of the eroding stream banks will divert water back into the original channel, which is stable. Meadow Fork Creek is Designated Public, Mountain Trout Water managed as Hatchery Supported. However, wild brook and brown trout are found at this location (NCWRC data, 1994-1996). Based on the site visit and discussions with Mr. Pruitt about the project, I have no objection to the project as proposed provided that work is prohibited during the trout spawning period of October 15 through April 15. Stabilization of the eroding banks should improve water quality and fish habitat by reducing future sediment imput from this site. Thank you for the opportunity to review and comment on this project.
