Williams 111 Bethany Drive Stedman, NC 28391 Dear Mr. Williams: You have our approval to excavate and fill 2.0 acres of wetlands or waters for the purpose of constructing a perimeter road at the end of SR 1331 near Horseshoe Lake, as you described in your application dated 26 July 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you musdollow the conditions listed in the attached certification and any additional conditions listed below. The road side ditches shall = be connected to outside waters. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. M you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter, I50B of'the North Carolina General Statutes to the Office of Administrative Hearings, P.O. BOX17447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unlesa you ask for a hearing. Placement of dredged or fill material in wetlands on this property without a Department of the Army permit is in 'most cases4 violation of Section 301 of the Clean Water Act (33 USC 1311). Williams, 111 Bethany Dr., Stedman, Bladen County, North Carolina. Project Number: 960709. The Wildlife Resources Commission has completed a review of the project and associated impacts on wildlife and fishery resources. A site visit was attempted on August 12, 1996. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), Section 401 of the Clean Water Act (as amended), and North Carolina General Statutes (G.S. 113-131 et seq.) . The applicant is seeking certification to construct a perimeter road by excavating ditches 10 feet wide on both sides of the.proposed road and using the material to build the road bed. The road bed is to be 20 feet wide and extend approximately 3/4 around the perimeter of the property. The parcel is 25.77 acres with a reported 15 acres being wetlands. The proposed road will cross these wetlands twice, according to the attached map. The length of the road is not given nor is the distance across wetland areas described. Also, the specific property location is not given. Since we were unable to locate the property from the information provided, we request that certification not be issued until an exact project location NCWRC; Project Number 960709; 8-20-96 p.2 is attached to the application and another site visit can be made.
