constructing a pond at SR 1413 and SR 14fi described in your application dated 26 July 1996. After
reviewing your application, we have deci,, . is covered by General Water Quality Certification
Number 2671. This certification allows .' onwide Permit Number 26 when it is issued by the
Corps of Engineers.
This approval is only valid for the p ` that you described in your application except as
modified below. If you change your pro9 us and you may be required to send us a new
application. For this approval to a vali a conditions listed in the attached certification
and any additional conditions listed belovvz and the existing pond shall be removed to high
ground. Spoil from new, excavation shall n' Hands. In addition, you should get any other

petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

The Wildlife Resources Commission has completed a
review of the project and associated impacts on wildlife and
fishery resources. A site visit was made on August 13,
1996.. Our comments are provided in accordance with
provisions of the Fish and Wildlife Coordination Act (48
Stat. 401, as amended; 16-:U.S.C. 661 et seq.), Section 401
of the Clean Water Act (as amended), and North Carolina
General Statutes (G.S. 113-131 et seq.).
The applicants are seeking certification to excavate
0.3 acre of cutover jurisdictional wetlands to construct a
pond. According 'to the site map,.approximately half of the
pond area would encroach on wetlands vegetated with
sweetgum, sweet bay, and red maple. Site wetlands provide
habitat for raccoon, muskrat, and opossum and also appear to
be associated with a stream to the west.
During our site visit, we saw some construction
activity in the same wetlands affected by the proposed
project but just north of the site of the proposed pond. A
small pond had already been dug and spoil from the
excavation had been piled in wetlands surrounding the pond.
Also, a ditch had been dug in an apparent attempt to drain

the wetlands. Due to adverse impacts to wetlands that have
already occurred at the site and the potential for more
damage, we recommend that certification be conditioned as
follows.
1. Excavation spoil in wetlands around the existing
pond must be removed to high ground and the ditch
draining the wetlands plugged or the site of the
proposed pond must be relocated entirely to high
ground:

Dear Mt. Pucci:
Reference your application of July 24, 1996, for Department of the Army
(DA) authorization to clear and drain approximately 3.2 acres of wetlands for
pasture and excavate 0.3 acre of wetlands for a pond, above the headwaters of
Town Creek, on your property located at the intersection of SR 1413 an SR 1412
near Bolivia, Brunswick County , North Carolina.
For the purposes of the Corps;;;' ineers' Regulatory Program, Title 33,
Code of Federal Regulations (CF' 0..6,.published in the Federal
Register on November 22, 1991,-i { nwide permits. Authorization,
pursuant to Section 404 of the,C r Act, was provided by Nationwide

Permit No. 26 for discharges of,, fill material into headwaters and
isolated waters.
Your work, sited in the coastalrea';`is authorized by this nationwide
permit provided it is accomplished=in strict accordance with the enclosed
conditions and any required State authorization. A consistency determination
is required from the North Carolina Division of Coastal Management (NCDCM)
Contact Mr. Steve Benton, telephone (919) 733-2293 for this consistency
determination. A Section 401 water quality certification.,is required from the
North Carolina Division of Water Quality. Contact Mr. John Dorney, telephone
(919) 733-1786 for this certification. This nationwide permit does not relieve
you of the responsibility to obtain other required State or local approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked, which will occur prior to January 21, 1997. It is
incumbent upon you to remain informed of changes to the nationwide permits,
which will be announced by public notice when they occur. If you commence, or
are under contract to commence, this activity before the date the nationwide
permit is modified or revoked, you will have twelve months from the date of
the modification or revocation, to complete the activity under the present
terms and conditions of this nationwide permit.
