Fullwood, Executive Director MEMORANDUM FROM: John Dorney Division of Water Quality Bennet t Wynne b1./fJ1 Habitat Conservation Program TO: DATE: July 25, 1996 SUBJECT: Harbor Development Corporation (c/o Mr. John Atkinson) 401 Water Quality Certification request for fill and excavation of wetlands across NC 211 from st. James Plantation, near Southport, Brunswick County, North Carolina. DEM ID: 960610. The Wildlife Resources Commission has reviewed the subject request for certification. A site visit was made on July 23, 1996. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and Section 401 (b) of the Clean Water Act (as amended). The applicant has applied for Water Quality Certification to excavate approximately 0.79 acre of wetlands that have become established in an old borrow area to create ponds and fill approximately 0.25 acre of wetlands to provide access to pockets of high ground. Certification is to facilitate construction of a combined office, retail, and residential complex. The old borrow area contains wax myrtle, pine, and some freshwater marsh vegetation. Shallow, standing water was present at the time of our visit. This area appears to provide good reproducing habitat for amphibians in the form of temporary, fish-free pools. The 404 wetlands proposed for filling appear to be associated with Beaverdam Creek, and thus may provide a ~~l A' ~ , water quality protection function in addition to their wildlife habitat value~. We recommend that the following measures be taken to reduce the extent of impacts to amphibian habitat and riparian wetlands: 1. Leave wetland Pocket 3 or a portion of wetland Pocket 4 in its current condition to provide some habitat for amphibian reproduction at the site. 2. Install culverts at the 404 wetland road crossings to maintain a hydraulic connection between adjacent wetlands. Thank you for the opportunity to comment on this project.
