Lake Park Blvd. Suite 4A Carolina Beach, NC 28428 Dear Mr. Weinbach: You have our approval to place fill material in 1.83 acres of wetlands or waters for the purpose of developing a residential subdivision at Phase II, Carolina Beach Village, as you described in your application dated 1 April 1996. After reviewing your application, we have decided that this fill is covered by General Water Qualit) Certification Number 2671 and 2732. These certifications allow you to use Nationwide Permit Numbers 14 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Stormwater shall be directed to flow into remaining wetlands following approval by DEM-Wilmington Regional Office for the final stormwater plan. Deed restrictions shall be placed on remaining wetlands to prevent future fill. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask "for a hearing. It appears that only the stormwater from approximately 8,000 sq. ft. of roadway will be discharge to the wetland. It is my opinion, based on existing topography and surrounding drainage features that this amount of stormwater will have little effect on the hydrology of this wetland. Wetland values in this area are generally low, with perhaps the most important value Bing water storage. This project is not within a sensitive watershed. This office has no major objection to the issuance of a 401 Certification for the proposed wetland fill provided that proper deed restrictions are used to insure that remaining wetlands are undisturbed and provided that a stonnwater management permit is obtained for this phase of the project. New Hanover County RECEIVED MAR 15 1996 ENVIRONMENTAL SCIENCES BRANCH The project has been reviewed to determine impacts to water quality. The following comments have been provided. A meeting was held in this office with the applicant's consultant, Charlie Hollis on December 8, 1995 to discuss the possibility of discharging a portion of the project's stormwater into the undisturbed wetlands on the project site. At this meeting we requested that the applicant submit a detailed plan showing how the stormwater would be discharged into the wetland area (outlet structure, elevations, etc.) as well as a calculation of how much impervious surface area would be routed to the wetland and not into the existing stormwater detention pond. Correspondence and work plats responding to this additional information request were submitted to this office by Charlie Hollis on February 12, 1996 and February 23, 1996. Wetland impacts for phase two of this project have been reduced to 1.83 acres. Total wetlands located on project site are 7 acres. Total wetland impacts for all phases of Carolina Beach Village will be 2.8 acres. The applicants are proposing to leave a 2.869 acre conservation area at the western end of the property. This conservation area includes 0.53 acres of highground. Total wetland preservation throughout project will be 3.77 acres. 1.8 acres of the phase two development area will have stonnwater directed into the 2.869 acre conservation area by way of a spill gutter at elevation 13.2'. A preliminary plat with topo lines indicate that only a small portion of this conservation area is below elevation 13.2'. These topo lines indicate that drainage is to the east. A final design plan with spot elevations in the conservation area indicate that drainage in this conservation area is to the northwest. This attached request represents a significant reduction of the Carolina Beach Village concept for which various infrastructure has been committed and on which the developer had based his investment return. The now-proposed completed project is a result of careful weighing of the values of the onsite wetland and cultural resources against the limited disturbance of these areas necessary for the construction of a project that is not likely to provide a complete cost-recovery for the investors. Initially 70 residential units were anticipated whereas this reduced project will provide for only 48. On balance, in exchange for the opportunity to construct the 48-unit project, Gulfstream Group, Inc. will: 1. preserve a significant section of the Civil War earthworks that exist within the high-ground of their property, 2. place 3.77 acres of wetlands into a perpetual conservation easement, and 3. place 0.53 acres of wetland-associated high ground into a perpetual conservation easement. The overall project as now proposed would cause the loss of a total of 2.95 acres of wetlands (0.97 Ac in Phase 1 and 1.98 Ac in Phase 2). t_ Page 2 in addressing the 404(b)(1) Guidelines for this project, the following steps have been taken: Avoidance. Gulfstream has aligned the project so as to take optimum advantage of available high ground and avoid only those wetlands necessary to realize this reduced project. Minimization. Clearing limits have been established to the rear and sides of the housing units to minimize wetland loss to only those areas absolutely required for the construction of the structures. Mitigation. 1. Preservation of that portion of the Civil War earthwork located south of the proposed road alignment (approximately 100 feet long) will be accomplished by placing that area in a conservation deed restriction. All of the earthwork is in high ground private property. 2. Preservation of wetlands at a ratio of 1.3 : 1 (3.77 Ac preserved to 2.95 Ac disturbed), and 3. preservation of .53 Ac of associated high ground will be assured by including these areas in conservation deed restrictions. DEM ID: 95790. Staff biologists with the Wildlife Resources Commission have reviewed the subject permit application. A site visit was made on August 8, 1995. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.). The applicant has applied for Water Quality Certification to place fill in wetlands for development of an access road and residential lots. A total of 1.98 acres of wooded wetlands including water oak, sweet bay, loblolly pine, grape and fern would be lost. Although the understory has recently been mowed, these wetlands retain habitat suitable for use by raccoon, opossum and a variety of songbirds. Project wetlands do not appear to be directly connected to surface waters, but that should not imply these wetlands have no stormwater retaining and filtration functions. Filling the wetlands may indeed divert stormwater normally retained onsite into adjacent surface waters where water quality impacts could occur. Therefore, we recommend that certification be conditioned to require the following project modifications: 1. Delete residential units 12, 13, 20 and 21 from project plans. A final wot.l.and delineation was performed and surveyed which reflects an acc-urate boundary of the jurisdictional wetlands present on the project site. The total wetland area iii approximately 1.8 acres. 2. The project wars rearranged so at, to minimize wetland loss,; specific illy, the buildingu were relocated insofar as pofitaible to avoid wetlands and three complete housing unite were eliminated from the plan. Ot.her areas were cut, out of the construction plan so as further avoid wetland disturbance. The result: of that effort reduced the total wetland impact to 0.97 acre. 3. The Corps pointed out that the "headwater.ta" point on the small drrsin was about 80' upstream of the property boundary on the east side, and that NWP-26 was not applicable downstream of that point.
